(f) al Artículo 15; enmendar el Artículo 18 y el Artículo 22 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, que crea la Junta de Examinadora de Peritos Electricistas.

Exposición de Motivos

A lo largo de los años la profesión de perito electricista ha tenido un notable aumento en sus miembros. El propósito de este Proyecto de Ley, entre otras cosas, es el de reglamentar de manera más acorde con las realidades modernas, el ejercicio de la profesión de perito electricista a través de la Junta Examinadora de Peritos Electricistas. En dicha Junta Examinadora los procedimientos de elección y nombramiento de sus miembros se regirán conforme a las disposiciones de esta Ley. La Junta Examinadora de Peritos Electricistas estará encargada de pasar juicio sobre la capacidad e idoneidad de los aspirantes a desempeñar la profesión de Perito Electricista.

Deorétase por la Asamblea Legislativa de Puerto Rico:

Sección 1.- Se enmiendan los incisos

(b) y

(d) del Artículo 2 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 2.-Definiciones.-Para los fines de esta ley, a los vocablos y frases que se exponen a continuación se les dará el significado y alcance que para cada uno se expresa:

(a) (b) Perito Electricista-Significa una persona autorizada por la Junta Examinadora de Peritos Electricistas para ejercer la profesión, trabajar en instalaciones eléctricas y con materiales y equipos eléctricos de alto y bajo voltaje.

(c) d) Instalaciones Eléctrica-significa la colocación de materiales, equipos o artefactos eléctricos realizada con el propósito de utilizar energía eléctrica." Sección 2.- Se enmienda el Artículo 3 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 3.-Organización de la Junta. La Junta estará compuesta por nueve (9) peritos electricistas debidamente autorizados por ley para ejercer la profesión, los cuales deberán ser miembros del Colegio de Peritos Electricistas de Puerto Rico. El Gobernador de Puerto Rico, nombrará con el consejo y consentimiento del Senado, a dichos miembros. El término de la Junta será de cuatro (4) años o, hasta que sucesor sea nombrado y tome posesión de su cargo.

Los miembros de la Junta deberán tener los siguientes requisitos: (1) (2) (3) (4) No podrán ser inspectores, empleados, miembros de la Junta de Gobierno o miembros de Comités del Colegio de Peritos Electricistas de Puerto Rico.

Los peritos electricistas que estén ocupando cargos como miembros de la actual Junta Examinadora de Peritos Electricistas a la fecha de aprobación de esta ley, y que no cumplan con el requisito dispuesto en el inciso (4) anterior, tendrán que renunciar a su cargo en la Junta Examinadora de Peritos Electricistas de Puerto Rico."

Sección 3.- Se enmienda el Artículo 4 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 4.-Destitución y Vacantes. El Gobernador de Puerto Rico podrá destituir a cualquier miembro de la Junta previa formulación de cargos, notificación y audiencia, por

razones de inmoralidad, negligencia, haber sido convicto de un delito grave o menos grave que implique depravación moral, e incompetencia.

Las vacantes que surjan en la Junta serán cubiertas por nombramientos del Gobernador con el consejo y consentimiento del Senado. La persona designada para cubrir una vacante ocupará el cargo hasta haber expirado el término para el cual la persona que sustituyó fue nombrada.

Ninguna persona podrá ser nombrada como miembro de la Junta por más de dos (2) términos consecutivos."

Sección 4.- Se enmienda los incisos

(d) y

(h) y se deroga el (1) del Artículo 5 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 5.-La Junta tendrá los siguientes deberes y facultades:

(a) (d) Adoptará un reglamento para su funcionamiento el cual deberá ser aprobado dentro del término de seis meses, desde la aprobación de esta ley.

(e) (h) Celebrará las reuniones y sesiones que sean necesarias para llevar a cabo sus funciones, previa convocatoria del Presidente o, de cinco (5) de sus miembros.

(i) (1) Podrá autorizar al Colegio de Peritos Electricistas de Puerto Rico, bajo las normas y reglas que la Junta especifique mediante reglamento, a que implemente la organización de un sistema de inspectores para velar por el cumplimiento de las disposiciones de esta ley."

Sección 5.- Se enmienda el Artículo 7 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 7.-Licencias y Requisitos.-Toda persona que aspire a una licencia de Aprendiz de Perito Electricista deberá cumplir con los siguientes requisitos:

1. Llenar y someter una solicitud a tales efectos ante la Junta, la cual proveerá los blancos apropiados de acuer-

do con los requisitos que exija por regla o reglamento de la Junta. 2. Haber cumplido disciséis (1C) años al momento de radicar su soicitud. 3. Haber cursado hasta noveno grado de escuela intermedia y acreditar este hecho o haber aprobado el curso de aprendizaje ofrecido por el Departamento de Instrucción Pública o equivalencia en experiencia, certificado ante la Junta por un Perito Electricista Colegiado, en la forma en que ésta lo especifique mediante reglamento. 4. Radicar con su solicitud un certificado médico y de buena conducta por la Policía, acreditando que se encuentra en buenas condiciones de salud física y mental para trabajar en proyectos de construcción y en aparatos y circuitos eléctricos. 5. Acompañar con su solicitud de licencia o renovación un comprobante de pago de rentas internas por valor de diez (10) dólares.

La licencia expedida tendrá una vigencia de dos años. Al vencerse dicho término, la licencia así expedida, perderá todo su valor y efecto y deberá ser renovada mediante el pago de diez (10) dólares en comprobante de rentas internas. El haber radicado una solicitud para examen de Perito Electricista no autoriza a trabajar como aprendiz.

Toda persona que aspire a una licencia de Perito Electricista deberá cumplir los siguientes requisitos:

1. Haber aprobado cuarto año de escuela superior.
2. Ser graduado de un curso de electricidad en una escuela vocacional o instituto tecnológico del Sistema de Instrucción Pública, o en su lugar, de una escuela vocacional privada, debidamente acreditada por el Departamento de Instrucción Pública, en ambos casos con un mínimo de ochocientas (800) horas de adiestramiento, disponiéndose que la Junta Estatal de Instrucción Vocacional y Altas Desírezas queda facultada para convalidar experiencia por horas de adiestramiento, o en su defecto, haber terminado el curso de adiestramiento prescrito, o que en el fu-

turo se prescriba, por el Consejo de Aprendizaje de Puerto Rico, creacio en virtud de las disposiciones de la Ley Núm. 483, aprobada el 15 de mayo de 1947, según ha sido o fuere subsiguientemente enmendada. 3. Todo aprendiz de Perito Electricista que posea una licencia como tal, que haya trabajado por un periodo de dos (2) años bajo la supervisión de un Perito Electricista Colegiado y que haya obtenido un diploma de escuela superior podrá solicitar su licencia de Perito Electricista, sin cumplir con el requisito número dos (2);

Disponiéndose, además, que toda persona que presente una certificación acreditativa de un Perito Electricista Colegiado o de un Ingeniero Electricista Colegiado de haber trabajado como electricista por un periodo no menor de siete (7) años, y que nunca antes hubiese solicitado licencia de Perito Electricista, podrá solicitar su licencia de Perito Electricista dentro de un (1) año a partir de la aprobación de esta ley sin tener que cumplir con los requisitos uno (1) y dos (2), y así obtener dicha licencia mediante la aprobación del examen. 4. Ser residente de Puerto Rico, tener más de dieciocho (18) años de edad, y presentar certificado de salud expedido por el Departamento de Salud y certificado de buena conducta expedido por la Policía de Puerto Rico." Sección 6.- Se enmienda el Artículo 8 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que se lea como sigue: "Artículo 8-Exámenes.

(a) Los exámenes se ofrecerán por la Junta tres veces al año, cada cuatro meses.

(b) Los exámenes constarán de dos (2) partes, una práctica y otra tcórica. Cada parte tendrá un valor de cincuenta (50) puntos y la puntuación mínima para pasar cada parte será de setenta (70) por ciento de ésta.

(c) Disponiéndose que los aspirantes tendrán que pasar ambas partes del examen para que les sea otorgada la licencia.

(d) Si un aspirante fracasa en una parte del examen y aprobase la otra, solamente se tendrá que reexaminar en la parte fracasada."

Sección 7.- Se enmienda el Artículo 11 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 11. Ningún perito electricista colegiado podrá tener bajo su inmediata supervisión más de seis (6) aprendices de perito electricista autorizados."

Sección 8.- Se enmienda el Artículo 12 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 12.-Se exceptúan de las disposiciones de la ley las siguientes personas naturales o jurídicas:

a) Los aprendices, debidamente autorizados por esta ley, siempre que realicen su trabajo bajo la supervisión personal e inmediata de un Perito Electricista Colegiado. b) Los Ingenieros Electricistas Colegiados, graduados de un colegio o universidad de ingeniería que ostenten licencia expedida por la Junta Examinadora de Ingenieros, Arquitectos y Agrimensores, que realicen instalaciones eléctricas o que empleen a Peritos Electricistas colegiados. c) Los empleados de la Autoridad de Energía Eléctrica, mientras realizan trabajos en las propiedades de la Autoridad."

Sección 9.- Se adiciona el inciso

(f) al Artículo 15 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 15.-Suspensión, renovación o denegación de licencias.

La juita puiirá suspencer, revocar o denegar la renovación de la licencia expedida de acuerdo con esta ley, previa formulación de cargos, notificación y audiencis a cualquier persona que:

f) Realice instalaciones eléctricas que no cumplan con los requisitos mínimos del Código Eléctrico Nacional vigente, del Código Eléctrico de Puerto Rico y de los reglamentos promulgados por la compañía privada o pública encargada del suministro de energía eléctrica." Sección 10.- Se enmienda el Artículo 18 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que lea como sigue: "Artículo 18.-Cualquier miembro de la Junta Examinadora, los inspectores del Colegio de Peritos Electricistas de Puerto Rico autorizados por la Junta, el Servicio de Bomberos, la Policía Estatal, el Secretario del Trabajo y sus empleados o funcionarios autorizados por éste, quedan autorizados por la presente para 'entrar en proyectos de construcción e industrias donde se estén haciendo instalaciones eléctricas,' hacer investigaciones, inspecciones o interrogatorios relacionados con el cumplimiento de esta ley".

Sección 11.- Se enmienda el Artículo 22 de la Ley Núm. 115 de 2 de junio de 1976, según enmendada, para que se lea como sigue: "Artículo 22.-Toda compañía de servicio público o privado:

a) Inspeccionará mediante inspectores oficiales de la compañía, que serán ingenieros o peritos electricistas colegiados o técnicos especializados las instalaciones eléctricas realizadas o supervisadas y certificadas así por ingenieros o peritos electricistas colegiados. b) Aprobará y suministrará servicio de energía eléctrica únicamente a instalaciones eléctricas que hayan sido realizadas o supervisadas por un ingeniero electricista colegiado o por un perito electricista colegiado debidamente autorizado por ley, y que cumplan con el Código Eléctrico Nacional vigente, el Código Eléctrico de Puerto Rico y los Reglamentos promulgados por la compañía pública o privada encargada del suministro de energía eléctrica. Disponiéndose que los ingenieros y peritos electricistas colegiados, certificarán la realización de las instalaciones eléctricas mediante un documento oficial al respecto radicado ante la compañía de servicio público o privado.

La información requerida en este documento oficial será dispuesta por la compañía de servicio público o privado en coordinación con la Junta Examinadora de Ingenieros, Arquitectos y Agrimensores, la Junta Examinadora de Peritos Electricistas, ol Colegio de Ingenieros y Agrimensores y el Colegio de Peritos Electricistas. El original del documento se entregará a la compañía de servicio público o privado, una primera copia será para el abonado y la segunda copia para el Ingeniero o Perito Electricista Colegiado.

Cualquier persona natural o jurídica que 'violare las disposiciones de esta ley' o que emplee a personas no autorizadas por esta ley a realizar trabajos, instalaciones eléctricas, o a supervisar los mismos, incurrirá en delito menos grave y convicta que fuere será castigada con una muita no mayor de quinientos ( 500 ) dólares o reclusión por un período que no excederá de seis meses, o ambas penas, a discreción del tribunal."

Sección 12.- Esta ley comenzará a regir a los 60 días después de la fecha de su aprobación.

(c) to Section 12; add subsection

(f) to Section 15; amend Section 18 and Section 22 of Act No. 115 of June 2, 1976 as amended, which creates the Board of Examiners of Expert Electricians.

STATEMENT OF MOTIVES

Through the years the profession of expert electrician has had an outstanding increase in the number of members. The purpose of this Bill, among other things, is to regulate the practice of the profession of expert electrician through the Examining Board of Expert Electricians in the manner most in accord with today's substantiality. The procedure for the selection and appointment of its members in said Examining Board shall be governed according to the provisions of this Act. The Examining Board of Expert Electricians shall be charged with passing

judgment on the capability and suitability of the candidates aspiring to practice the profession of Expert Electrician.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Subsections

(b) and

(d) of Section 2 of Act No. 115 of June 2, 1976 as amended, are hereby amended to read as follows:

"Section 2.- Definitions.-

For the purposes of this Act, the terms and phrases set forth shall have the meaning and scope stated for each:

(a) (b) Expert Electrician.- means a person authorized by the Board of Examiners of Expert Electricians to practice the profession, work in electrical installations and with high and low-voltage electrical material and equipment.

(c) (d) Electrical Installations.- means the installation of any materials, equipment or electrical devices made for the purpose of using electric energy."

Section 2.- Section 3 of Act No. 115 of June 2, 1976 as amended, is hereby amended, to read as follows:

"Section 3.- Organization of the Board.

The Board shall be composed of nine (9) expert electricians duly authorized by law to practice the profession, who shall be members of the College of Expert Electricians of Puerto Rico. The Governor of Puerto Rico shall appoint said members with the advice

and consent of the Senate. The term of office of the members of the Board shall be of four (4) years, or until their successors are appointed and take office. The Members of the Board shall meet the following requirements: (1) (2) (3) (4) Employees, members of the Governing Board or members of the Committee of the College of Expert Electricians of Puerto Rico cannot be inspectors.

Expert electricians who are holding office as members of the present Board of Examiners of Expert Electricians on the date of approval of this Act and who do not meet the requirement provided in the preceding subsection (4), shall have to resign their position on the Examining Board of Expert Electricians of Puerto Rico."

Section 3.- Section 4 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows: "Section 4.- Removal and Vacancies. The Governor of Puerto Rico may remove any member of the Board upon the filing of charges, due notice and hearing, for immorality, negligence, having been convicted of a felony or a misdemeanor involving moral turpitude, and incompetence.

The governor shall fill vacancies on the Board by appointment, with the advice and consent of the Senate. The person

designated to fill a vacancy shall hold office until the term of the person who he is appointed to substitute, has expired.

No person may be appointed as member of the, Board for more than two (2) consecutive terms."

Section 4.- Subsections

(d) and

(h) are hereby amended, and (1) of Section 5 of Act No. 115 of June 2, 1976 as amended, is hereby repealed, to read as follows: "Section 5.- The Board shall have the following duties and powers:

(a) (d) It shall adopt bylaws for its operations, which shall be approved within the term of six months after approval of this Act.

(e) (h) It shall hold such meetings and sessions as may be necessary for the performance of its duties, upon call of the Chairman or of five (5) of its members.

(i) (I) It shall authorize the college of Expert Electricians of Puerto Rico, under the norms and regulations which the Board may specify by regulation, to implement the organization of a system of inspectors to ascertain that the provisions of this Act are complied with."

Section 5.- Section 7 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows:

"Section 7.- Licenses and Requirements.- Any person desiring a license as Apprentice Expert Electrician, shall meet the following requirements: (1) He shall fill out and submit an application to such effects to the Board, which shall provide the proper forms pursuant to the requirements prescribed by rules or regulations of the Board. (2) He shall have attained sixteen (16) years of age at the time of filing his application. (3) He shall have completed up to the ninth grade of intermediate school, which fact must be fully established, or shall have passed the apprenticeship course offered by the Department of Education, or shall have equivalence in experience, certified before the Board by a Collegiated Expert Electrician, in the manner the Board may specify by regulations. (4) He shall file a medical certificate and a good conduct certificate given by the Police with his application, showing that he is in sound physical and mental condition to work in construction projects and with electrical apparatus and circuits. (5) He shall attach an internal revenue voucher for ten (10) dollars to his application for a license or renewal. The license issued shall be effective for two years. At the

end of said term, the license so issued shall lose all force and effect and must be renewed upon payment of ten (10) dollars, through an internal revenue voucher. The fact of having filed an application for examination as Expert Electrician does not allow the person to work as an apprentice.

Any person desiring an Expert Electrician's license shall meet the following requirements: (1) Must have passed the fourth year of high school. (2) Be a graduate of an electrical course in a vocational school or technological institute of the Public Education System, or in lieu thereof, from a private vocational school duly-accredited by the Department of Education, in both cases with a minimum of eight-hundred (800) hours of training, Providing, that the Commonwealth Board for Advanced Skills and Vocational Education is hereby empowered to validate experience for hours of training, or in its place, to have finished the prescribed training course, or that which may be prescribed in the future by the Apprenticeship Council of Puerto Rico, created by virtue of the provisions of Act No. 483 approved on May 15, 1947, as it has, or shall be subsequently amended.

(3) Every Apprentice Expert Electrician holding a license as such, who has worked for a period of two (2) years under the supervision of a Collegiated Expert Electrician and has obtained a high school diploma, may apply for his Expert Electrician's license without complying with requirement number two (2);

Provided, also, that any person who presents a certification from a Collegiated Expert Electrician which certifies his having worked as an electrician for a period of not less than seven (7) years, and who had never before applied for an Expert Electrician's license, may apply for his Expert Electrician's license within one (1) year from the approval of this Act, without having to comply with requirements one (1) and two (2), and thus obtain said license through the approval of the examination. (4) Be resident of Puerto Rico, be over eighteen (18) years of age, and present a good conduct certificate issued by the Police of Puerto Rico."

Section 6.- Section 8 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows: "Section 8.- Examinations.-

(a) The examinations shall be offered by the Board three times a year, every four months.

(b) The examinations shall consist of two (2) parts, one, practical, and the other, theoretical. Each part shall have a value of fifty (50) points and the minimum number of points needed to pass each part shall be of seventy (70) percent thereof.

(c) Provided, that the candidates shall have to pass both parts of the examination to be granted a licence.

(d) If a candidate fails one part of the examination and passes the other, he shall only have to take a reexamination in the part he failed."

Section 7.- Section 11 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows:

"Section 11.- No collegiated expert electrician may have under his immediate supervision more than six (6) authorized apprentice expert electricians."

Section 8.- Section 12 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows:

"Section 12.- The following natural or juridical persons are exempted from the provisions of this Act:

(a) Apprentices duly-authorized by this Act, provided that they perform their work under the personal and immediate supervision of a Collegiated Expert Electrician.

(b) Collegiated Electrical Engineers graduated from a college or university of engineering, who hold a license issued by the Examining Board of Engineers, Architects and

Surveyors, who make electrical installations, or who employ Collegiated Expert Electricians.

(c) The Employees of the Electric Power Authority while they work in the properties of the Authority."

Section 9.- Subsection

(f) is hereby added to Section 15 of Act No. 115 of June 2, 1976 as amended, to read as follows:

"Section 15.- License Suspension, Renewal, or Denial

The Board may suspend, revoke, or deny the renewal of the license issued pursuant to this Act, upon filing of charges, due notice and hearing, to any person who:

(a) . . . . . . . . . .

(b) . . . . . . . . . .

(c) . . . . . . . . . .

(d) . . . . . . . . . .

(e) . . . . . . . . . .

(f) Makes electrical installations which do not meet the minimum standards of the National Electrical Code in effect, of the Puerto Rico Electrical Code and the regulations promulgated by the private or public company in charge of supplying electric power."

Section 10.- Section 18 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows:

Section 18.- Any member of the Examining Board, the inspectors of the College of Expert Electricians of Puerto Rico licensed by the Board, the Fire Service, the Commonwealth Police, the Secretary of Labor and his employees or officials authorized by

him, are hereby authorized to enter construction projects or industries where electrical installations are being made, to make investigations, inspections or interrogatories related to the enforcement of this Act."

Section 11.- Section 22 of Act No. 115 of June 2, 1976 as amended, is hereby amended to read as follows: "Section 22.- Every public or private service company:

(a) Shall inspect, through official inspectors of the company, who must be engineers or collegiated expert electricians or specialized technicians, the electrical installations thus made or supervised and certified by collegiated engineers or expert electricians.

(b) Shall approve and supply power service only to electrical installations which have been made or supervised by a collegiated electrical engineer or an expert collegiated electrician duly authorized by law, and which meet the National Electrical Code in effect, the Puerto Rico Electrical Code, and the Regulations promulgated by the public or private company in charge of supplying electric power. Provided, that the collegiated engineers and expert electricians shall certify that the electrical installations have been made, through an official document filed before the public or private service company.

The information required in this official document shall be provided by the public or private service company in

coordination with the Board of Examiners of Engineers, Architect and Surveyors, the Board of Examiners of Expert Electricians, the College of Engineers and Surveyors and the College of Expert Electricians. The original of the document shall be delivered to the public or private service company, the first copy shall be for the subscriber, and the second copy for the Collegiated Engineer or Expert Electrician.

Any natural or juridical person who, violates the provisions of this Act, or who employs persons not authorized by this Act to perform work, make electrical installations, or to supervise the same, shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than five hundred (500) dollars or imprisonment in jail for a period of not more than six months, or both penalties, in the discretion of the Court."

Section 12.- This Act shall take effect 60 days after the date of its approval.
