AN ACT

To amend Section 4 of Act No. 54 of August 22, 1990, as amended, in order to add a youth representative to the Board of Directors of the School of Plastic Arts.

STATEMENT OF MOTIVES

For the purpose of reaffirming and strengthening the academic autonomy in the plastic arts and to facilitate the development thereof, the Legislature approved Act No. 54 of August 22, 1990, as amended, through which the School of Plastic Arts became an autonomous entity attached to the Institute of Puerto Rican Culture.

In accordance with its Organic Act, the School of Plastic Arts is a higher education institution, vested with all the rights, powers, faculties and duties held by said institutions and in compliance with the social mission of intellectually and spiritually developing students within a universal and particular culture in order to contribute to the development of these cultures and to the wellbeing of society.

Within this objective, it has been firmly established in the traditional higher education institutions that it is necessary that the main clientele constituted by youths and students be represented in the directive bodies of the institution, without this preventing that the maximum governing body from being composed mainly of persons who are not linked by direct interests to the administrative decisions within the institution. The

University of Puerto Rico has established the precedent of having student and teaching representation inclusively in its Board of Trustees.

In a previous session, H. B. 336 expressly proposed to elect students and academic personnel as trustees of the Board of Directors of the School of Plastic Arts. Due to the fact that said bill was vetoed on the grounds that there was no need to increase the number of directors, this Legislature nevertheless deems that there should be youth representation present, in any case requiring that one of the representatives of the public sector be such representative.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Section 4 of Act No. 54 of August 22, 1990, as amended, is hereby amended to read as follows: "Section 4.- The School shall have a governing board that shall be named "Board of Directors of the School of Plastic Arts," hereinafter "the Board," whose functions, duties, and composition shall be:

(a) Composition of the Board. The Board shall be composed of seven (7) members, four (4) of them appointed by the Board of Directors of the Institute of Puerto Rican Culture, who may not be employees of the School and shall represent the public, educational and cultural interest. Two (2) of them shall be appointed for four (4) years, one (1) for three (3) years and one for two (2) years. One of said members shall be a person between the ages of eighteen (18) and thirty-five (35) years and/or one (1) regular student at under graduate level. The Board of Directors of the Institute of Puerto Rican Culture shall also elect from among and by a majority of its members, three (3) directors who shall serve in the Board of the School and one

of them shall hold the position of President. These last three (3) members shall remain in their positions until the term of their appointments to the Board of Directors of the Institute of Puerto Rican Culture expires and their successors are appointed and take office. In the event of a vacancy, substitutes shall be appointed who shall perform their functions for the remainder of the term of the member causing the vacancy.

Section 2.- The present Board of Directors of the School of Plastic Arts, as constituted by the Act in effect shall continue with its configuration according to its present terms of appointments and if future vacancies should occur, they shall be filled in compliance with the purposes of the amendment contained in this Act.

Section 3.- This Act shall take effect immediately after its approval.

AN ACT to amend Section 4 of Act No. 54 of August 22, 1990, as amended, in order to add a youth representative to the Board of Directors of the School of Plastic Arts, has been translated from Spanish to English and that the English version is correct.
