Esta ley enmienda la Ley de la Autoridad de los Puertos de Puerto Rico para autorizar a la Autoridad a recopilar datos estadísticos de las compañías de transporte aéreo y marítimo que utilizan sus instalaciones. El propósito es crear una base de datos para la planificación y mercadeo efectivo de actividades turísticas. La información recopilada será confidencial, pero las cifras agregadas estarán disponibles para diversos grupos, incluyendo estudiantes, universidades, prensa, agencias gubernamentales, negocios turísticos y potenciales inversores, previa solicitud.

(v) in Section 6 of Act No. 125 of May 7, 1942, as amended, known as the "Puerto Rico Ports Authority Act," to authorize the Authority to obtain, by electronic or manual means, the necessary statistical data from the air and marine transport companies that use its facilities, to develop a data base for effective planning and marketing of tourism activities; and other purposes.
Tourism has become one of the most important commercial activities in Puerto Rico. Being an island, Puerto Rico, essentially depends upon air and marine transportation for the development of the tourism industry.
For this reason, to position our country as a first order tourism market, specific and reliable statistic information is necessary, for us to have the opportunity to develop marketing plans, strategies, and projections, as well as effective and competitive planning projects.
The Puerto Rico Ports Authority has the development and administration of all types of transportation facilities and related services in Puerto Rico under its charge. Therefore, we understand that this government entity is the most appropriate to obtain detailed tourism information from the private sector of said industry.
On the other hand, the information to be supplied to the Ports Authority shall be confidential in nature, and the detailed, aggregated figures shall be
available to students, universities, press, government agencies, and the tourism businesses that supply same, as well as to potential investors, with prior request submitted to the Authority; which shall be an incentive that shall assist in the development of future plans.
Section 1.- A new subsection
(u) is hereby added, and the current subsection
(u) is hereby redesignated as subsection
(v) in Section 6 of Act No. 125 of May 7, 1942, as amended, known as the "Puerto Rico Ports Authority Act," to read as follows: "Section 6.- Powers of the Authority The purposes of the Authority shall be to develop and improve, own, operate, and manage any and all types of air and marine transportation facilities and services, as well as to establish and manage mass marine transportation systems in, to and from the Commonwealth of Puerto Rico on its own, or in coordination with other government, corporate or municipal entities, and make available the benefits thereof in the most extensive and least costly manner, thereby promoting the general welfare and increasing commerce and prosperity; and the Authority is granted, and shall have and may exercise all rights and powers that are necessary or convenient to carry out the aforesaid purposes, including the following, but not without limiting the generality of the foregoing;
(a) To have perpetual existence as a corporation.
(b) $\ldots$
(u) The Authority shall obtain, by electronic or manual means, the necessary statistical data regarding the number of travelers, expenses incurred, satisfaction and interests of same, among others, from the air and marine
transport companies that use its facilities, to develop a data base for effective planning and marketing of tourism activities, and such data shall be confidential in nature, and the detailed, aggregated figures shall be available to students, universities, press, government agencies, and the tourism businesses that supply same, as well as to potential investors, with prior request submitted to the Authority. This provision shall not diminish the powers granted to other agencies, dependencies, or instrumentalities of the Commonwealth of Puerto Rico that handle matters of this same sort.
The Authority shall approve a regulation to ensure compliance with this subsection within a term of ninety (90) days after the approval of this Act.
(v) To do all acts or things necessary or convenient o carry out the powers granted to it by Sections 1 to 22 of this Act or by any other Act of the Legislature of Puerto Rico, or by any Act of the Congress of the United States; Provided, however, that the Authority shall have no power at any time or in any manner to pledge the credit or taxing power of the Commonwealth of Puerto Rico or any of its political subdivisions, nor shall the Commonwealth of Puerto Rico or any of its political subdivisions be liable for the payment of the principal or of interest on any bonds issued by the Authority."
Section 2.-This Act shall take effect ninety (90) days after its approval.
I hereby certify to the Secretary of State that the following Act No. 128 (H.B. 2054) of the $5^{ ext {th }}$ Session of the $14^{ ext {th }}$ Legislature of Puerto Rico:
