Resumen
Esta ley enmienda la Ley Núm. 109 de 1 de septiembre de 2005 para posponer la fecha de efectividad de la Ley Núm. 278 de 14 de septiembre de 2004 hasta el 31 de marzo de 2006. La Ley Núm. 278, a su vez, enmendó la Ley Núm. 172 de 31 de agosto de 1996, conocida como la "Ley para el Manejo Adecuado del Aceite Usado en Puerto Rico", estableciendo la distribución de depósitos no reclamados entre agencias como la Junta de Calidad Ambiental, el Departamento de Hacienda y la Autoridad de Desperdicios Sólidos, así como su transferencia a fondos ambientales.

AN ACT
To amend Section 1 of Act No. 109 of September 1, 2005, for the sole purpose of postponing the effective date of Act No. 278 of September 14, 2004, as amended, until March 31, 2006.
STATEMENT OF MOTIVES
Act No. 109 of September 1, 2005, amended Act No. 278 of September 14, 2004, ("Act 278") in order to postpone the effective date of the provisions of "Act 278," since the implementation of the changes set forth in "Act 278" is highly complex thus making it necessary to postpone its effective date so as to ensure their correct implementation.
In spite of the meetings held by members of the Department of the Treasury, of the Environmental Quality Board and of the private sector affected by the provisions of "Act 278," to discuss the impact and the implementation of "Act 278," it is necessary to have additional time to consider all elements relative to "Act 278." For this reason this Legislature believes it appropriate to postpone the effective date of "Act 278" until March 31, 2006.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.-Section 1 of Act No. 109 of September 1, 2005 is hereby amended to read as follows: "Section 4.- This Act shall take effect after March 31, 2006, it being understood that during that time Sections 8, 11 and 12, as amended, of Act No. 172 of August 31, 1996, known as the "Act for the Proper Management of Used Oil in Puerto Rico", shall be in effect to September 13, 2004; except for the last sentence of the first $\left(1^{ ext {st }} ight)$ paragraph of Section 8 which is amended to read as follows: 'The unclaimed deposits shall be administered by the Department of the Treasury and fifty (50) percent of said unclaimed deposits shall be distributed among the agencies charged with the education, implementation and supervision of this Act as follows: The Environmental Quality Board, twenty-two point five (22.5) percent; the Department of the Treasury, sixteen (16) percent; and the Solid Waste Authority, eleven point five (11.5) percent and the remaining fifty (50) percent shall be transferred and deposited, in equal parts, with the Environmental Emergencies Fund and the Fund for Land Acquisition and Conservation, as provided in subsection 2 of Section 12 of this Act."
Section 2.-This Act shall take effect immediately after its approval.

I hereby certify to the Secretary of State that the following Act No. 170 (H.B. 2187) (Conference) of the $2^{ ext {nd }}$ Session of the $15^{ ext {th }}$ Legislature of Puerto Rico:
AN ACT to amend Section 1 of Act No. 109 of September 1, 2005, for the sole purpose of postponing the effective date of Act No. 278 of September 14, 2004, as amended, until March 31, 2006, has been translated from Spanish to English and that the English version is correct.
