Ley 24 del 1984

Para adicionar un apartado (4) al inciso

(c) de la Sección 6-209 y enmendar la Sección 6-311 de la Ley Núm. 141 de 20 de julio de 1960, según enmendada, conocida como "Ley de Vehículos y Tránsito de Puerto Rico", a los fines de autorizar, bajo ciertas condiciones, el uso de luces intermitentes o rojas y de sirenas y campanas en los vehículos de agencias de seguridad privadas dedicadas a la protección de personas o propiedad mueble o inmueble.

EXPOSICION DE MOTIVOS

Es un hecho de conocimiento general que en el presente nuestro pais sufre un grave problema de criminalidad que se manifiesta grandemente en la frecuente comisión de delitos contra la vida, contra la integridad corporal y contra la propiedad. El Estado, a través de la Policía de Puerto Rico y de otros organismos que se han creado tales como la Guardia Municipal, lucha incansablemente por combatir este terrible mal. Sin embargo, los recursos humanos y económicos con que cuenta el Estado para ganar esta batalla son limitados. Consciente de esto, los ciudadanos están buscando, por ellos mismos, los medios y mecanismos necesarios para la protección de sus vidas y las de los suyos y de sus bienes.

Como respuesta a esta demanda ciudadana, se han creado compañías privadas que prestan servicios de vigilancia y prevención del crimen y de protección a vidas y propiedades. Estas compañías o agencias de segu idad están brindando un servicio a la comunidad y, por ende, una ayuda al Estado en su lucha por combatir la criminalidad.

Durante la prestación de sus servicios, a estas agencias privadas de seguridad les resulta necesario e imprescindible utilizar métodos y mecanismos que les permitan realizar sus funciones con la mayor eficiencia posible. En consideración a ello, esta Asamblea Legislativa aprueba esta medida que autoriza el uso de luces intermitentes o rojas y de sirenas y campanas en vehículos que son propiedad de estas agencias privadas de seguridad, que están debidamente identificados, cuando los mismos estén llevando a cabo gestiones que pueden ser clasificadas como de emergencia.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Artículo 1.- Se adiciona un apartado (4) al inciso

(c) de la Sección 6-209 de la Ley Núm. 141 de 20 de julio de 1960, según enmendada, para que lea como sigue: "Sección 6-109.-Luces Intermitentes o Rojas.- a) c) Quedan exceptuados de las disposiciones de los precedentes incisos

(a) y

(b) , los siguientes vehículos:

2. Vehículos de agencias privadas de seguridad para la protección de personas o de propiedad mueble o inmueble que estén autorizadas por ley para operar como tales, cuando dichos vehículos estén debidamente identificados y llevando a cabo gestiones de emergencia". Artículo 2.- Se enmienda la Sección 6-311 de la Ley Núm. 141 de 20 de julio de 1960, según enmendada, para que lea como sigue: "Sección 6-311.-Uso de Sirenas y campanas.- Será ilegal el uso y la instalación en vehículos de motor de pitos, sirenas y campanas. Esta disposición no será aplicable a los vehículos de servicio de bomberos, de la Policía, ambulancias y vehículos que son propiedad de agencias privadas de seguridad para la protección de personas o propiedad mueble o inmueble que estén autorizadas por ley para operar como tales, cuando dichos vehículos estuvieren debidamente identificados y llevando a cabo gestiones de emergencia." Artículo 3.- Esta Ley empezará a regir inmediatamente después de su aprobación.

AN ACT

To add a paragraph (4) to subsection

(c) of Section 6-209 and to amend Section 6-311 of Act No. 141 of July 20, of 1960 as amended, known as the "Vehicle and Traffic Law of Puerto Rico", in order to authorize, under certain conditions, the use of intermittent or red lights, and sirens and bells in the vehicles of private security agencies dedicated to the protection of persons, or personal or real property.

STATEMENT OF MOTIVES

It is a generally-known fact that our country is affected at present by a serious crime problem that is greatly evidenced by the frequent commission of crimes against life, against physical integrity, and property. The Commonwealth carries out an untiring fight to combat this terrible evil through the Police of Puerto Rico and other bodies that have been created, such as the Municipal Guard. However, the human and economic resources that the Commonwealth can count on to win this battle are limited. Aware of this, the citizens are

searching, on their own, for the necessary means and mechanisms for the protection of their lives and those of their loved ones, and of their property.

As an answer to this demand by the citizenry, private companies that give vigilance and crime prevention and life and property protection services, have been created. These companies or security agencies, are providing a service to the community and at the same time are helping the Commonwealth in its fight against crime.

While rendering their services, these private security agencies find it necessary and imperative to use methods and mechanisms which allow them to carry out their functions in the most efficient manner possible. In consideration of this, this Legislature approves this bill which authorizes the use of intermittent or red lights, and of sirens and bells in vehicles that are the property of these private security agencies, and are duly-identified as such, when the same are carrying out activities that can be classified as emergencies.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- A paragraph (4) is hereby added to subsection

(c) of Section 6-209 of Act No. 141 of July 20, 1960 as amended, to read as follows:

"Section 6-209--Flashing or red lights.--

(a) (c) Excepted from the provisions of the preceding subsections

(a) and

(b) are the following vehicles:

1. .........................
2. Vehicles of private security agencies for the protection of persons, or real or personal property, that are authorized by law to operate as such, when said vehicles are duly-identified and carrying out emergency activities." Section 2.- Section 6-311 of Act No. 141 of July 20, 1960 as amended, is hereby amended to read as follows: "Section 6-311.- Use of Sirens and bells.It shall be illegal to use and install whistles, sirens and bells in motor vehicles. This provision shall not apply to Fire Service and Police Vehicles, ambulances, and vehicles that are the property of private security agencies for the protection of persons or personal or real property, that are legallyauthorized to operate as such, when said vehicles are duly-identified and carrying out emergency activities." Section 3.- This Act shall take effect immediately after its approval.
