The Commonwealth of Puerto Rico's Department of Labor and Human Resources, through a resolution dated March 11, 2009, amended its Occupational Safety and Health Regulation, Number Four (Part 1910). This amendment formally adopts the federal "Electrical Standard; Clarifications; Corrections; Final Rule" published by the Occupational Safety and Health Administration (OSHA) on October 29, 2008. The federal rule clarifies the scope of a specific provision, 29 CFR 1910.304(b)(3)(ii), within the electrical installation standard for general industry, and corrects two typographical errors. OSHA revised the provision's introductory text to explicitly state its application to "construction-like activities," encompassing certain maintenance, remodeling, or repair activities involving buildings, structures, or equipment. This clarification aims to align the regulatory text with OSHA's original intent, ensuring the rule applies to activities posing electrical hazards similar to those found in construction work, without altering substantive obligations. Puerto Rico recommended adopting the regulation with the same October 29, 2008, effective date as the federal government to ensure workers are protected by the latest electrical safety changes. The amended Puerto Rico regulation will be cited as "4 OSH 1910."
