Resumen
Enmienda la Ley Núm. 66 de 1976 para fortalecer el 'Fondo para la Fiscalización y Reglamentación de la Industria de Seguros'. La ley incorpora multas, intereses y gastos de investigación al fondo, y autoriza al Comisionado de Seguros a fijar tarifas por la radicación y aprobación de documentos y tipos de seguros. Además, especifica que el fondo se nutre de gastos de examen, derechos de presentación, venta de publicaciones y una parte de la contribución sobre primas de aseguradores.

L E Y Para enmendar el título y el Artículo 1 de la Ley Núm. 66 de 27 de mayo de 1976, según enmendada, para incluir entre las partidas que se ingresan al Fondo para la Fiscalización y Reglamentación de la Industria de Seguros, las multas, intereses y todo otro gasto en que se incurriere como resultado de las investigaciones que realiza el Comisionado de Seguros y autorizar al Comisionado de Seguros a fijar mediante reglamentación las tarifas de los derechos a cobrarse por la radicación de una serie de documentos y tipos que dicho Comisionado viene obligado a aprobar o desaprobar.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el título de la Ley Núm. 66 de 27 de mayo de 1976, para que lea como sigue: "Para crear en los libros del Secretario de Hacienda una cuenta especial denominada 'Fondo para la Fiscalización y Reglamentación de la Industria de Seguros' y para ordenar que se ingrese en dicha cuenta el dinero que toda entidad, organismo o persona pague al Secretario de Hacienda por concepto de gastos y derechos de examen, análisis e investigación de la Industria de Seguros; derechos de presentación e inscripción; venta de publicaciones; y cierta cantidad de los fondos que genere la contribución sobre primas de aseguradores del país; y para autorizar el anticipode foridos para sufragar los gastos iniciales de operación y para disponer de su devolución al Fondo General." Sección 2.- Se enmienda el Artículo 1 de la Ley Núm. 66 de 27 de mayo de 1976, para que lea como sigue: "Artículo 1.-Por la presente se crea en los libros del Secrel. . . . tario de Hacienda una cuenta especial denominada 'Fondo para la Fiscalización y Reglamentación de la Industria de Seguros' y se ordena que se ingresen en dicha cuenta especial los dineros en exceso de $59,000 que toda entidad, organismo o persona pague al Secretario de Hacienda por concepto de: (1) los gastos y derechos de examen, análisis e investigación de las operaciones de la
Industria de Seguros que realice el Comisionado de Seguros de acuerdo con la legislación vigente o que se aprobare en el futuro, incluyendo las multas e intereses que se impusieren, así como todo otro gasto en que incurriere la Oficina del Comisionado de Seguros a consecuencia de dichos exámenes e investigaciones; (2) los úerechos de presentación e inscripción de formularios básicos de polizas de seguro, formularios de solicitud, endoso, o aditamento, manuales de tipo, listas de tipos, clasificación de riesgo y planes tarifarios que estén sujetos a aprobación o inscripción conforme a los Artículos 11.110, 12.050 y 19.080 de la Ley Núm. 77 de 19 de junio de 1957, según enmendada; (3) las publicaciones que el Comisionado de Seguros venda; y (4) la mitad de los fondos generados por concepto de la contribución sobre primas generadas por aseguradores del país conforme a las disposiciones del Artículo 7.021 de la Ley Núm. 77 de 19 de junio de 1957, según enmendada.
Se autoriza al Comisionado de Seguros a adoptar reglas y reglamentos adecuados para fijar los derechos de radicación e inscripción aludidos en el párrafo anterior."
Sección 3.- Esta Ley empezará a regir inmediatamente después de su aprobación.

B. 957) of the Third Session of the 9th Legislature of the Commonwealth of Puerto Rico, entitled:
AN ACT to amend the title and Section 1 of Act No. 66 of May 27, 1976, as amended, to include among the items to be covered into the Insurance Industry Control and Regulations Fund, the fines, interest and any other expense incurred as a result of the investigations conducted by the Insurance Commissioner, etc., and finds the same are complete, true and correct versions of each other.
(NO. 90) (Approved June 4, 1983) AN ACT To amend the title and Section 1 of Act No. 66 of May 27, 1976 as amended, to include among the items to be covered into the Insurance Industry Control and Regulations Fund the fines, interest and any other expense incurred as a result of the investigations conducted by the Insurance Commissioner, and to authorize the Insurance Commissioner to fix, through regulations, the rates of the fees to be collected for the filing of a series of documents and the rates which said Commissioner is required to approve or disapprove.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- The title of Act No. 66 of May 27, 1976, is hereby amended to read as follows: "To create upon the books of the Secretary of the Treasury a special account called 'Insurance Industry Control and Regulation Fund' and to direct that there be covered into said account the monies that any entity, body or person pays to the Secretary of the Treasury for the expenses and fees for the examination, analysis and investigation of the Insurance
Industry; presentation and registration fees; sale of publications; and a certain amount of the funds generated by the premium tax on the country's underwriters' premiums, and to authorize the advancing of funds to defray the initial operating expenses, and to provide for the reimbursement thereof to the General Fund."
Section 1.- Section 1 of Act No. 66 of May 27, 1976, is hereby amended to read as follows: "Section 1.- There is hereby created upon the books of the Secretary of the Treasury, a special account called the 'Insurance Industry Control and Regulations Fund'and it is hereby directed that there be covered into said special account the monies in excess of $59,000 that any entity, body or person pays to the Secretary of the Treasury for: (1) the expenses and fees for the examination, analysis and investigation of the operations of the Insurance Industry conducted by the Insurance Commissioner in accordance with the legislation in force or to be approved in the future, including fines and interest to be imposed, as well as any other expense incurred by the Office of the Insurance Commissioner as a result of said examinations and investigations; (2) fees for the presentation and registration of basic insurance policy forms, application, endorsement or rider forms, rate manuals, schedules of rates, classification of risks and rating plans which
are subject to approval or registration in accordance with Sections 11.110, 12.050 and 19.080 of Act No. 77 of June 19, 1957 as amended; (3) the publications sold by the Insurance Commissioner; and (4) half of the fund generated by concept of the premium tax generated by the underwriters of the country pursuant to the provisions of Section 7.021 of Act No. 77 of June 19, 1957 as amended.
The Insurance Commissioner is hereby authorized to adopt adequate rules and regulations to fix the filing and registration fees mentioned in the preceding paragraph."
Section 3.- This Act shall take effect immediately after its approval.
