Esta ley enmienda la Ley de Procedimientos Legales Especiales para requerir que, como parte de los documentos que acompañan una petición de adopción, se presente una certificación negativa de deuda de la Administración para el Sustento de Menores (ASUME). El propósito es asegurar que el adoptante no tenga deudas de pensión alimentaria y sea financieramente responsable con sus dependientes.

To amend subsection
(g) of Section 612B(G) of Act No. 9 of January 5, 1995, as amended, known as the Special Legal Proceedings Act so as to require the presentation of a negative debt certification from the Child Support Administration (ASUME, Spanish acronym) as part of the documents that accompany the adoption petition.
The Special Legal Proceedings Act, formerly known as the Code of Civil Procedure, was amended by Act No. 9 of January 19, 1995. The purpose of Act No. 9, supra, was to establish a new summary proceeding, similar to the eviction trial proceeding, to expedite the adoption process for persons who wish to take in as parents unprotected and abandoned minors and disabled persons into their homes.
Act No. 9, supra, repealed Sections 612 through 613F of the Code of Civil Procedure of 1933, as amended, and added Sections 613G through 613P.
At present Section 612B of the Special Legal Proceedings Act establishes the contents of the petitioner's adoption petition. Subsection G indicates the documents that shall accompany the petition. It is required to include therein the birth certificates of the adopter and the adoptee, the civil status certificates of the adopter and the adoptee, the negative criminal record of the adopter, the written consent of the biological parent or parents when these are available, a report on the expert social study for the adjudication, in case it is available, a motion to summon court appearance and proposed decision in uncontested cases and the proposed new
birth certificate. However, the adopter is not required to show evidence of a negative debt certification from the Child Support Administration (ASUME, Spanish acronym), through which the Department of the Family shall know whether the adopter has any dependents and if he/she has been financially responsible therewith.
Section 1.- Subsection
(g) of Section 612B of Act No. 9 of January 15, 1995, as amended, known as the "Special Legal Proceedings Act," is hereby amended to read as follows: "Section 612B.- Contents of the Adoption Petition The petitioner shall file an adoption petition, under oath, to the Part of the Court of the First Instance corresponding to the place of residence of the adoptee. Said petition shall contain the following:
The petition for adoption shall be submitted under oath, to the Part of the Court of the First Instance corresponding to the place of residence of the minor, and it shall contain the following: a. ( ...) b. ( ...) c. ( ...) d. ( ...) e. ( ...) f. ( ...) g. A list of documents, which shall accompany the petition, among which the following shall be included or their unavailability
