A resolution from the Commonwealth of Puerto Rico's Department of Labor and Human Resources, dated December 23, 2002, and approved February 27, 2004, amends the Puerto Rico Occupational Safety and Health Regulation, Number Ten (Part 1926). Exercising authority under the Puerto Rico Occupational Safety and Health Act, the Secretary of Labor and Human Resources adopted the "Safety Standards for Signs, Signals, and Barricades; Final Rule." This amendment specifically incorporates the federal standard published in the Federal Register on September 12, 2002, pertaining to Part 10 OSH 1926 – Subpart G. The adoption became effective 30 days after its filing with the Department of State.
The referenced federal final rule, issued by the Occupational Safety and Health Administration (OSHA), revises construction industry safety standards for traffic control signs, signals, and barricades. It mandates that devices protecting workers conform to Part VI of either the 1988 Edition (with 1993 revisions) or the Millennium Edition of the Federal Highway Administration's Manual on Uniform Traffic Control Devices (MUTCD). This update replaces the previously required 1971 MUTCD standard, aligning OSHA's regulations with more current federal Department of Transportation guidelines. The federal rule itself became effective on December 11, 2002, following a revision to its initial proposed effective date.
