THIS REGULATION AIMS TO MAINTAIN THE PROCEDURES AT THE INSPECTION FACILITIES ESTABLISHED BY THE AUTHORITY IN ITS MARITIME PORT FACILITIES AT THE PORT OF SAN JUAN.

This regulation, issued by the Puerto Rico Ports Authority on November 18, 2016, establishes procedures for the non-intrusive scanning of inbound cargo containers at the Port of San Juan. Its primary purpose is to enhance port security and safety, prevent the introduction of undisclosed contraband, and support the Treasury Department's efforts to identify unreported taxable goods. The Authority, responsible for managing the Port of San Juan and ensuring efficient commercial flow, implements a "fast track method" involving an imaging system capable of scanning up to 100% of containers. This initiative stems from a multi-party agreement in 2007 and Act No. 12 of 2008, which mandated cooperation among government agencies to improve tax fiscalization while minimizing disruption to commerce. A Memorandum of Understanding between the Treasury Department and the Authority further solidified these objectives. The scanning process commences after U.S. Customs and Border Protection completes its inspections, ensuring federal interests are released first. The regulation aims to strike a balance, maximizing security and tax enforcement goals without impeding the free and efficient movement of cargo. An "Enhanced Security Fee" is established to recover the costs associated with implementing and maintaining this comprehensive scanning service and related security improvements. Ultimately, these "Scanning Regulations" serve to uphold the public policy of the Commonwealth of Puerto Rico regarding port security, efficient commerce, and tax collection.
