LEY Para enmendar la Sección 15 de la Ley Núm. 52 de 2 de junio de 1983, según enmendada, conocida como "Ley de Incentivos Turísticos de Puerto Rico de 1983", a los fines de extender su vigencia indefinidamente.

EXPOSICION DE MOTIVOS

El 2 de junio de 1983 fue aprobada la Ley Núm. 52, mejor conocida como "Ley de Incentivos Turísticos de Puerto Rico de 1983". Esta nueva ley tiene como objetivo primordial el fortalecimiento de la economía puertorriqueña a través de incentivos contributivos que propician el desarrollo turístico en la Isla.

Es destacada la importancia de la actividad turística y su contribución al desarrollo económico de Puerto Rico, caracterizándose la Década de los años 80 , por unos cambios dramáticos. El ingreso neto originado en el turismo aumentó de $202.2 millones en 1980 a $381.1 millones en 1989 , aumento el cual supone una tasa de crecimiento anual promedio de 7.3% para el período entre 1980 y 1989. Para el período entre 1980 y 1984, el producto bruto interno producto del gasto turístico mostró una tasa anual de crecimiento negativo ( $-1.3 %$ ) con una reducción de $594 millones de 1980 a $564.9 en 1984; para la segunda parte de la década, la tasa de crecimiento anual fue de 11%, con un aumento de $592.6 millones en 1985 a $898.7 millones en 1989. Se observa, además, que el producto bruto interno producto del gasto turístico como por ciento del producto bruto interno total lleva un crecimiento constante en los últimos cinco años, aunque se mantenga entre cinco y seis por ciento.

En esta nueva década, Puerto Rico necesita fortalecer su base industrial, de la cual el sector del turismo como queda demostrado en la pasada década, es piedra angular.

Por la presente medida se permite el desarrollo, crecimiento y fortalecimiento del turismo en Puerto Rico con los consecuentes beneficios económicos y sociales. Es sólo basado en estas realidades que es de esperar que el proceso de expansión que se observó en la pasada década bajo el estímulo de los mecanismos gubernamentales existentes, se sostenga, continúe firme e incremente de manera que la industria turística recupere plenamente su rol central en el desarrollo económico de Puerto Rico.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Artículo 1.- Se enmienda la Sección 15 de la Ley Núm. 52 de 2 de junio de 1983, según enmendada, para que lea como sigue: "Sección 15.- Cláusula de Vigencia Esta ley comenzará a regir inmediatamente después de su aprobación y será aplicable tanto a los dueños como a los operadores de negocios elegibles, según dicho término se define en esta ley."

Artículo 2.- Esta ley empezará a regir inmediatamente después de su aprobación.

AN ACT

To amend Section 15 of Act No. 52 of June 2, 1983, as amended, known as the "Puerto Rico Tourist Incentives Act of 1983," in order to extend its effectiveness indefinitely.

STATEMENT OF MOTIVES

Act No. 52, better known as the "Puerto Rico Tourist Incentives Act of 1983," was approved on June 2, 1983. The primary objective of this new Act is to strengthen the Puerto Rican economy by means of tax incentives which foster the development of tourism throughout the island.

Tourist activity and its contribution to the economic development of Puerto Rico are matters of the utmost importance, with the decade of the 80's being characterized by certain dramatic changes. The net income garnered through tourism increased from $202.2 million in 1980 to $381.1 million in 1989, an increase which accounts for an average annual rate of growth of 7.3% for the period between 1980 and 1989. For the period between 1980 and 1984, the gross domestic product of tourist expenditures showed a negative ( $-1.3 %$ ) annual rate of growth with a decrease of $594 million in 1980 to $564.9 million in 1984; for the second part of the decade the annual rate of growth was of 11%, with an increase of $592.6 million in 1985 to $898.7 million in 1989. It is also observed that the domestic growth product of tourist expenditures as a percentage of the total gross domestic

product has remained in constant growth during the past five years, even though it remains between five and six percent.

During this new decade, Puerto Rico needs to strengthen its industrial base, of which the tourism sector, as demonstrated in the past decade, is a cornerstone.

The present measure allows for the development, growth and strengthening of the tourist industry in Puerto Rico with the subsequent social and economic benefits. Only on the basis of these realities are we to expect that the expansion process experienced in the past decade, spurred by existing government mechanisms, can be maintained and continue to hold firm and increase so that the tourist industry may fully recover its central role in the economic development of Puerto Rico.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- Section 15 of Act No. 52 of June 2, 1983, as amended, is hereby amended to read as follows: "Section 15.- Effectiveness This Act shall take effect immediately after its approval and shall apply both to the owners and the operators of eligible businesses, as said term is defined in this Act."

Section 2.- This Act shall take effect immediately after its approval.
