Ley 8 del 1988
Resumen
Esta ley crea el "Fondo Especial de la División de Teatro del Instituto de Cultura Puertorriqueña" en el Departamento de Hacienda. LEY Para crear un Fondo Especial en el Departamento de Hacienda de Puerto Rico, designado para uso de la División de Teatro del Instituto de Cultura Puertorriqueña con el propósito de fomentar el desarrollo de las artes teatrales en Puerto Rico y para asignar fondos.
EXPOSICION DE MOTIVOS
El Pueblo de Puerto Rico siempre ha demostrado un gran interés por el teatro en todas sus manifestaciones. Esto ha quedado demostrado por la asistencia de un público representativo de todos los sectores socioeconomicos y culturales del pais a los distintos espectáculos teatrales que se han presentado en nuestra isla.
No obstante la exitosa acogida que han tenido estos espectáculos teatrales, la realidad es que la producción de los mismos es una sumamente costosa y en muchas ocasiones las entidades que los han llevado a cabo han sufrido considerables pérdidas.
El teatro es una industria con un valor turistico, social y cultural incalculable, ya que a través de él se da a conocer la cultura y costumbres de nuestro pais y hace accesible a nuestros ciudadanos el conocer las costumbres y tradiciones de otras culturas. Es éste, una fuente para la madurez del intelecto, del afianzamiento y desarrollo de los valores de la cultura de los pueblos.
La creación de un fondo especial dirigido a fomentar las artes teatrales en Puerto Rico redundaria en beneficios y brindaria oportunidades a los artistas puertorriqueños para que éstos, a través de su actuación y quehacer teatral, puedan propagar todo su arte. y ofreceria a las entidades dedicadas a producir espectáculos teatrales una fuente económica adicional que los ayude a llevar a escena mayores y mejores producciones de teatro.
Por ser el Gobierno de Puerto Rico quien debe alentar la más amplia difusión de su arte y su cultura, es que se hace necesario la creación de este fondo especial.
Decretase por la Asamblea Legislativa de Puerto Rico:
Articulo 1.-Se crea en los libros del Departamento de Hacienda de Puerto Rico un fondo especial que se denominara "Fondo Especial de la División de Teatro del Instituto de Cultura Puertorriqueña" adscrito al Instituto de Cultura Puertorriqueña y sin
año económico determinado, que se regirá conforme a las normas y reglamentos que éste con la aprobación previa del Secretario de Hacienda adopte en armonía con las disposiciones vigentes para la administración de fondos similares. Este fondo se mantendrá como uno separado de otros fondos públicos bajo su custodia. Dicho fondo estará compuesto de las siguientes partidas las cuales serán utilizadas por la División de Teatro para el fomento de las artes teatrales:
(a) Las asignaciones de dinero dispuestas por esta ley y las que en el futuro destine la Asamblea Legislativa al fondo especial aquí creado.
(b) Cualesquiera otros dineros que se donaren, traspasaren o cedieren por organismos de los gobiernos federal, estatal, municipal, o entidades o personas privadas.
Estas partidas serán depositadas por el Director Ejecutivo del Instituto de Cultura Puertorriqueña y por el Director de la División de Teatro, respectivamente, en el referido Fondo Especial y serán utilizadas para los fines que en esta ley se disponen.
Artículo 2.- La División de Teatro del Instituto de Cultura Puertorriqueña establecerá mediante reglamentación al efecto, todo lo concerniente en cuanto a la forma y manera en que dichos fondos serán utilizados y canalizados a los fines que se garantice el mejor uso de los mismos.
Artículo 3.- Sólo tendrán derecho a solicitar dichos fondos aquellas corporaciones o compañías dedicadas a producir espectáculos relacionados con las artes teatrales y cumplan con los siguientes requisitos:
(a) estar debidamente incorporadas o registradas según las leyes vigentes;
(b) ser una de fines no pecuniarios;
(c) estar reconocidas y recomendadas por la División de Teatro del Instituto de Cultura Puertorriqueña; y
(d) aportar una cantidad igual a la de los fondos solicitados, la cual podrá ser en efectivo, especie o una combinación de ambas.
Sólo se podrá solicitar del Fondo Especial una cantidad que no exceda de la suma de cuarenta mil (40,000) dólares por cada producción o espectáculo que se haga.
Artículo 4.- Se asigna al Fondo Especial de la División de Teatro la cantidad de cien mil ( 100,000 ) dólares, de fondos no comprometidos en el Tesoro Estatal, para llevar a cabo los propósitos de esta ley durante el año fiscal 1988-89.
Artículo 5.- Será obligación de la División de Teatro el velar porque los fondos asignados al Fondo Especial sean utilizados para los propositos enunciados en esta ley y rendirá anualmente un informe al Instituto de Cultura Puertorriqueña, quien a su vez lo incluirá en su informe anual a la Asamblea Legislativa sobre la labor llevada a cabo por el Instituto con estos fondos.
Artículo 6.- Será deber de la División de Teatro garantizar que se le dé participación y acceso a los dineros del Fondo Especial a aquellos productores que cumplan con los requisitos establecidos en el Artículo 3 de esta Ley.
Artículo 7.- Durante los años fiscales subsiguientes el Instituto de Cultura Puertorriqueña consignará en su presupuesto dentro de la Resolución Conjunta del Presupuesto del Gobierno de Puerto Rico la cantidad asignada mediante esta ley para nutrir dicho fondo.
Artículo 8.- Esta Ley empezará a regir inmediatamente después de su aprobación, pero su implantación entrará en vigor el 1 ro. de julio de 1988.

AN ACT
To create a Special Fund in the Department of the Treasury of Puerto Rico designated to be used by the Theatrical Division of the Institute of Puerto Rican Culture for the purpose of promoting the development of the theatrical arts in Puerto Rico, and to appropriate funds.
STATEMENT OF MOTIVES
The People of Puerto Rico have always shown a great interest in the theater in all its expressions. This has been evinced by the number of people, representing all socioeconomic and cultural sectors of the country who attend the various theatrical performances shown on our Island.
Notwithstanding the successful acceptance that these theatrical perfomances have had, the truth is that the production of the same is very costly and on many occasions, the entities that have staged them have suffered considerable losses.
The Theater is an industry with an incalculable tourist, social and cultural value, since through it our culture and customs are made known, and our citizens have access to the customs and traditions of other cultures. It is a source for the cultivation of the intellect and the strenghtening and development of the cultural values of nations.
The creation of a special fund aimed at promoting the theatrical arts in Puerto Rico would redound in benefits and would offer opportunities to the Puerto Rican performers to propagate their art through their acting and theatrical work, and would give the entities engaged in the production of theatrical performances an additional financial source to stage more and better dramatic productions.
Since it is the Government of Puerto Rico the one that should promote the broadcast difussion of its art and culture, the creation of this special fund becomes necessary.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- A special fund that shall be designated as the "Special Fund of the Theatrical Division of the Institute of Puerto Rican Culture" is hereby created in the books of the Department of the Treasury of Puerto Rico, which shall be attached to the Institute of Puerto Rican Culture, and without a specific fiscal year. It shall be governed pursuant to the rules and regulations that the Institute adopts with the prior approval of the Secretary of the Treasury, in harmony with the provisions in force for the administration of similar funds. This fund shall be kept apart from other public funds under its custody. Said fund shall be composed of the following items which shall be used by the Theatrical Division for the promotion of the dramatic arts:
(a) The appropriations provided by this Act and those which the Legislature may allot in the future to the special fund created herein.
(b) Whatever any other monies donated, transferred or yielded by bodies of the United States, Commonwealth or municipal governments or by private entities or persons.
These items shall be deposited in said Special Fund by the Executive Director of the Institute of Puerto Rican Culture and by the Director of the Theatrical Division, respectively, and shall be used for the purposes provided in this Act.
Section 2.- The Theatrical Division of the Institute of Puerto Rican Culture shall establish, through regulations to such effects, everything concerning the form and manner that said funds shall be used and channeled for the purpose of ensuring their best use.
Section 3.- Only those corporations or companies engaged in the production of performances related to theatrical arts and who meet the following requirements, shall be entitled to request said funds:
(a) must be duly-incorporated or registered pursuant to the laws in force;
(b) must be a nonprofit entity;
(c) must be recognized and recommended by the Theatrical Division of the Institute of Puerto Rican Culture; and
(d) must contribute an amount equal to that of the funds requested, which can be in cash, in kind or a combination of both.
Only an amount which shall not exceed the sum of forty thousand (40,000) dollars can be requested from the Special Fund for each production or spectacle that is produced.
Section 4.- The sum of one hundred thousand (100,000) dollars is hereby appropriated to the Special Fund of the Theatrical Division from unencumbered funds in the Commonwealth Treasury to carry out the purposes of this Act during fiscal year 1988-89.
Section 5.- It shall be the duty of the Theatrical Division to see that the funds appropriated to the Special Fund are used for the purposes stated in this Act, and shall submit a report to the Institute of Puerto Rican Culture annually, which at the same time shall include it in its annual report to the Legislature regarding the work carried out by the Institute with these funds.
Section 6.- It shall be the duty of the Theatrical Division to ensure that those producers who meet the requirements established in Section 3 of this Act shall participate in, and have access to the monies from the Special Fund.
Section 7.- The Institute of Puerto Rican Culture shall consign in its budget within the Joint Resolution of the Budget of the Government of Puerto Rico, the amount appropriated through this Act to nourish said fund, during subsequent fiscal years.
Section 8.- This Act shall take effect immediately after its approval, but its implementation shall become effective July 1, 1988.
