Para enmendar los Incisos

(c) y

(d) del Articulo 5; adicionar un nuevo Artículo 5-A y enmendar el Articulo 7 de la Ley Num. 241 del 8 de mayo de 1950, según enmendada, conocida como "Ley Para la Reglamentación e Inspección de los Mercados Agricolas" a los fines de facultar al Secretario de Agricultura a fijar y cobrar cargos por las licencias que expida a las personas que se dedican a mercadear productos agricolas, a detener e inspeccionar cargas de productos agricolas y para establecer penalidades. Decrétase por la Asamblea Legislativa de Puerto Rico: Sección 1.- Se enmiendan los Incisos

(c) y

(d) del Artículo 5 de la Ley Núm. 241 del 8 de mayo de 1950, según enmendada, conocida como "Ley Para la Reglamentación e Inspección de los Mercados Agricolas", para que se lean como sigue: "Artículo 5.-El Secretario de Agricultura tendrá poder para:

(a) (c) Requerir licencias a las personas naturales o juridicas que se dediquen al mercadeo o a administrar facilidades para el mercadeo de productos agricolas y fijar y cobrar cargos por las licencias que se expidan, de acuerdo con los reglamentos que se promulguen para tal efecto y que por la presente ley se autorizan; Disponiéndose que dichos cargos serán fijados por el Secretario de acuerdo al volumen de negocios declarados conforme lo establece la Ley Núm. 113 de 10 de julio de 1974, según enmendada, conocida como "Ley de Patentes Municipales" y dicha cantidad no será menor de cincuenta (50) dólares ni mayor de doscientos cincuenta (250) dólares.

(d) Cancelar o suspender licencias por el periodo que él crea necesario, cuando a su juicio la persona no cumpla con los standards y reglamentos que se establezcan de acuerdo con esta ley, o cuando dicha persona, por la fuerza, asaltare, resistiere a, se opusiere a, impidiere, intimidare, interfiriere, obstruyere o estorbare a un funcionario mientras éste se encuentre en el desempeño de sus deberes oficiales bajo esta ley, o con motivo de encontrarse en el desempeño de sus deberes.

Sección 2.- Se adiciona un nuevo Artículo 5-A a la Ley Núm. 241 dèl 8 de mayo de 1950, según enmendada, conocida como "Ley Para la Reglamentación e Inspección de los Mercados Agricolas" para que se lea como sigue: "Artículo 5-A.-Se autoriza al Secretario de Agricultura o su representante autorizado a:

(a) Detener o inspeccionar, siempre que esté identificado como tal y sin necesidad de orden de allanamiento, a cualquier persona o medio de transportación o carga que arribe a Puerto Rico de cualquier sitio fuera de éste, siempre que a juicio del Secretario de Agricultura o de su representante autorizado hubiere causa probable para creer que dicha persona o medio de transportación o carga, transporta, lleva o porta cualquier producto agrícola en forma contraria a cualquier reglamento prescrito en virtud de esta ley;

(b) Requerir la presentación para inspección de hojas de ruta, manifiestos, facturas, conocimientos de embarque, conduces, o cualesquiera otros documentos que se relacionen con los productos agricolas que arriben a Puerto Rico de cualquier sitio fuera de éste, con el propósito de verificar que se cumpla con esta ley o con cualquier reglamento promulgado bajo la misma. Será mandatorio que la persona encargada de tales documentos haga accesibles los mismos a los inspectores para el propósito señalado anteriormente." Sección 3.- Se enmienda el Artículo 7 de la Ley Núm. 241 del 8 de mayo de 1950, según enmendada, conocida como "Ley Para la Reglamentación e Inspección de los Mercados Agricolas" para que se lea como sigue: "Artículo 7.-Toda persona natural o juridica que dejare de cumplir con las disposiciones de esta ley o con todo o parte de cualquier standard o reglamento establecido por el Secretario de Agricultura de acuerdo con las disposiciones de esta ley, incurrirá en delito menos grave y convicta que fuere, será castigada con multa no menor de cien (100) dólares ni mayor de doscientos (200) dólares por la primera convicción; y por cada violación subsiguiente será castigada con multa no menor de doscientos (200) ni mayor de quinientos (500) dólares; Disponiéndose que cualquier producto agrícola, envase o material de empaque o rotulación del mismo que no estuviere de acuerdo con los reglamentos o standards promulgados por el Secretario de Agricultura y que haya sido objeto de una orden de detención podrá ser confiscado si su dueño o manipulador omitiere proceder en alguna de las formas señaladas en el Articulo 6-A de esta

ley, y en tal caso, los productos agricolas, envases o materiales de empaque o rotulación de éstos que fueren apropiados para el uso de hospitales municipales o estatales se enviarán a éstos cuando fuere posible y conveniente hacerlo y los que no fueren enviados a hospitales se venderán en públicas subastas, destruirán o usarán para otros propósitos que no sea el uso o consumo humano; Disponiéndose que en casos de violaciones al Articulo 6-A, la multa administrativa que podrá imponer el Secretario de Agricultura será hasta doscientos (200) dólares por la primera vez y hasta quinientos (500) dólares en grado subsiguiente. Cuando se haya mercadeado en Puerto Rico cualquier producto agrícola en violación de cualquier reglamento promulgado bajo esta ley, sin haber sido inspeccionado dicho producto por los funcionarios del Departamento de Agricultura y sin haberse pagado los cargos de inspección establecidos mediante reglamentación para ese producto, el dueño o consignatario del producto agrícola así mercadeado vendrá obligado a pagar los cargos inspección correspondientes, además de quedar sujeto a las penalidades dispuestas por esta ley;

El Secretario de Agricultura queda facultado para imponer multas administrativas hasta una cantidad de quinientos (500) dolares la primera vez, y hasta diez mil (10,000) dólares por cualquier violación subsiguiente, cuando se encuentre que no se han cumplido las disposiciones de esta ley o de los reglamentos o standards promulgados de acuerdo con la misma."

Sección 4.- Esta Ley comenzará a regir inmediatamente después de su aprobación.

AN ACT

To amend Subsections

(c) and

(d) of Section 5; add a new Section 5-A and amend Section 7 of Act No. 241 of May 8, 1950 as amended, known as the "Act for the Regulation and Inspection of Agricultural Markets", to empower the Secretary of Agriculture to fix and collect fees for the licenses issued to persons engaged in marketing agricultural products, to detain and inspect agricultural produce cargo, and to establish penalties.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Subsections

(c) and

(d) of Section 5 of Act No. 241 of May 8, 1950 as amended, known as the "Act for the Regulation and Inspection of Agricultural Markets", are hereby amended to read as follows: "Section 5.- The Secretary of Agriculture shall have the power:

(a) (c) To require the licensing of all natural or juridical persons engaged in the marketing or the management of facilities for the marketing of farm products, and to fix and collect fees for the licenses issued in accordance with the regulations promulgated for such purpose, and authorized hereby; Provided that such fees shall be fixed by the

Secretary in accordance with the declared volume of business as established by Act No. 113 of July 10, 1974 as amended, known as the "Municipal License Tax Act" and said amount shall not be less than fifty (50) dollars nor more than two hundred and fifty (250) dollars.

(d) To cancel or suspend licenses for the period he may deem necessary, when in his judgment, the person is not complying with the standards and regulations established pursuant to this Act, or when said person forcefully, assaults, resists, opposes, prevents, intimidates, interferes with, obstructs or hinders an official while performing his/her official duties under this Act, or because he/she is performing his/her duties.

Section 2.- A new Section 5-A is hereby added to Act No. 241 of May 8, 1950 as amended, known as the "Act for the Regulation and Inspection of Agricultural Markets", to read as follows: "Section 5-A- The Secretary of Agriculture or his authorized representative are hereby authorized to:

(a) Detain or inspect any person or means of transportation or shipment that arrives in Puerto Rico from any outside source, as long as he is identified as such and without the need of a search warrant, whenever, in the judgment of the Secretary of Agriculture or his authorized representative, there is problable cause to believe that said

persons or means of transportation or shipment, transports, carries or bears any agricultural product in a manner contrary to any regulations prescribed by virtue of this Act;

(b) Require the presentation for inspection of routing slips, manifests, invoices, bill of lading, delivery steps or any other documents related to the farm products that arrive in Puerto Rico from any outside source with the purpose of verifying compliance of this act or any regulations promulgated hereunder. It shall be mandatory for the person in charge of such documents to make them accessible to the inspectors for the purpose indicated above."

Section 3.- Section 7 of Act No. 241 of May 8, 1950, as amended, known as the "Act for the Regulation and Inspection of Agricultural Markets", is hereby amended to read as follows: "Section 7.- Any natural or juridical person who fails to comply with the provisions of this Act or with all or part of any standard or regulation established by the Secretary of Agriculture pursuant to the provisions of this Act, shall incur a misdemeanor and upon conviction shall be punished with a fine of not less than one hundred (100) dollars nor more than two hundred (200) dollars for the first conviction; and with a fine of no less than two hundred (200) nor more than five hundred (500) dollars for each subsequent violation; Provided, that any farm product or container, packaging or labeling material for it, not in accord with the regulations or standards promulgated by the Secretary of

Agriculture, and which has been the subject to a detention order, may be seized if its owner or handler fails to proceed as set forth in Section 6-A of this Act and in such case, the farm products, containers, or their packaging or labeling materials that are appropriate for the use of municipal or Commonwealth hospitals shall be sent to them whenever it is possible and convenient, and those that are not sent to hospitals will be sold at public auction, destroyed or used for purposes other than human consumption; Provided, that in cases of violations to Section 6-A, the administrative fine that the Secretary of Agriculture may impose, shall be of up to two hundred (200) dollars for the first time and up to five hundred (500) dollars, subsequently. When any farm product has been marketed in Puerto Rico in violation of any regulations promulgated under this Act without it having been inspected by officials of the Department of Agriculture and without payment of the inspection fees established through regulations for that product, the owner or consignee of the farm product thus marketed shall be obliged to pay the corresponding inspection fees addition to being subject to the penalties provided by this Act;

The Secretary of Agriculture is hereby empowered to impose administrative fines up to the sum of five hundred (500) dollars for the first violation and up to ten thousand (10,000) for any subsequent violation when it is found that the provisions of this Act, or the

regulations or standards promulgated thereunder it have not been complied with."

Section 4.- This Act shall take effect immediately after its approval.
