Resumen

Esta ley enmienda la Ley Núm. 38 de 24 de abril de 2007 para restablecer el texto omitido de la Ley Núm. 91 de 29 de marzo de 2004, conocida como la "Ley Orgánica del Sistema de Retiro para Maestros del Estado Libre Asociado de Puerto Rico". El propósito es aumentar el ingreso anual mínimo vitalicio para los maestros jubilados de trescientos (300) dólares a cuatrocientos (400) dólares mensuales, con efectividad a partir del 1 de julio de 2007. La ley detalla cómo se calculará el aumento para los pensionados existentes y establece que los fondos necesarios provendrán de asignaciones del Fondo General.

AN ACT

To amend Section 3 of Act No. 38 of April 24, 2007, in order to re-establish the text that was omitted, belonging to Act No. 91 of March 29, 2004, as amended, which was amended by Act No. 38, supra, in order to increase the minimum annual lifetime income from three hundred (300) dollars to four hundred (400) dollars for the teachers who retire from the service.

STATEMENT OF MOTIVES

In order to address to the needs of pensioners, Act No. 38 of April 24, 2007, amended Act No. 91 of March 29, 2004, as amended, better known as the "Commonwealth of Puerto Rico Teacher's Retirement System Organic Act," for the purpose of granting two (2) increases of three (3) percent to the pensions granted under the aforementioned Act, before January 1, 2004.

Through this Act, the minimum annual lifetime income for all teachers retiring from the service was also increased from three hundred (300) dollars to four hundred (400) dollars. Inadvertently, in Section 3 of Act No. 38, supra, the text of Section 25 of Act No. 91, supra, that was amended to increase the minimum annual lifetime income for retired teachers was omitted. The purpose of this bill is to rectify the aforementioned involuntary omission.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Section 3 of Act No. 38 of April 24, 2007, is hereby amended to read as follows:

"Section 25.- Annual Lifetime Income The minimum annual lifetime income for all teachers who retire from service shall be four hundred (400) dollars per month.

Effective the 1st of July 2007, the minimum pension to be received by the participants who retire according to the provisions of Act No. 91, supra, or from any of the pension plans the latter supersedes, shall be raised to four hundred (400) dollars per month. Every pensioner shall have his/her pension increased in an amount equal to the difference between the pension he/she receives and the proposed pension of four hundred (400) dollars that goes into effect. The funds needed to cover the cost which the increase in the pensions of the teachers entails shall proceed from appropriations from the General Fund for the pensioned teachers."

Section 2.- This Act shall take effect immediately after its approval.

AN ACT to amend Section 3 of Act No. 38 of April 24, 2007, in order to re-establish the text that was omitted, belonging to Act No. 91 of March 29, 2004, as amended, which was amended by Act No. 38, supra, in order to increase the minimum annual lifetime income from three hundred (300) dollars to four hundred (400) dollars for the teachers who retire from the service, has been translated from Spanish to English and that the English version is correct.
