Resumen
Esta ley enmienda la Ley de Municipios Autónomos para facultar a los municipios a contratar y establecer consorcios con otras agencias gubernamentales y entidades privadas para ofrecer servicios de centros de cuidado diurno (guarderías) a sus empleados y funcionarios. La ley busca armonizar con la política pública de bienestar familiar y el desarrollo infantil, reconociendo la importancia de la atención temprana. Autoriza a los alcaldes o funcionarios designados a coordinar con la Administración para el Cuidado y Desarrollo Integral de la Niñez y a notificar a la Administración de Familias y Niños sobre el establecimiento de estos centros.

AN ACT
To add subsection
(v) to Section 2.001 of Act No. 81 of August 30, 1991, as amended, known as the "Commonwealth of Puerto Rico Autonomous Municipalities Act of 1991," to empower the Municipalities of the Government of Puerto Rico to contract and establish consortiums with other government agencies, as well as to contract private entities to offer day care center services for their employees and officers.
STATEMENT OF MOTIVES
Act No. 84 of March 1, 1999, known as the "Act for the Creation of Child Day Care Centers at the Departments, Agencies, and Public Corporations and Instrumentalities of the Government of Puerto Rico," is in harmony with the public policy of the Commonwealth of Puerto Rico to watch over the general well-being of the family, particularly our children. From this point of view, it is recognized that early attention is vital for the development of useful citizens, who are willing to accept and carry out their duties and obligations within Puerto Rican society in a responsible manner.
However, the municipalities are not covered by said law. In view of this reality, this legislation proposes to empower the municipalities to contract and establish consortiums with other government agencies, as well as with private entities that provide similar services, to offer day care center services to their employees and officers. For purposes of complying with the provisions of this Act, the municipalities shall follow the guidelines established by state and federal regulations in effect for similar programs.
Finally, this measure responds to the need for providing mechanisms to guarantee excellent care services, and to promote the physical and moral development of these children in order to increase the productivity and work performance of the parents that work in the municipalities.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Subsection
(v) is hereby added to Section 2.001 of Act No. 81 of August 30, 1991, as amended, to read as follows: "2.001 - Powers:
(a) ...
(v) To contract and establish consortiums with other government agencies and private entities to provide day care center services their employees and officers in harmony with the provisions established by state and federal regulations in effect for similar programs.
The Mayor or designated officer is hereby authorized to take all pertinent steps with respect to the Integral Care and Development of Childhood Administration, the government entity that, in accordance with Reorganization Plan No. 12 of 1995, manages the funds received by the Government of Puerto Rico under the federal "Child Care and Development Block Act," as well as to establish consortiums with government agencies and private entities. Furthermore, the Mayor or authorized officer in the municipalities also has the obligation to notify the Family and Children Administration of the establishment of any day care center for the benefit of its employees."
Section 2.- This Act shall take effect thirty (30) days after its approval.
