LEY

Para adicionar los incisos

(c) y

(d) al Artículo 1 de la Ley Núm. 87 de 26 de junio de 1964 para disponer que toda persona que sirva como jurado podrá cargar el tiempo que ha tenido que ausentarse de su trabajo por esta razón, a su licencia regular de vacaciones y que el patrono que despida o reinstale en una plaza de inferior categoría, status o retribución a un trabajador por tales motivos incurrirá en responsabilidad civil.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Sección 1.- Se adicionan los incisos

(c) y

(d) al Artículo 1 de la Ley Núm. 87 de 26 de junio de 1964, para que lea como sigue: "Artículo 1.-Derecho de reinstalación

(a) (c) Toda persona que haya tenido que ausentarse de su trabajo para servir como jurado podrá, a su discreción, cargar el tiempo que se ha ausentado para actuar como tal a su licencia regular de vacaciones. Lo dispuesto en este inciso en nada afectará los derechos adquiridos mediante negociación colectiva a estos efectos.

(d) Todo patrono que despida a una persona por haber servido como jurado o que por esta razón se niegue a reinstalarlo, o lo reinstale en una plaza de inferior categoría, status, o retribución que la que ocupaba al momento de comenzar a servir como jurado siempre que se cumpla con lo dispuesto en el inciso

(b) de esta sección, incurrirá en responsabilidad civil por una suma igual al doble del importe de los daños que esta actuación haya causado a la persona o por una suma no menor de cien (100) dólares, ni mayor de mil ( 1,000 ) dólares a discreción del Tribunal, si no se pudiesen determinar los daños pecuniarios." Sección 2.- Esta Ley entrará en vigor inmediatamente después de su aprobación.

AN ACT to add subsections

(c) and

(d) to Section 1 of Act No. 87 of June 26, 1964, to provide that any person who acts as a juror may charge the time that he has had to be absent from his job for this reason, to his regular vacation leave, and that the employer who dimisses or reinstates a worker in a position of lower category, status or retribution for such reasons, shall incur civil liability, and finds the same are complete, true and correct versions of each other.

To add subsections

(c) and

(d) to Section 1 of Act No. 87 of June 26, 1964, to provide that any person who acts as a juror may charge the time that he has had to be absent from his job for this reason, to his regular vacation leave, and that the employer who dimisses or reinstates a worker in a position of lower category, status or retribution for such reasons, shall incur civil liability.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Subsections

(c) and

(d) are hereby added to Section 1 of Act No. 87 of June 26, 1964, to read as follows: "Section 1.- Right to Reinstatement

(a) (c) Any person who has had to absent himself from his job to act as juror may, at his discretion, charge the time that he has been absent to act as such, to his regular vacation leave. The provisions of this subsection shall in no way affect the rights acquired through collective bargaining to these effects.

(d) Any employer who dismisses a person for having served as a juror, or refuses to reinstate him for this reason or reinstates him in a position of an inferior category, status, or retribution than what he held at the moment he started to serve as a juror, provided the provisions of subsection

(b) of this Section are met, shall incur civil liability for a sum equal to twice the amount of damages caused by his action to this person, or for a sum of not less than one hundred (100) dollars nor more than one thousand (1,000) dollars at the discretion of the Court, if the pecuniary damages cannot be determined."

Section 2.- This Act shall take effect immediately after its approval.
