Resumen
Esta ley enmienda la Ley Núm. 200 de 14 de septiembre de 2006, que a su vez enmendó la Ley Núm. 253 de 27 de diciembre de 1995, conocida como la "Ley de Seguro Compulsorio de Responsabilidad Obligatoria para Vehículos de Motor". El propósito de la enmienda es clarificar el lenguaje y contenido de la Sección 1 de la Ley Núm. 200, específicamente en lo referente al mecanismo de identificación y el suministro de información digital mensual por parte del Departamento de Hacienda y el Departamento de Transportación y Obras Públicas a la Asociación de Suscripción Conjunta del Seguro de Responsabilidad Obligatoria para Vehículos de Motor. La ley detalla la información que debe incluirse en las listas digitales (nombre, dirección del asegurado, número VIN, número de marbete, fecha de pago, fecha de expiración y número de tablilla) y establece la responsabilidad de cada departamento en el proceso.

AN ACT
To amend Section 1 of Act No. 200 of September 14, 2006, in order to clarify its language and contents, and for other purposes.
STATEMENT OF MOTIVES
Act No. 253 of December 27, 1995, as amended, known as the "Compulsory Motor Vehicle Liability Insurance Act," was recently amended by Act No. 200 of September 14, 2006, for the purposes of directing the Department of the Treasury, the Department of Transportation and Public Works, and the Joint Underwriting Association of the Compulsory Motor Vehicle Liability Insurance (henceforth the "Association") to establish an identification mechanism through which the "Association" shall provided with a monthly digital list of those consumers or insured persons who pay their compulsory liability insurance with their license sticker payment. Section 2 of Act No. 200 establishes that the amendment shall take effect one hundred and eighty (180) days after its approval, reason for which said amendment is not in effect at present.
It should be noted that as it arises from the legislative history as well as from the Statement of Motives of Act No. 200, supra, the intention of the latter was solely to incorporate a new subsection
(n) (1) to Act No. 253, supra, so as to provide for those matters that concern the information to be furnished by the Department of the Treasury as well as by the Department of Transportation and Public Works to the "Association." It was never the
intention of the amendment in question to amend subsection
(c) of Section 6 of Act No. 253, supra. On the contrary, the Statement of Motives of Act No. 200, supra, sets forth the clear intention of not amending the aforementioned subsection by specifically providing that subsection
(c) of Section 6 was not the object of analysis under the bill and that its inclusion did not have the effect of analyzing, amending or giving an opinion about the same.
However, the new subsection
(n) (1) that was added to Section 6 inadvertently included part of the text of subsection
(c) of Section 6 itself. For this reason, the Legislature believes it necessary to correct the latter, thus clarifying the language and contents of the new subsection
(n) (1) according to the legislative intent. Since the amendment introduced by Act No. 200, supra, has never been in effect, we believe that this is the proper moment to clarify its contents and scope.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.-The content of Section 1 of Act No. 200, supra, of September 14, 2006, is hereby amended to read as follows: "(n)(1) The Secretary of the Treasury shall provide the Association with a monthly digital list of all license stickers acquired, for purposes of identification, by consumers or insured persons who upon acquiring their license sticker purchase the Compulsory Motor Vehicle Liability Insurance at the Internal Revenue Collector's Offices, Financial Institutions and Official Inspection Stations, should the latter apply. The digital list to be provided every month shall contain the name and address of the insured, and the motor vehicle identification number (VIN number), the license sticker number, the date of payment, the date of expiration, and the plate number. The Department of
Transportation and Public Works shall be responsible for providing to the Department of the Treasury a monthly digital list with the name and address of the insured and the motor vehicle identification number (VIN number), so that the Department of the Treasury may provide all the required information to the 'Association.'" (2) In the case of all those license stickers acquired by consumers or insured persons through the Official Inspection Stations, the Department of Transportation and Public Works shall provide to the 'Association' a monthly digital list containing the name and address of the insured, or the motor vehicle identification number (VIN number), license sticker number, date of payment, date of expiration, and plate number, as well as any information concerning the insured received by the Department of Transportation and Public Works from the Department of the Treasury."
Section 2.-Effectiveness This Act shall take effect immediately after its approval.
