Resumen

Esta ley enmienda la "Ley de Pago de Salarios" para permitir deducciones voluntarias de nómina para donaciones a la Universidad de Puerto Rico. Autoriza a los empleadores a deducir una cantidad específica del salario de un empleado, previa autorización escrita, como contribución, regalo o donación a las campañas de recaudación de fondos de la Universidad de Puerto Rico. El empleador es responsable de remitir los fondos a la Universidad.

AN ACT

To add a new subsection

(p) to Section 5 of Act No. 17 of April 17, 1931, as amended, known as the "Payment of Wages Act," in order to allow voluntary payroll deductions for donations to the University of Puerto Rico.

STATEMENT OF MOTIVES

The public universities of the United States are nourished from three different sources for their operation: the money they receive from the State, the collections from tuition and other fees, and contributions from the private sector. It was not until recently, that the University of Puerto Rico began focusing on cultivating this last resource.

With the purpose of supporting the generation of a philanthropic culture in favor of the University in Puerto Rico, in the same tradition of public and private universities in the United States and in other parts of the world, the University of Puerto Rico initiated efforts directed to calling upon the alumni and friends, individuals and corporations to support, in financial terms, its work as the main educational center.

The Planning Agenda of the University, "Diez para la Década," approved by the university community in 2006, establishes as one of the goals of the university project to broaden the financing basis and solvency of the University. The University has drafted and enforced a plan to capture private funds for the purpose of cultivating philanthropy and to make private

donations the third sustained source of income. In order for this effort to be successful, it is necessary to establish the habit of giving and identify the ways to facilitate that individuals may make donations to the University.

This measure allows the University to petition funds to its alumni through payroll deductions. It likewise enables the University to petition the employer of its alumni to match the donations of the latter. In other words, this measure makes it possible to establish the alumni-employer matching system in donations to the University in Puerto Rico.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- A new subsection

(p) is hereby added to Section 5 of Act No. 17 of April 17, 1931, as amended, known as the "Payment of Wages Act," to read as follows: "Section 5.- Payment of wages--Deductions authorized Except in those cases provided in this Section, no employer may deduct or withhold for any reason whatsoever, part of the salary earned by his or her workers or employees except:

(a) ...

(b) When the worker or employee authorizes, in writing, his/her employer to deduct a specific amount from his/her wages as a contribution, gift, or donation to the fund raising campaigns of the University of Puerto Rico. It shall be the responsibility of the employer to make the corresponding disbursements and to remit the same to the University of Puerto Rico."

Section 2.- This Act shall take effect immediately after its approval.
