LEY

Para enmendar el Artículo 18 de la Ley Número 66 de 22 de junio de 1978, según enmendada, a fin de aumentar a seis (6) el número de miembros de la Junta de Entidades Participantes del Centro Médico, requerido para constituir quórum.

EXPOSICION DE MOTIVOS

La Ley Número 66 de 22 junio de 1978, según enmendada, mejor conocida como "Ley de la Administración de Servicios Médicos de Puerto Rico" fue enmendada mediante la Ley Núm. 99 de 9 de julio de 1985 a fin de, entre otros propósitos, crear la Junta de Entidades Participantes del Centro Médico de Puerto Rico, la cual está constituída por los jefes máximos de las entidades que operan una o más instituciones en el Centro Médico; dos (2) consumidores de servicios de salud y el Presidente del Comité de Administración y Política Médica.

Posteriormente la Ley Núm. 124 de 12 de julio de 1986 enmendó nuevamente la referida ley habilitadora para incluir al Secretario de Servicios contra la Adicción como miembro de dicha Junta. Esta ley tuvo el efecto de aumentar de nueve (9) a diez (10) los miembros de la Junta, pero sin embargo, se omitió aumentar el número de miembros necesarios para constituir quórum, por lo que la ley mantiene en cinco (5) el número de miembros que constituyen quórum, lo que puede suscitar una situación donde haya quórum y la Junta no pueda tomar decisiones debido a que éstas requieren mayoría absoluta de los miembros que la componen, es decir, el voto concurrente de por lo menos seis (6) miembros.

Por lo tanto es necesario armonizar la mayoría absoluta requerida para adoptar acuerdos válidos con el número mínimo de miembros presentes para constituir quórum.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Sección 1.- Se enmienda el tercer párrafo del Artículo 18 de la Ley Número 66 de 22 de junio de 1978, según enmendada, para que se lea como sigue: "Artículo 18.- Facultades de la Junta de Entidades Participantes.

Seis (6) miembros de la Junta constituirán quórum y las decisiones se tomarán por mayoría absoluta de los miembros que la componen. La Junta se reunirá por lo menos seis (6) veces al año en reunión ordinaria y podrá reunirse en sesiones extraordinarias todas las veces que lo estime pertinente, previa convocatoria de su Presidente. De toda reunión de la Junta se dejará constancia en unas minutas o actas de sus deliberaciones y acuerdos."

Sección 2.- Esta Ley empezará a regir inmediatamente después de su aprobación.

AN ACT

To amend Section 18 of Act No. 66 of June 22, 1978, as amended, in order to increase to six (6) the number of members of the Board of the Puerto Rico Medical Center Participating Entities, required to constitute a quorum.

STATEMENT OF MOTIVES

Act No. 66 of June 22, 1978, as amended, better known as the "Puerto Rico Medical Services Administration Act, was amended through Act No. 99 of July 9, 1985, in order to create, among other purposes, the Board of the Puerto Rico Medical Center Participating Entities, which is constituted by the heads of the entities which operate one or more institutions at the Medical Center, two (2) health services consumers, and the Chairperson of the Administration and Medical Policy Committee.

Subsequently, Act No. 124 of July 12, 1986, again amended the aforementioned enabling Act to include the Secretary of Addiction Services as a member of said Board. This Act increased the number of members of the Board from nine (9) to ten (10), however, the provision to increase the number of members needed to constitute a quorum was omitted, which the Act maintains at five (5) the number of members who constitute a quorum, which could create a situation in which there is a quorum but the Board may be unable to make decisions since these require the absolute majority of the

constituting members, that is to say, the concurrent vote of at least six (6) members.

It is, therefore, necessary to harmonize the absolute majority required to adopt valid agreements, with the minimum number of members present to constitute a quorum.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- The third paragraph of Section 18 of Act No. 66 of June 22, 1978, as amended, is hereby amended to read as follows: "Section 18.- Powers of the Participating Entities.

(g) Six (6) members of the Board shall constitute a quorum and decisions shall be made by an absolute majority of its members. The Board shall meet at least six (6) times a year in regular meetings and may meet in special sessions every time it deems it pertinent, after being duly summoned by its Chairperson. During every meeting of the Board, minutes and records of the proceedings shall be kept of its deliberations and agreements."

Section 2.- This Act shall take effect immediately after its approval.
