Ley 16 del 1984
Resumen
Esta ley enmienda el Código Penal de Puerto Rico para ajustar las penas por recibir y transportar bienes obtenidos ilegalmente. Además, introduce un nuevo artículo que faculta al Secretario de Justicia, al Secretario de Hacienda y al Superintendente de la Policía a confiscar vehículos de motor, embarcaciones marítimas o aéreas, y cualquier otro medio de transportación utilizado en el traslado de dichos bienes ilícitos, estableciendo el procedimiento a seguir para dicha confiscación.

Para enmendar el Artículo 168 y añadir el Artículo 168A a la Ley Núm. 115 de 22 de julio de 1974, según enmendada, conocida como Código Penal de Puerto Rico.
EXPOSICION DE MOTIVOS
En la mayoría de los delitos que envuelven bienes apropiados ilegalmente, robados, obtenidos por medio de extorsión o cualquier otra forma ilícita la persona o personas envueltas utilizan vehículos de motor o cualquier otro medio de transportación para cargar o transportar los bienes. A fin de evitar la desaparición de evidencia relacionada con el acto delictivo se faculta al Secretario de Justicia, al Secretario de Hacienda y al Superintendente de la Policía a confiscar los vehículos de motor, embarcaciones marítimas o aéreas y cualquier otro medio de transportación utilizado en la transportación y carga de la mercancía obtenida ilegalmente.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el Artículo 168 de la Ley Núm. 115 de 22 de julio de 1974, según enmendada para que lea: "Recibo y Transportación de Bienes Apropiados Ilegalmente
Artículo 168.- Toda persona que compre, reciba, retenga, transporte, cargue o disponga de algún bien mueble, a sabiendas de que fue obtenido mediante apropiación ilegal, robo, extorsión, o cualquier otra forma ilícita, será sancionado con pena de reclusión que no excederá de seis meses o multa que no excederá de quinientos dólares, o ambas penas a discreción del Tribunal, si el valor del bien apropiado ilegalmente no llegare a doscientos dólares. Si llegare o excediere este valor, será sancionada con pena de reclusión por un término fijo de tres (3) años. De mediar circunstancias agravantes, la pena fija establecida podrá ser aumentada hasta un máximo de cinco (5) años; de mediar circunstancias atenuantes, podrá ser reducida hasta un mínimo de dos años. El Tribunal podrá imponer la
pena de restitución en adición a la pena de reclusión establecida o ambas penas."
Sección 2.- Se adiciona el Artículo 168-A a la Ley Nüm. 115 de 22 de julio de 1974, para que lea:
Confiscación de Vehículos u otros Medios de Transportación Artículo 168-A.-
Todo vehículo u otro medio de transportación que haya sido utilizado para la transportación de bienes apropiados ilegalmente, robados, obtenidos por medio de extorsión, o cualquiera otra forma ilícita será confiscado por el Secretario de Justicia, el Secretario de Hacienda o por el Superintendente de la Policía, por conducto de sus delegados, policías o agentes del orden público en favor del Estado Libre Asociado de Puerto Rico. Los vehículos de motor o cualquier medio de transportación confiscados serán puestos bajo custodia de la Oficina de Transporte.
Para la confiscación y disposición de vehículos, bestias, embarcaciones marítimas o aéreas o de cualquier medio de transportación se seguirá el procedimiento establecido en la "Ley Uniforme de Confiscación de Vehículos, Bestias y Embarcaciones", Ley Número 39 de 4 de junio de 1960, según enmendada; excepto que la notificación de confiscación a las personas con interés sobre la propiedad confiscada se hará dentro de los diez (10) días de la ocupación o de que se establezca que la propiedad transportada y/o cargada es una obtenida ilegalmente, conforme se establece en el Artículo 168. Sección 3.- Esta Ley empezará a regir inmediatamente después de su aprobación.

STATEMENT OF MOTIVES
In most offenses involving property that has been unlawfully appropriated, stolen, obtained by extortion or any other illicit means, the person or persons involved use motor vehicles or any other means of transportation to load or transport the property. To avoid the disappearance of the evidence related to the unlawful act, the Secretary of Justice, the Secretary of the Treasury, and the Police Superintendent are empowered to seize the motor vehicles, marine or air vessels, or any other means of transportation used in the loading or transportation of the unlawfully-appropriated goods.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Article 168 of Act No. 115 of July 22, 1974
as amended, is hereby amended to read as follow: "Receiving and Transporting of Unlawfully-Appropriated Property.
Article 168.- Any person who purchases, receives, retains, transports, loads, or disposes of any personal property, knowing that it was obtained by unlawful appropriation, robbery, extortion, or by any other illegal means, shall be punished by imprisonment for a term not exceeding six months, or a fine not exceeding five hundred dollars, or both penalties, in the discretion of the Court, if the value of the property unlawfully appropriated is less than two hundred dollars. If it amounts to, or exceeds this value, he shall be punished by imprisonment for a fixed term of three (3) years. Should there be aggravating circumstances, the fixed penalty established may be increased to a maximum of five (5) years; if there should be extenuating circumstances, it may be reduced to a minimum of two (2) years. The Court may impose the penalty of restitution in addition to the established penalty of imprisonment, or both penalties."
Section 2.- Article 168A is hereby added to Act No. 115 of July 22, 1974, to read:
Seizure of Vehicles and other means of Transportation.
Article 168 A.- Every vehicle or other means of transportation which has been used for the transportation of property unlawfullyappropriated, stolen, obtained by extortion, or any other unlawful means, shall be seized by the Secretary of Justice, the Secretary of the Treasury, or by the Police Superintendent through his agent, policemen or officers of the peace, in behalf of the Commonwealth of Puerto Rico. The motor vehicle or any means of transportation thus seized shall be placed under the custody of the Transportation Office.
The procedure to be followed for the seizure and disposition of vehicles, mounts, marine or air vessels or any other means of transportation, shall be that which is established by Act No. 39 of June 4, 1960 as amended, the "Uniform Vehicle, Mounts and Vessel Seizure Act", except that the notice of seizure to the parties with an interest in the seized property, shall be made within ten (10) days following such seizure, or after establishing that the transported and/or loaded property has been obtained illegally, as established in Article 168. Section 3.- This Act shall take place immediately after its approval.
