AN ACT
To add Section 13A to Title IV of Act No. 75 of June 24, 1975, as amended, known as the "Puerto Rico Planning Board Organic Act," to require all persons who request from the Planning Board a location verification for construction works located within a radius of two hundred (200) meters from the territorial limits between two (2) municipalities to notify both municipalities so that they may state their comments regarding the requested verification; and for other purposes.
STATEMENT OF MOTIVES
The Commonwealth of Puerto Rico strengthened the direction, coordination, and integration of the public policy on integral development of the country through the "Puerto Rico Planning Board Organic Act."
The purpose of said legislation was to coordinate and integrate the efforts of the different government sectors in order to achieve an integral and balanced development of society.
In recent years, the Puerto Rican society has undergone transformations, evincing the problem of the location of works when the same are located within the territorial limits of more than one municipality; especially when environmental, socioeconomic and other types of impacts may directly affect a bordering municipality that shall not benefit from this location.
With this measure, the Legislature intends to require that bordering municipalities be notified of location verifications submitted to the Planning Board when any works located within one municipality are within a limit of two hundred (200) meters from another municipality, so that, when it considers the location
verification, the Planning Board may take into account the position of each bordering municipality with respect to the project in question.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 13A is hereby added to Title IV of Act No. 75 of June 24, 1975, as amended, to read as follows: "TITLE IV.- SPECIAL FUNCTIONS AND POWERS OF THE BOARD Section 13.- . . .
