Ley 32 del 2005

Resumen

Esta ley deroga la Ley Núm. 9 de 2 de julio de 1973, eliminando el Comité Especial de la Legislatura para el Estudio de los Sistemas de Retiro. La ley argumenta que la eliminación de este comité especial es parte de un mandato para reducir el gasto público y aumentar la eficiencia legislativa, transfiriendo sus funciones a otros comités existentes.

AN ACT

To repeal Act No. 9 of July 2, 1973, as amended, in order to eliminate the Special Committee of the Legislature for the Study of the Retirement Systems.

STATEMENT OF MOTIVES

Act No. 9 of July 2, 1973, as amended, created the Special Committee for the Study of the Retirement Systems. This Special Committee of the Legislature has functions such as "studying the government retirement systems and their retirees, to propose the adoption of all legislation which is necessary and convenient to improve the administration of said systems, to give them vitality, strengthen, and preserve their financial standing, as well as everything related to the benefits offered by them, their participants, retirees, and their benefits." In addition, the Special Committee for the Study of the Retirement System is responsible for the study and evaluation of the proposals concerning the retirement of public employees presented by the Executive and the Legislative Branch, the systems and their participants, either as a group or individually; as well as to study and consider all legislation concerning retirement that is filed in the Legislative Bodies.

Last November 2, 2004, the People of Puerto Rico gave a mandate to this Legislature to be more strict and conservative in the use of public funds, among other things. This mandate together with another through which the

elimination or cut of standing legislative committees, whether created by law or by resolutions, was demanded; since by doing so there would be savings in the budget, and at the same time the efficiency of the legislature would be increased.

Due to said mandate, since its beginning, the Fifteenth Legislature deemed it was necessary to undertake a process of dramatic cuts in the number of existing committees. To such purposes, it is imperative to amend the laws or sections that direct the creation of many committees, so that their functions and jurisdictions may be assumed by other committees. The Special Committee for the Study of the Retirement Systems is among those that may be eliminated without causing further adverse consequences on the administration of Legislative Bodies; thus propitiating legislative savings.

It is important to mention that the repeal of Act No. 9, which created this Special Committee of the Legislature for the Study of the Retirement Systems, does not affect the attention each Legislative Body may give to matters related to our retirees and public employees.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Act No. 9 of July 2, 1973, as amended, is hereby repealed. Section 2.- This Act shall take effect immediately after its approval.
