Esta ley enmienda la Ley de Control de Contaminación del Aire para armonizar sus sanciones penales con el nuevo Código Penal de Puerto Rico de 2004. Establece que las violaciones a la ley o sus reglamentos, con ciertas excepciones, constituyen un delito menor, y las violaciones voluntarias y maliciosas a la Sección 15 se consideran un delito grave de cuarto grado.

To amend subsections
(a) and
(b) of Section 17 of Act No. 157 of June 28, 1968, known as the "Air Pollution Control Act" to harmonize it to the new Penal Code of the Commonwealth of Puerto Rico.
The present is one of several amendments to the laws that are affected by the approval of the new Penal Code of the Commonwealth of Puerto Rico, which, in turn, repeals the one in effect approved through Act No. 115 of July 22, 1974.
It is imperative to adjust the penal code of laws so that when the new Penal Code is introduced, there is uniformity in said code of laws.
Section 1.- Subsections
(a) and
(b) of Section 17 of Act No. 157 of June 28, 1968 are hereby amended to read as follows: "Section 17.- Penalties
(a) Any person who violates the provisions of this Act or of the regulations adopted by virtue thereof, with the exception of Section15 and 16 shall incur in a misdemeanor. Each day of said violation shall constitute a different and separate crime.
(b) Any person who voluntarily and maliciously violates the provisions of Section 15 shall incur a fourth degree felony.
Section 2.- Effectiveness This Act shall take effect upon effectiveness of the Commonwealth of Puerto Rico Penal Code of 2004.
