Ley 6 del 1985

Resumen

Esta ley crea el cargo de Subadministrador para la Promoción de Industrias Puertorriqueñas dentro de la Administración de Fomento Económico. Su objetivo principal es fortalecer, impulsar y ampliar el desarrollo de las empresas locales, fomentando la creación de empleos, el aumento de la producción y la demanda de productos puertorriqueños, la mejora de los sistemas de mercadeo y la facilitación de oportunidades de financiamiento. La ley también requiere estudios exhaustivos y la reestructuración administrativa para lograr estos fines.

LEY

Para crear el cargo de Subadministrador para la Promoción de Industrias Puertorriqueñas en la Administración de Fomento Económico del Estado Libre Asociado de Puerto Rico, según ésta fuera creada por el Plan de Reorganización Núm. 10 de 1950 y por la Ley Núm. 423 del 14 de mayo de 1950, según enmendada y para proveer fondos.

EXPOSICION DE MOTIVOS

La Administración de Fomento Económico de Puerto Rico, creada bajo el Plan de Reorganización Núm. 10 de 1950 y por la Ley Núm. 423 del 14 de mayo de 1950, según enmendada, tiene a su cargo las funciones de promoción industrial e investigaciones económicas para fomentar el desarrollo industrial y económico de Puerto Rico. De acuerdo con el Censo de Industrias Manufactureras de Puerto Rico, publicado por el Departamento del Trabajo y Recursos Humanos, en marzo de 1983 habla en Puerto Rico un total de 2.131 establecimientos manufactureros, de los cuales 606 eran establecimientos de origen local promovidos por Fomento. A diciembre de 1984, estaban operando 689 fábricas locales promovidas por Fomento, las cuales empleaban un total de 19.996 personas lo que representa un 14.9% del total del 134.200 empleos promovidos a esa fecha. Durante los últimos ocho años el programa de promoción de industrias puertorriqueñas de la Administración de Fomento Económico no recibió todo el apoyo y el respaldo que el mismo necesitaba para fortalecer y mejorar al empresario local. Resulta, por lo tanto, imperativo que la Administración de Fomento Económico reestructure el programa de industrias puertorriqueñas para fortalecerlo, impulsarlo y ampliarlo de forma tal que el industrial puertorriqueño reciba toda la ayuda que sea necesaria para lograr que su empresa pueda tener el éxito económico esperado y así se generen nuevas fuentes de empleo para más puertorriqueños. A esos efectos, esta medida propone que se establezca el cargo de Subadministrador de Promoción de Industrias Puertorriqueñas en la Administración de Fomento Económico con la encomienda específica de ayudar al empresario local para que se desarrolle como industrial bajo las mejores expectati-

vas de prosperidad económica, lo cual servirá de base para la creación de mayores fuentes de empleos e ingresos en beneficio de todo el Pueblo de Puerto Rico.

La medida ordena que la Administración de Fomento Económico realice un estudio exhaustivo sobre la situación actual de la industria puertorriqueña con particular énfasis en las áreas de promoción, desarrollo y diversificación de la misma. Sobre los datos de este estudio debe construirse una estructura administrativa con directrices y objetivos particularmente diseñados para lograr la más eficiente y adecuada promoción de la industria puertorriqueña.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Artículo 1.- Se crea el cargo de Subadministrador para la Promoción de Industrias Puertorriqueñas en la Administración de Fomento Económico del Estado Libre Asociado de Puerto Rico. El Subadministrador para la Promoción de Industrias Puertorriqueñas, será nombrado por el Gobernador a propuesta del Adminjstrador de Fomento Económico y su compensación será la que éste determine, previa aprobación del Gobernador.

Artículo 2.- Para efectos de esta medida se interpretará el término "Industria Puertorriqueña", como toda empresa que opere o se proponga operar con inversión sustancial, según se determine por reglamento, de capital producido, generado o aportado por puertorriqueños o residentes bonafide de Puerto Rico.

Artículo 3.- En coordinación y con la aprobación del Administrador de la Administración de Fomento Económico, el Subadministrador para la Promoción de Industrias Puertorriqueñas atenderá exclusiva y prioritariamente todo lo relacionado con la problemática, fomento y desarrollo de la industria puertorriqueña. Dirigirá sus trabajos colocando particular énfasis en la consecución de logros y el desarrollo de cursos de acción efectivos, entre otras, para las siguientes áreas: (1) para el desarrollo de industrias puertorriqueñas que generen nuevas fuentes de empleo. (2) el aumento de la demanda para consumo local y para la exportación de productos de industria puertorriqueña. (3) el aumento en la producción y en la diversificación de productos de industrias puertorriqueñas.

(4) sofisticación de los sistemas de mercadeo. (5) ampliar y facilitar oportunidades de financiamiento. (6) lograr la más efectiva divulgación de los servicios ofrecidos por la Administración a la industria puertorriqueña. (7) la promoción efectiva de los productos manufacturados por Industrias Puertorriqueñas.

Artículo 4.- Tan pronto el Sub-Administrador esté nombrado, el Administrador de Fomento Económico le requerirá que realice un estudio exhaustivo sobre el estado actual, deficiencias, lagunas y logros alcanzados en las áreas presentadas en el Artículo 3 y sobre cualesquiera otras que el Administrador y/o el Subadministrador estime pertinente estudiar, para beneficio de los trabajos en promoción del desarrollo de la Industria Puertorriqueña. En el curso de los trabajos de estudio, deberá tomar en consideración las opiniones y recomendaciones de todos los sectores de la comunidad industrial.

Artículo 5.- Tan pronto esté finalizado el estudio el Subadministrador deberá preparar un informe de conclusiones y recomendaciones específicas, a corto o largo plazo para asegurar la consecusión de logros en las áreas estudiadas. A la luz del estudio y del informe de recomendaciones y con la asesoria del Subadministrador el Administrador de la Administración de Fomento Económico, en coordinación y con la participación de la Oficina de Presupuesto y Gerencia del Estado Libre Asociado de Puerto Rico, deberá reestructurar la composición administrativa y operacional del actual Departamento de Industrias Puertorriqueñas.

Artículo 6.- Cumplidos Seis (6) meses, a partir de la fecha de efectividad de esta ley, el Administrador de la Administración de Fomento Económico en unión al Sub-administrador comparecerá ante la Asamblea Legislativa a presentar y exponer sobre: -El estudio realizado y sus hallazgos en relación a cada una de las áreas prioritarias mencionadas en el Articulo 3 de esta ley y cualesquiera otra incluida. -Ante el Informe de Conclusiones y recomendaciones de los planes, a corto y largo plazo, restructuraciones administrativas y operacionales y cualesquiera otras medidas o actuaciones dispuestas para lograr la más efectiva promoción del desarrollo de la industria puertorriqueña.

Artículo 7.- Anualmente, el Administrador de Fomento Económico rendirá un informe al Gobernador sobre los logros, actividades y otros asuntos que estime propios sobre la inplementación de esta ley.

Artículo 8.- La Administración de Fomento Económico, de sus propios fondos asignará las cantidades necesarias para el cumplimiento de las disposiciones de esta ley durante el primer año fiscal. En años fiscales subsiguientes las cantidades necesarias para llevar a cabo los propositos de esta ley se consignarán en el Presupuesto General de Gastos de la Administración de Fomento Económico.

Artículo 9.- Esta Ley entrará en vigor inmediatamente después de su aprobación, pero sus disposiciones se harán efectivas al 1ro. de julio de 1985.

STATEMENT OF MOTIVES

The Economic Development Administration of Puerto Rico, created under Reorganization Plan No. 10 of 1950, and Act No. 423 of May 14, 1950 as amended, is in charge of industrial promotion and economic investigation duties to promote the industrial and economic development of Puerto Rico. According to the Census of Manufacturing Industries of Puerto Rico, published by the Department of Labor and Human Resources, in March of 1983, there was a total of 2,131 manufacturing establishments in Puerto Rico, of which 606 were of local origin promoted by the Economic Development Administration. There were 689 local factories promoted by Fomento in operation in December, 1984, which employed a total of 19,996 persons which is 14.9% of the

total 134,200 jobs promoted to that date. During the past eight years the Economic Development Administration's Puerto Rican Industry Promotion Program, did not receive all the backing and support it needed to encourage and improve local entrepreneurs. Therefore, it is imperative for the Economic Development Administration to restructure the Puerto Rican Industries program to strenghten it, motivate it, and enhance it, in such a manner that Puerto Rican manufacturers may receive all the help they need, for their enterprises to have the expected financial success, and thus generate new sources of employment for more Puerto Ricans. To such effects, this bill proposes that the office of Deputy Administrator for the Promotion of Puerto Rican Industries be established in the Economic Development Administration, with the specific charge of helping local entrepreneurs develop as industrialists with the highest expectations of economic prosperity, which will serve as a basis for the creation of additional sources of employment and income, in benefit of all the People of Puerto Rico.

The bill directs the Economic Development Administration to undertake an extensive study of the present situation of Puerto Rican industry, with particular emphasis on its promotion, development and diversification. An administrative structure with directives and objectives specifically designed to achieve the most efficient and

adequate promotion of Puerto Rican industry, should be constructed from the data of this study.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- The office of Deputy Administrator for the Promotion of Puerto Rican Industries, in the Economic Development Administration of the Commonwealth of Puerto Rico, is hereby created. The Deputy Administrator for the Promotion of Puerto Rican Industries shall be appointed by the Governor, by recommendation of the Economic Development Administrator, who shall determine his compensation, subject to the Governor's approval.

Section 2.- For the purposes of this Act, the term "Puerto Rican Industry" shall be interpreted as any industry which operates, or that proposes to operate with a substantial investment of capital, as determined by regulation, generated or funded by Puerto Ricans, or bona-fide residents of Puerto Rico.

Section 3.- The Deputy Administrator for the Promotion of Puerto Rican Industries shall attend exclusively, and with priority, to everything related to the complexities, development and promotion of Puerto Rican industry, in coordination and with the approval of the Administrator of the Economic Development Administration. He shall manage his work by placing special emphasis on attaining goals and developing effective courses of action in the following areas, among others:

(1) develop Puerto Rican Industries that generate new sources of employment. (2) stimulate demand for local consumption, and for exportation of Puerto Rican industry products. (3) increase production and diversify Puerto Rican industry products. (4) sophisticate the marketing systems. (5) broaden and facilitate financing opportunities. (6) effectively publicize the services offered to Puerto Rican industries by the Administration. (7) effectively promote products manufactured by Puerto Rican Industries.

Section 4.- As soon as the Deputy Administrator is appointed, the Economic Development Administrator shall require him to carry out an extensive study of the present status, deficiencies, needs, and achievements in the areas introduced in Section 3, and any others that the Administrator, and/or Deputy Administrator deem that should be studied to assist in promoting the development of Puerto Rican Industry. During the course of the study, he must take into consideration the opinions and recommendations of all sectors of the industrial community.

Section 5.- As soon as study is finished, the Deputy Administrator must prepare a report on his conclusions and specific short or long-term recommendations to insure the achievement of success in the fields studied. The

Administrator of the Economic Development Administration, in coordination and with the participation of the Office of the Budget and Management of the Commonwealth of Puerto Rico, must restructure the present administrative and operational composition of the Department of Puerto Rican Industries, pursuant to the study and report on recommendations, and with the advice of the Deputy Administrator.

Section 6.- After six (6) months from the effective date of this Act have elapsed, the Administrator of the Economic Development Administration, together with the Deputy Administrator, shall appear before the Legislature to present and explain: --The study performed and its findings with regard to each of the priority areas mentioned in Section 3 of this Act, and any others that were included. --The administrative and operational restructuring and any other measures, or activities provided to achieve the most effective promotion of the development of Puerto Rican industry, pursuant to the Report on Conclusions, and recommendations of the short and long-term plans.

Section 7.- The Economic Development Administrator shall inform the Governor, annually, of the achievements, activities, and other matters he may deem proper, with regard to the implementation of this Act.

Section 8.- During the first fiscal year, the Economic Development Administration shall appropriate the amounts needed to comply with the provisions of this Act from its own funds. The amounts needed to carry out the purposes of this Act in subsequent fiscal years, shall be consigned in the General Expense Budget of the Economic Development Administration.

Section 9.- This Act shall take effect immediately after its approval, but its provisions shall take effect July 1, 1985.
