Esta ley enmienda la Ley Núm. 3 de 22 de agosto de 1990 y la Ley Núm. 9 de 27 de noviembre de 1990 para rectificar la descripción de una propiedad en el sector Condado de San Juan, segregarla en cuatro lotes independientes, establecer una servidumbre legal a favor del Estado Libre Asociado de Puerto Rico en el lote donde se desarrolla la "Plaza La Gran Ventana al Mar", y ordenar al Registro de la Propiedad realizar las anotaciones e inscripciones correspondientes. También deroga una sección de la Ley Núm. 9 para liberar una servidumbre previamente creada y reubicar el acceso a la playa.

To amend Section 2; add a new Section 3; amend Sections 3 and 4 and renumber them as Sections 4 and 5 respectively; to amend Section 5 and renumber it as Section 6; to repeal Section 6 ; to amend Section 7 of Act No. 3 of August 22, 1990, as amended, to rectify the area and to segregate the lot owned by "Hotel Development Corporation" into four (4) independent lots; to order the Registrar in charge of the corresponding Section of the Registry of Property to make the notations and inscriptions required by law, to establish a legal easement in favor of the Commonwealth of Puerto Rico, located in the lot where the "Plaza La Gran Ventana al Mar" is being developed; and to repeal Section 4 of Act No. 9 of November 27, 1990, for the purpose of releasing the easement there created, to relocate the access to the beach north of the hotels La Concha and Condado Beach on the lot where the "Plaza La Gran Ventana al Mar" is being developed and for other purposes.
On August 22, 1990, Act No. 3 was approved with the purpose of formally transferring ownership to the Puerto Rico Industrial Development Company of certain property recovered from the sea by the efforts of men, where Hotel Condado Beach, the Convention Center and the Hotel La Concha were built.
Afterwards, on November 27 of the same year, Act No. 9 was approved with the purpose, among others, of relocating the easement established through Section 4 of Act No. 3. At that time, relocation of the easement was decided upon when it was discovered that the approved access would be
inadequate and could be dangerous since high tension wires, and steam and flammable gas pipes crossed through the site of the easement. Additionally, an electrical generating plant which, on one side, had a fuel storage tank with a five hundred (500) gallon capacity located inside the easement area. For those reasons, the Legislature deemed it convenient to relocate the easement to the east side, which in those days was Hotel La Concha.
Presently, after the demolition of the Convention Center, the Government of the Commonwealth of Puerto Rico has made an access to the beach available to the public, known as "Ventana al Mar," located behind hotels La Concha and Condado Beach. This access having become available, and after the modifications made in the area, it is more convenient for the citizenry in general and for our visitors to relocate the access to the beach and that the same be through the land of Ventana al Mar.
This Legislature deems it necessary and proper in the public interest, to amend Act No. 3 to describe the correct area of the property where hotels La Concha and Condado Beach and the Convention Center are located; to segregate said property into four (4) independent plots; to provide that in the future, access to the beach in front of Hotels La Concha and Condado Beach shall be through the land where the Convention Center was built, through the Ventana Al Mar, as well as to rezone said land for public use, and additionally, to harmonize Act No. 3 to the new development contemplated. Furthermore, it proposes to repeal Section 4 of Act No. 9, supra, due to the fact that the governmental public policy is no longer the privatization or sale of land belonging to the Commonwealth of Puerto, or to its agencies or instrumentalities and to give immediate effect to the proposed easement.
Section 1.- Section 2 of Act No. 3 of August 22, 1990, as amended, is amended to read as follows: "Section 2.- It is declared that the plot the description of which follows, where the former Hotel Vanderbilt, also known as Condado Beach Hotel, where the Convention Center used to be and where presently "La Plaza La Gran Ventana al Mar" is being developed, and the former La Concha Hotel in the Condado Sector of the Santurce North neighborhood, in the Municipality of San Juan, belongs to the Hotel Development Corporation, which is a subsidiary of the Puerto Rico Tourist Company, described in the Property Registry as follows: 'URBAN.- Plot of land, located in the Condado Sector of the Santurce North Neighborhood of the Municipality of San Juan, Puerto Rico, with a superficial area of thirty-six thousand eight hundred ninety-eight point five thousand eight hundred and sixty square meters, $(36,898.5860)$ equivalent to nine cuerdas three thousand eight hundred and eighty ten thousandths of another (9.3880) cuerdas abutting on the NORTH with the maritime land zone of the Atlantic Ocean, Public Domain Lot and the street Seaview; on the SOUTH with Seaview Street and the Ashford Avenue: on the EAST, with land owned by Luisa Calaf Brunet de Guijarro, with Sea View Street, with the land formerly belonging to Louisse de Cásseres Vending, today the property of the Puerto Rico Industrial Development Company, and lands owned by Concepción Brunet Calaf; and on the WEST, with land belonging to Modesto Bird.'
Said plot is recorded on Folio 11, Volume 963 of Santurce NORTH, Property Number 40,970.00, first recording.
According to the measurements performed by Marcelino Díaz-Declet, land surveyor, license number 7915, in July 1998, and certification signed by the same, on February 27, 2003, the plot has a surface of 37,962.7155 square meters equivalent to 9.65875 cuerdas and new metes and bounds. Said surface increase resulted to be 1064.1295 square meters, equivalent to 0.2707436 cuerdas. Such surface increase over the measurement of the foregoing recorded surface was due to mistakes in distances and to the fact that methods used in the past to establish its surface were not as exact and reliable as the ones available at the date when the measurements were performed, in which technical procedures of high quality and modern high precision electronic equipment were used. It is hereby ordered the recording thereof in the property registry as farm number 40,970 . As it is described below: 'URBAN'- Plot of land, located in the Condado Sector of the Barrio Santurce North in the Municipality of San Juan, Puerto Rico, with a surface of thirty-seven thousand nine hundred sixty-two square meters with seven thousand one hundred and fifty-five ten thousandths of square meters (37,962.7155 square meters), equivalent to nine cuerdas with seventy-five thousand eight hundred seventy-five one hundred thousandths cuerdas ( 9.65875 cuerdas) abutting on the NORTH, with the maritime terrestrial Atlantic Ocean; on the SOUTH, with Dr. Ashford Avenue; on the EAST, "Sea View Apartments", with Sea View Street, with a plot owned by Puerto Rico Industrial Development Company (P.R.I.D.C.O.) and with the Subway Restaurant; and on the WEST with land owned by Modesto Bird."
Section 2.- A new Section 3 is added to Act No. 3 of August 22, 1990, as amended, to read as follows: "Section 3.- The plot described in Section 2 of this Act is subdivided into four independent plots "hereinafter referred to as "Plots", and each one is so segregated, as it is recorded in the segregation plan which forms part of this Act, and which shall remain recorded in the Property Registry with the following descriptions:
PLOT A: 'URBAN. A strip of land to be dedicated to public use called Plot "A", located in Barrio Santurce, Condado Sector, of the Municipality of San Juan, Puerto Rico, with a surface of FIVE HUNDRED TWENTY-EIGHT POINT SEVEN THOUSAND FIVE HUNDRED EIGHTY-SIX SQUARE METERS (528.7586 square meters) equivalent to zero cuerdas point thirteen thousand four hundred fifty-three hundred thousandths cuerdas ( 0.13453 cuerdas) abutting on the NORTH, in eight (8) different alignments adding up to One Hundred Sixty-Two point Two Thousand Six Hundred Thirty Linear Meters (162.2630 linear meters), abutting the first in a distance of Thirteen point Five Thousand Seventy-Six linear meters (13.5076 linear meters) with the Plot "B" (Vanderbilt Hotel), from the second to the fifth, in a distance of One Hundred and Eight point Five Thousand Three Hundred Forty-Six linear meters (108.5346 linear meters), with Plot "D"called "Plaza Ventana al Mar"; and the sixth and eighth in a distance of Forty point Two Thousand Two Hundred and Eight linear meters (40.2208 linear meters), with Parcel "C" (Hotel La Concha); to the SOUTH in four (4) lines that amount to One Hundred Sixty-Two Point Zero Six Hundred Twenty (162.0620 linear meters) with Dr. Ashford Avenue, to the EAST, at the dipping
point with Parcel "C" (Hotel La Concha); and to the WEST, at the dipping point with four hundred forty-five with Parcel "B" (Hotel Vanderbilt)."
PLOT B: 'URBAN: A strip of land called Plot "B" (Hotel Vanderbilt), located in Barrio Santurce, Condado Sector, Municipality of San Juan, Puerto Rico, with a surface area of ELEVEN THOUSAND TWO HUNDRED EIGHTY-TWO POINT TWO THOUSAND THREE HUNDRED FORTY-ONE SQUARE METERS (11,282.2341 sq.m) equivalent to Two cuerdas with EightySeven Thousand Fifty-One Hundred Thousandths cuerdas (2.87051 cuerdas). On Boundaries to the NORTH, in fifteen (15) different lines that amount to One Hundred Seventy-Nine point Eight Thousand One Hundred Thirty-Nine Linear Meters (179.8139 l.m.) with the Maritime Territorial Zone of the Atlantic Ocean; to the SOUTH, in three (3) different lines that amount to One Hundred Sixty-Eight point Forty-Three Thousand Eight Hundred Seventeen Linear Meters (168.43817 l.m.) the first and the second adjacent at a distance of One Hundred and Fifty-Five point Three Thousand Eight Hundred Twenty-Nine Lineal Meters (155.3829 l.m.) with plot "A" to be dedicated to public use; on the EAST, in one (1) line that meets at Fifty-Eight point Zero Seven Hundred Sixty-Six Linear Meters (58.0766 l.m.) with Mr. Modesto Bird's property, occupied by L&M Car Rental and by Nono Maldonado."
PLOT C: "URBAN: A strip of land called Plot "C" (Hotel La Concha), located in Barrio Santurce, Condado Sector, Municipality of
San Juan, Puerto Rico, with a surface area of SEVENTEEN THOUSAND FIVE HUNDRED FIFTY-NINE POINT ZERO ONE HUNDRED THIRTY-FIVE SQUARE METERS (17,559.0135 sq. m.) equivalent to Four cuerdas and Forty-Six Thousand Seven Hundred Forty-Nine One Hundred Thousandths cuerdas (4.46749 cuerdas). On boundaries to the NORTH, on six (6) different lines that amount to One Hundred Seventy-One point Zero Zero Fifty-Eight Linear Meters (171.0058 1.m.), with the Maritime Terrestrial Zone of the Atlantic Ocean; to the SOUTH, in nine (9) different lines that amount to One Hundred Ninety-Six Point Two Thousand Six Hundred Ninety-Three Linear Meters (196.2693 1.m.), the first adjacent to the third in a distance of Forty point Two Thousand Two Hundred Eight Linear Meters (40.2208 1.m.), with Plot "A" to be dedicated to public use, and from the fourth to the ninth in a distance of One Hundred Fifty-Six Point Zero Four Hundred Eight-Five Linear Meters (156.0485 1.m.) with Dr. Ashford Avenue; to the EAST, in five (5) different lines that amount to Ninety-Nine point Nine Thousand Six Linear Meters (99.9006 1.m.); the first adjacent in a distance of Twenty-Three point Five thousand Five Hundred SixtyNine Linear Meters (23.5569 1.m.) with Sea View Apartments, the second, in a distance of Ten Point Three Thousand Nine Hundred Thirty-Four Linear Meters (10.3934 1.m.), with Sea View Street; and the third and fourth at a distance of THIRTY POINT EIGHT THOUSAND ONE HUNDRED SEVENTY-EIGHT Linear Meters (30. 8178 1.m.) with a plot owned by P.R.I.D.C.O., and the fifth at a distance of THIRTY-FIVE POINT ONE THOUSAND TWENTY FIVE Linear Meters (35.1325 1.m.) with Subway Restaurant, and to
the WEST, in three (3) different lines that amount to Ninety-Eight point Seven Thousand Two Hundred Ninety-Nine Linear Meters (98.7299 l.m.), with Plot "D" called "Plaza Ventana al Mar."
PLOT D: 'URBAN: Plot of land called Plot "D" (Plaza Ventana al Mar), located in Barrio Santurce, Condado Sector, Municipality of San Juan, Puerto Rico, with a surface area of EIGHT THOUSAND FIVE HUNDRED NINETY-TWO POINT SEVEN THOUSAND NINETY-THREE SQUARE METERS (8,592.7093 sq.m.) equivalent to Two Cuerdas point Eighteen Thousand Six hundred Twenty-Two One Hundred Thousandths cuerdas (2,18622 cuerdas). With boundaries to the NORTH, in one (1) line that meets One Hundred Seven Point Nine Thousand One Hundred Thirty-Four Linear Meters (107.9134 l.m.) meeting with the Maritime Terrestrial Zone of the Atlantic Ocean; to the SOUTH, in four (4) different lines that amount to One Hundred Eight point Nine Thousand Eight Hundred NinetySix Linear Meters (108.9896 l.m.), with Plot "A" to be dedicated to public use, to the EAST, in three (3) different lines that amount to Ninety-Eight point Seven Thousand Two Hundred Ninety-Nine Linear Meters (98.7299 l.m.) with Plot "C" (Hotel La Concha); and to the WEST, with one (1) line that measures Sixty-Four point Six Thousand Eight Linear Meters (64.6080 l.m.) and meets with Plot "B" (Hotel Vanderbilt)."
Section 3.- Section 3 of Act No. 3 of August 22, 1990, as amended, is hereby renumbered as Section 4 and amended to read as follows: "Section 4.- The free and continuous maritime and pedestrian access is guaranteed to the maritime terrestrial zone abutting with the plots segregated and described in Section 3 of this Act; that is to say Plot B, where the
buildings and facilities of the former Vanderbilt Hotel are located; Plot C, where the buildings and facilities of the former La Concha Hotel are located; and Plot D, where the Convention Center was located and presently the "Plaza La Gran Ventana al Mar" is being developed pursuant to the provisions of Section 3 of this Act.
The land of Plot B where the buildings and facilities of the former Vanderbilt Hotel (Condado Beach) and those of Plot C of the former La Concha Hotel are hereby exempted from the easement of coastal surveillance.
Section 4.- Section 4 of Act No. 3 of August 22, 1990, as amended, is hereby renumbered as Section 5 and amended to read as follows: "Section 5.- A legal easement for public use is hereby established in favor of the Commonwealth of Puerto Rico, which shall be located in the totality of the plot described as Plot D in Section 3 of this Act, where the Convention Center was located and where presently "Plaza La Gran Ventana al Mar" is being developed, in the Condado sector of San Juan. The total area of Plot "D" is hereby designated as a public zone, to be used for passive recreation as a public square that will be called "Plaza La Gran Ventana al Mar," consisting of an open space destined to passive recreational use, connecting Doctor Ashford Avenue with the Maritime Terrestrial Zone of the Atlantic Ocean, in which a landscaped atmosphere is created by the planting of shrubs and plants, and in the same improvements consistent with the public use can be realized for the public's enjoyment, including without limitation, and ornamental fountain and sculptures, paved walkways, the construction and installation of outdoor lighting and the installation of urban furniture, among others. Additionally, improvements strictly compatible with public use can be realized, these in keeping with the
designation as a public square, such as the construction and installation of complementary buildings where the office of administration, tourist information center, a mechanical room, an electrical room, a warehouse, restrooms for public use, and the construction and installation of commercial tourist concessionaires shall be located. Provided, that the owner of Plot "D" shall be responsible for fulfilling, at his cost, the works and improvements and operation of the same, so that whatever economic benefits and fruits that are generated in its operation can be received by same. It is also provided, that such construction, installations and facilities shall be accomplished in such a way so as not to hinder free pedestrian access from Ashford Avenue to the beach located on the north side of Plot "D".
Since public use has been designated for Plot "D", the Administrator of the Regulations and Permit Administration shall consider and take action regarding the building permit request without consultation with the Planning Board concerning location, and he shall consider said application without the need of obtaining a final and firm declaration of environmental impact.
The segregation of plots A, B, C and D, ordered in Section 3 of this Act, the easement release hereby authorized, and the creation of the new easement hereby provided to guarantee in perpetuity the existence of Plaza La Gran Ventana al Mar, pursuant to public policy, are hereby exempted from the payment of any type of internal revenue taxes, stamp taxes and registration fees."
Section 5.- Section 5 of Act No. 3 of August 22, 1990, as amended, is hereby renumbered as Section 6, and amended to read as follows: "Section 6.- ..." On the land described in Section 3 of this Act, in the public zone located north of said land, improvement works and exclusively
beach area embellishments in harmony with the view, as well as maintenance of such work shall be performed. These and any other improvements performed on said land, by the owner or through a third party, in the public areas shall not imply ownership over the land or over the improvement or decoration works. Also, the public areas shall not be sold or leased. ... Section 6.- Section 6 of Act No. 3 of August 22, 1990, as amended, is hereby repealed.
Section 7.- The third paragraph of Section 7 of Act No. 3 of August 22, 1990, as amended, is hereby amended to read as follows: "Section 7.- . ... In addition to the above, ownership of the plots, personally or through a third party, shall invigorate Vendig and Sea View Streets in Condado through the paving of the streets with materials compatible with the ones to be used on the Urban Front of the complex formed by the Vanderbilt Hotel (also known as the Condado Beach Hotel, the Plaza la Gran Ventana al Mar and the La Concha Hotel). Vegetation resistant to urban conditions shall be planted and decorative lights to give ambiance to the sector shall be placed. On the north side of Vendig Street a formal stairway shall be built allowing free access to the beach level."
Section 8.- Section 4 of Act No. 9 of November 27, 1990, is hereby repealed.
Section 9.- The registrar in charge of the corresponding Section of the Property Registry is hereby ordered to proceed with the corresponding registration and annotations in the books under his custody, to reflect the
provisions of this Act, within sixty (60) days following the date of approval of this Act. No action by any government entity shall be necessary for the Registrar to proceed to make the registration and annotations ordered herein.
Section 10.- Any provision of this Act, regulation, resolution, order or similar action, or part of these, by the Commonwealth of Puerto Rico or by any municipality, which may be in conflict with the provisions of this Act, shall not be applicable to the transactions contemplated in this Act. The provisions of this Act shall prevail over any provision of any other act or regulation, resolution, ordinance or similar action, or part of these, by the Government of the Commonwealth of Puerto Rico or any municipality or agency which is in conflict with the provisions of this Act.
Section 11.- The annulment of any part of this Act by judicial determination shall not affect the validity of the remaining provisions.
Section 12.- This Act shall take effect immediately after its approval.
I hereby certify to the Secretary of State that the following Act No. 126 (Substitutive to H.B. 3434) of the $5^{ ext {th }}$ Session of the $14^{ ext {th }}$ Legislature of Puerto Rico:
AN ACT to amend Section 2; add a new Section 3; amend Sections 3 and 4 and renumber them as Sections 4 and 5 respectively; to amend Section 5 and renumber it as Section 6; to repeal Section 6 ; to amend Section 7 of Act No. 3 of August 22, 1990, as amended, to rectify the area and to segregate the lot owned by "Hotel Development Corporation" into four (4) independent lots; to order the Registrar in charge of the corresponding Section of the Property Registry to make the notations and inscriptions required by law, to establish a legal easement in favor of the Commonwealth of Puerto Rico, located in the lot where the "Plaza La Gran Ventana al Mar" is being developed; and to repeal Section 4 of Act No. 9 of November 27, 1990, etc., has been translated from Spanish to English and that the English version is correct.
