Resumen

Esta ley enmienda la Ley Núm. 144 de 2003 para requerir al Instituto de Cultura Puertorriqueña que presente informes semestrales a la Legislatura sobre el progreso en la identificación y actualización de estructuras con valor arquitectónico, histórico y cultural en Comerío. También le ordena someter propuestas anuales a la Oficina Estatal de Conservación Histórica para obtener fondos para este fin.

AN ACT

To amend Section 3, add a new Section 4 and redesignate present Section 4 as Section 5 in Act No. 144 of 2003, which directs the Institute of Puerto Rican Culture to identify and update the information of the structures located in the Urban Zone and in other lands of the Municipality of Comerío that have architectural, historic and cultural value as part of the cultural patrimony of this Municipality, in order to provide that the Institute of Puerto Rican Culture shall remit semiannual reports to the Legislature of Puerto Rico about the progress of the implementation of this Act and to direct said administrative agency to annually submit proposals to the Commonwealth Historic Preservation Office in order to obtain funds to promote compliance with the Act.

STATEMENT OF MOTIVES

Act No. 144 of 2003 directs the Institute of Puerto Rican Culture to identify and update the information of the structures located in the Urban Zone and in other lands of the Municipality of Comerío that have architectural, historic and cultural value as part of the cultural patrimony of said Municipality. To such purposes, it provided that the Institute should submit to the Planning Board and the Commonwealth Historic Preservation Office the identification and update of structures and lands to comply with the provisions of this Act. Provided, that the necessary funds to comply with this Act shall be identified, requested and consigned in the General Budget of Expenses of the Commonwealth of Puerto Rico commencing on Fiscal

Year 2003-2004 and subsequently, specifically in the budget appropriated to the Institute of Puerto Rican Culture.

However, after almost four (4) years of the approval of Act No. 144, supra, and we have been informed that the Institute has not been yet able comply with its provisions.

Considering the above, and for the purposes of ensuring the effective compliance with the provisions of this Act, it is deemed reasonable to require the Institute of Puerto Rican Culture comprehensive and detailed report on the progress of the implementation of this Act until the identification and updating process of the information about the structures located in the urban zone and other lands of the Municipality of Comerío that have architectural, historic and cultural value as part of the cultural patrimony of said Municipality.

Lastly, through this Legislation, said agency administrative is entrusted with the task of submitting proposals every year to the Commonwealth Historic Preservation Office in order to obtain funds to further compliance with this Act.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Section 3 of Act No. 144 of 2003 if hereby amended to read as follows: "Section 3.- The necessary funds to comply with this Act shall be identified, requested, and consigned in the General Budget of Expenses of the Commonwealth of Puerto Rico, specifically in the budget appropriated for the Institute of Puerto Rican Culture, beginning in fiscal year 2003-2004, and in subsequent years. Furthermore, the Institute of Puerto Rican Culture is hereby directed to annually submit proposals to the Commonwealth

Historic Preservation Office in order to obtain the funds that further compliance with this Act."

Section 2.- A new Section 4 is hereby added to Act No. 144 of 2003, to read as follows: "Section 4.- The Executive Director of the Institute of Puerto Rican Culture shall remit a comprehensive and detailed semiannual report to the Legislature of Puerto Rico about the progress of the implementation of this Act, until the said process concludes. Provided, that the same shall be submitted through the Office of the Secretary of the Senate and the Office of the Clerk of the House of Representatives."

Section 3.- Present Section 4 of Act No. 144 of 2003, is hereby redesignated as Section 5.

Section 4.- This Act shall take effect immediately after is approval.

I hereby certify to the Secretary of State that the following Act No. 55 (H.B. 3805) of the $7^{ ext {th }}$ Session of the $15^{ ext {th }}$ Legislature of Puerto Rico:
