Ley 33 del 1984
Resumen
Esta ley enmienda la Ley Núm. 11 de 1974, conocida como "Ley de Donaciones Anatómicas", para actualizar y agilizar el procedimiento de adquisición de tejidos, órganos o partes de cadáveres para trasplantes e investigaciones científicas. Establece las formas legales para realizar donaciones (documento público o privado, con o sin notario/testigos) y autoriza la remoción de córneas, glándulas, órganos o tejidos durante autopsias por parte de profesionales médicos, siempre que no interfiera con la autopsia ni altere la apariencia post mortem del cadáver. También regula la entrega de córneas a bancos de ojos.

LEY
Para derogar el Inciso
(a) y sustituirlo por un nuevo Inciso
(a) del Artículo 8 de la Ley Núm. 11 de 15 de abril de 1974, según enmendada, conocida como "Ley de Donaciones Anatómicas", para establecer el procedimiento en la adquisición de tejidos, órganos o parte de ellos a fin de que puedan ser utilizados en trasplantes o investigaciones cientificas.
EXPOSICION DE MOTIVOS
Los objetivos y obligaciones de la Junta de Disposición de Cuerpos, Organos, Tejidos Humanos creada mediante la Ley Núm. 11 del 15 de abril de 1974, enmendada, han aumentado sustancialmente siguiendo los adelantos de la ciencia moderna.
Se propone la enmienda al Artículo 8 con el propósito de aligerar el proceso de adquirir tejidos (glándulas, hueso, piel, etc.) órganos (rinón, corazón, cerebro, etc.), o parte de ellos (córneas, etc.), para que éstos puedan ser efectivamente utilizados en trasplantes o investigaciones cientificas. La remoción de estos tejidos en ninguna forma altera la apariencia post mortem del cadáver.
Estas enmiendas van dirigidas a poner la Ley a tono con la evolución de nuestra sociedad, facilitar el proceso de donación y mejorar la legislación vigente.
La Ley Núm. 4 de 13 de septiembre de 1983 no enmendó el Artículo 8 de la Ley Núm. 11 del 15 de abril de 1974, según enmendada, referente al procedimiento de donaciones anatómicas. Para atemperar la Ley Núm. 6 con la Ley Núm. 11, ya mencionadas, se propone la enmienda al Artículo 8.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se deroga el Inciso
(a) y se sustituye por un nuevo Inciso faindel Artículo 8 de la Ley Núm. 11 del 15 de abril de 1974, según enmendada, para que lea como sigue: "Artículo 8.-Procedimiento de la donación; exención de responsabilidad.
(a) La donación de una parte o de la totalidad de un cadáver, la autorización para practicar una autopsia
clínica, o la donación de un órgano para trasplante vivo se hará por documento público o documento privado, suscrito ante Notario, o por documento privado ante dos o más testigos sin la concurrencia de Notario. Disponiéndose, sin embargo, que a los cadáveres bajo la jurisdicción del Estado Libre Asociado de Puerto Rico que se les practique autopsia por disposición de ley, el patólogo, el médico forense, el oftalmólogo, cirujano o sus ayudantes podrán remover las córneas, glándulas, órganos, tejidos o partes para ser entregadas a la Junta, para los fines y propósitos de esta Ley; siempre y cuando la remoción de dichas glándulas, córneas, órganos o tejidos no interfieran con la ejecución de la autopsia, con alguna intervención que se esté realizando por las autoridades competentes, o que altere la apariencia física post mortem del cadáver. Cuando se trate de córneas, éstas serán entregadas libre de costo al Banco de Ojos del Leonismo Puertorriqueño u otros bancos de ojos acreditados que se establezcan en un futuro, sin fines de lucro.

Sección 2.- Esta Ley comenzará a regir inmediatamente después de su aprobación.

AN ACT
To repeal subsection
(a) and substitute it with a new subsection
(a) of Section 8 of Act No. 11 of April 15, 1974, as amended, known as the "Anatomical Donations Act", to establish the procedure for the acquisition of tissues, organs, or parts thereof so that they may be used in transplants or scientific research.
STATEMENT OF MOTIVES
The objectives and obligations of the Board for the Disposal of Human Bodies, Organs, and Tissues, created by Act No. 11 of April 15, 1974, amended, have increased substantially pursuant to the advances of modern science.
An amendment to Section 8 is proposed, with the purpose of expediting the process of acquiring tissue (glands, bone, skin, etc.), organs (kidney, heart, brain, etc.) or parts thereof (corneas, etc.) so that they may be effectively used in transplants or scientific research. The removal of these tissues in no way alters the post-mortem appearance of the body.
These amendments are addressed to bring the Law up to the evolutionary level of our society, thus facilitating the donation process and improving the legislation in force.
Act No. 6 of September 13, 1983, did not amend Section 8 of Act No. 11 of April 15, 1974 as amended, with regard to the procedure for anatomic donations. In order to adjust Act No. 6 to the abovementioned Act No. 11 this amendment to Section 8 is hereby proposed.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Subsection
(a) is hereby repealed and substituted by a new subsection
(a) of Section 8 of Act No. 11 of April 15, 1974 as amended, to read as follows:
"Section 8.- Donation Procedure; Exemption from Liability.
(a) The donation of any part, or the entire corpse, the authorization to perform a clinical autopsy, or the donation of an organ for a live transplant, shall be made by a public or unofficial document, signed before a Notary, or by an unofficial document before two or more witnesses, without the concurrence of a Notary. Provided, however, that these corpses under the jurisdiction of the Commonwealth of Puerto Rico upon which an autopsy
is performed under the law, the pathologist, the medical examiner, the opthalmologist, surgeon, or their assistants may remove the corneas, glands, organs, tissue or parts, to be delivered to the Board for the ends and purposes of this Act; as long as the removal of said glands, corneas, organs, or tissues do not interfere with the performance of the autopsy, with any operation that is being carried out by competent authorities, or which alters the post-mortem physical appearance of the body. In the case of corneas, these will be handed over free of charge, to the Eye Bank of the Lions Club of Puerto Rico or other accredited non-profit eye banks that might be established in the future.

Section 2.- This Act shall take effect immediately after its approval.
