Ley 40 del 1984
Resumen
Esta ley enmienda la Ley de Vehículos y Tránsito de Puerto Rico para autorizar la expedición de tablillas especiales para los vehículos oficiales de los Jefes de Misiones Consulares acreditados en Puerto Rico. Establece los requisitos para su solicitud, uso exclusivo y devolución, y dispone penalidades por el uso no autorizado de dichas tablillas.

Para adicionar la Sección 2-412 a la Ley Núm. 141 del 20 de julio de 1960, según enmendada, conocida como "Ley de Vehículos y Tránsito de Puerto Rico", a los fines de disponer el uso de una tablilla especial al vehículo oficial del Jefe de cada Misión Consular que así lo solicite y para disponer penalidades.
EXPOSICION DE MOTIVOS
El Pueblo de Puerto Rico desea, en reconocimiento de la labor que llevan a cabo las Misiones Consulares en beneficio de la hermandad y comercio entre los Pueblos, conceder el privilegio de una distinción a través de una tablilla distintiva para uso del Cónsul o más alto oficial de la Misión Consular. Esta forma de identificación les facilitará el ejercicio de sus funciones ante nuestros organismos gubernamentales y privados y les distinguirá ante la comunidad. No conlleva este privilegio el menoscabo de nuestras leyes de tránsito, ordenanzas municipales de tránsito o leyes relacionadas a vehículos de motor y su utilización dentro del territorio de Puerto Rico.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Artículo 1.- Se adiciona la Sección 2-412 a la Ley Núm. 141 del 20 de julio de 1960, según enmendada, para que lea como sigue: "Sección 2-412.-Tablillas especiales para cónsules de carrera u honorarios debidamente acreditados en los Departamentos de Estado de los Estados Unidos y de Puerto Rico.
(a) El Secretario del Departamento de Transportación y Obras Públicas expedirá una tablilla especial a solicitud de la parte interesada, al vehículo de los cónsules debidamente acreditados en los Departamentos de Estado de los Estados Unidos y de Puerto Rico, en adición a la tablilla oficial expedida al vehículo. En el registro del vehículo se anotará la información necesaria para identificar la tablilla especial con el registro oficial del vehículo de motor correspondiente.
(b) La solicitud para tablilla especial deberá tener la debida certificación del Departamento de Estado en cuanto a la acreditación del Cónsul solicitante.
(c) Estas tablillas deberán llevar grabado la frase 'Misión Consular', la palabra 'Puerto Rico' y una numeración especial para el control de la expedición e identificación. La tablilla especial será fijada en un área visible de la parte posterior del vehículo.
(d) Dicha tablilla deberá usarse única y exclusivamente en el vehículo utilizado por el cónsul o más alto funcionario consular en el país. Dicho privilegio no es extensivo a miembros de su familia u otras personas o funcionarios del consulado.
(e) El uso de la tablilla especial queda autorizado únicamente en las vías públicas de Puerto Rico durante el período de vigencia de la tablilla oficial. Transcurrido dicho período deberá solicitarse la expedición de una nueva tablilla especial al renovarse la licencia del vehículo.
(f) Todo dueño de vehículo de motor a quien el Secretario de Transportación y Obras Públicas expida una tablilla especial vendrá obligado a devolverla al Secretario de Transportación y Obras Públicas cuando cesare en sus funciones o perdiere su acreditación como cónsul, cuando vendiere el vehículo, cuando envíe el mismo fuera del país, cuando dispusiere del mismo como chatarra o lo abandonare por inservible o cuando el vehículo quedare desautorizado para transitar por las vías públicas de Puerto Rico. El incumplimiento de esta disposición dará lugar a la cancelación de la autorización para el uso de la tablilla especial.
(g) Para efectos de esta sección la palabra 'cónsul' significará aquella persona que cuida en una población de los nacionales e intereses del país que representa debidamente acreditado ante los Departamentos de Estado de los Estados Unidos y de Puerto Rico como cónsul de carrera u honorario y que sean jefes permanentes, no provisionales, de un puesto consular debidamente acreditado.
(h) El Secretario de Transportación y Obras Públicas dispondrá mediante reglamento todo lo concerniente a la
expedición, uso, renovación y cancelación de las tablillas especiales.
(i) El Secretario de Estado tendrá la potestad de solicitar la cancelación del uso de dicha tablilla en caso de incumplimiento de las disposiciones de esta ley.
(j) El privilegio del uso de dicha tablilla no necesariamente implica ningún otro beneficio relacionado con vehículos para uso del cuerpo consular.
(k) Toda persona que exhiba una tablilla especial para cónsules sin estar autorizada para ello incurrirá en delito menos grave punible con multa no menor de cincuenta (50) dólares ni mayor de doscientos (200) dólares a discreción del Tribunal."
Artículo 2.- Esta Ley comenzará a regir noventa (90) días después de su aprobación.

AN ACT
To add Section 2-412 to Act No. 141 of July 20, 1960 as amended, known as the "Vehicle and Traffic Law of Puerto Rico" in order to provide for a special license plate to be used on the official vehicle of the Head of every Consular Mission who requests it, and to provide penalties.
STATEMENT OF MOTIVES
The People of Puerto Rico, in recognition of the work performed by the Consular Missions in benefit of the brotherhood and trade between the Peoples, wish to grant the privilege of a distinction through a special license plate for the use of the Consul or the highest Official of the Consular Mission. This manner of identifying them would facilitate the exercise of their functions before our governmental and private bodies, and would distinguish them before the community. This privilege is not meant to impair our traffic laws, municipal ordinances or laws regarding motor vehicles and their use within the territory of Puerto Rico.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 2-412 is hereby added to Act No. 141 of July 20, 1960 as amended, to read as follows: "Section 2-412.- Special license plates for career or honorary consuls, duly accredited in the Departments of State of the United States and of Puerto Rico.
(a) The Secretary of the Department of Transportation and Public Work shall issue a special Iicense plate on the.request of the interested party, for the vehicle of the consuls duly accredited in the Departments of State of the United States and of Puerto Rico, in addition to the official license plate issued to the vehicle. The information needed to identify the special license plate with the official registration of the corresponding motor vehicle, shall be written down in the registry of the vehicle.
(b) The request for a special license plate must be duly certified by the Department of State as to the accreditation of the requesting Consul.
(c) These license plates shall bear the phrase "Consular Mission", the word "Puerto Rico", and a special sequence of numbers to control their
issue and for identification. The special license plate shall be fixed in a visible area of the rear of the vehicle.
(d) Said license plate shall be used solely and exclusively on the vehicle used by the consul or the highest consular official in the country. Said privilege shall not be extended to the members of his family or other persons or officials of the consulate.
(e) The use of the special license plate is authorized solely on the public roads of Puerto Rico during the effective period of the official license plate. After said period has passed, the issuing of a new special license plate must be requested when the vehicle's license is renewed.
(f) Every owner of a motor vehicle to whom the Secretary of Transportation and Public Works issues a special license plate, shall have the obligation to return it to the Secretary of Transportation and Public Works when he ceases his functions or loses his accreditation as counsel, when he sells the vehicle, or sends it out of the country, when he disposes
of the same as scrap iron or abandons it as useless, or when said vehicle is no longer authorized to travel on the public roads of Puerto Rico. Failure to comply with this provision will bring about the cancellation of the authorization for the use of the special license plate.
(g) For the effects of this Section the word "consul" shall mean that person who watches over the citizens and interests of the country he represents in a country, being dulyaccredited before the Departments of State of the United States and of Puerto Rico as a career or honorary consul, and who are permanent heads, not provisional ones, of a dulyaccredited consular position.
(h) The Secretary of Transportation and Public Works shall provide, through regulations, all aspects regarding the issuing, use, renewal, and cancellation of the special license plates.
(i) The Secretary of State shall have the power to request the cancellation of the use of said license plate in cases of non-compliance with the provisions of this Act.
(j) The privilege of using said license plate, does not necessarily imply any other benefit concerning vehicles for the use of the consular corps.
(k) Any person who displays a special license plate for consuls without being authorized as such shall be guilty of a misdemeanor, punishable by a fine of not less than fifty (50) dollars, nor more than two hundred (200) dollars, at the discretion of the Court."
Section 2.- This Act shall take effect ninety (90) days after its approval.
