Ley 87 del 1983
Resumen
Esta ley enmienda la "Ley de Vehículos y Tránsito de Puerto Rico" para establecer el uso de tablillas especiales para vehículos privados de personas físicamente impedidas o de instituciones dedicadas a su transportación. Define las condiciones de expedición, uso y devolución de estas tablillas, otorga al Secretario del Departamento de Transportación y Obras Públicas la facultad de reglamentar su implementación y establecer privilegios de estacionamiento, e impone penalidades administrativas por el uso indebido o el estacionamiento ilegal en áreas reservadas.

LEY
Para derogar la Sección 2-409; enmendar la Sección 2-410 y adicionar el inciso (100) a la Sección 16-101 de la Ley Núm. 141 de 20 de julio de 1960, según enmendada, conocida como "Ley de Vehículos y Tránsito de Puerto Rico", a los fines de disponer el uso de una tablilla especial a los vehículos privados de los físicamente impedidos o de instituciones dedicadas a la transportación de éstos e imponer penalidades.
EXPOSICION DE MOTIVOS
Al aprobarse la Ley Número 63 del 21 de junio de 1978 para enmendar la Ley Número 141 de 20 de julio de 1960, según enmendada, no se incluyó en dicha aprobación la determinación de penalidad y otros alcances que resultan necesarios para el buen funcionamiento del propósito de dicha ley. Con esta ley se atemperan esas diferencias para lograr el propósito de la antes citada ley y para permitir a las autoridades pertinentes actuar contra los violadores de la misma.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Artículo 1.- Se deroga la Sección 2-409 de la Ley Núm. 141 de 20 de julio de 1960, enmendada:
Artículo 2.- Se enmienda la Sección 2-410 de la Ley Núm. 141 de 20 de julio de 1960, según enmendada, para que lea como sigue: "Sección 2-410.-Tablillas especiales para personas físicamente impedidas.
(a) El Secretario del Departamento de Transportación y Obras Públicas expedirá tablillas especiales a todo vehículo de motor privado que pertenezca y usen las instituciones con fines no pecuniarios dedicados a la transportación de personas físicamente impedidas y para los vehículos que pertenezcan y use personalmente una persona físicamente impedida o lisiada, según el Secretario del Departamento de Servicios Sociales haya definido el término persona físicamente impedida o lisiada y haya establecido el grado de incapacidad física que haría a la
persona físicamente impedida o lisiada, elegible a los privilegios que concede esta ley:-
Dichas tablillas deberán llevar grabado el símbolo internacional de los físicamente impedidos, la palabra 'Puerto Rico' y una numeración especial, autorizada por el Secretario del Departamento de Transportación y Obras Públicas.
Estas tablillas sólo podrán ser usadas mientras el vehículo de motor privado pertenezca y sea conducido por la persona físicamente impedida o lisiada debidamente identificada mediante tarjeta expedida por el Secretario del Departamento de Servicios Sociales, excepción hecha en aquellas situaciones en que la persona físicamente impedida o lisiada no pueda conducir ella misma u opta por usar un conductor autorizado; o cuando se trate de vehículos propiedad de las instituciones con fines no pecuniarios dedicadas a transportación de personas físicamente impedidas o lisiadas. La conducción del vehículo por otra persona que no sea la físicamente impedida o lisiada quedará autorizada única y exclusivamente para la transportación de la persona natural o jurídica, propietaria del vehículo de motor privado para el cual la tablilla especial fuese expedida. Este deberá devolver las tablillas al hacer la transferencia del vehículo de motor a otra persona, según lo dispone la ley.
El Secretario dispondrá por reglamento todo lo concerniente a la expedición, uso, renovación y cancelación de tablillas, y establecerá ciertos privilegios de estacionamiento para los vehículos que sean utilizados por las personas a que hace mención esta ley.
(b) La tablilla especial expedida al vehículo de motor privado de una persona natural o jurídica según se dispone en el inciso
(a) , no conllevará pago adicional al prescrito por ley para tablillas de vehículos de uso privado.
(c) (d) Toda persona que estacione ilegalmente un vehículo de motor en las áreas especialmente marcadas y reservadas para vehículos de motor privado de las personas en esta ley indicados, incurrirá en falta administrativa."
Artículo 3.- Se adiciona el inciso (100) a la Sección 16-101 de la Ley Núm. 141 de 20 de julio de 1960, según enmendada, para que lea como sigue: "Sección 16-101-Actcs ilegales que constituirán faltas administrativas de tránsito.-

AN ACT
To repeal Section 2-409; to amend Section 2-410 and to add subsection (100) to Section 16-101 of Act No. 141 of July 20,1960 as amended, known as the "Vehicle and Traffic Law of Puerto Rico", for the purpose of providing a special license plate for the private vehicles of physically-disabled persons, or the institutions devoted to their transportation, and to impose penalties.
STATEMENT OF MOTIVES
When Act No. 63 of June 21 of 1978, was approved to amend Act No. 141 of July 20, 1960 as amended, the determination of penalties and other matters that are necessary for the purposes, and the orderly operation of said Act, were not included. With this Act, these differences are adjusted so as to achieve the purpose of the abovementioned Act and to allow the pertinent authorities to act against violators thereof.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 2-409 of Act No. 141 of July 20, 1960 as amended, is hereby repealed.
Section 2.- Section 2-410 of Act Number 141 of July 20, 1960 as amended, is hereby amended to read as follows: "Section 2-410.- Special license plates for physically disabled persons.
(a) The Secretary of the Department of Transportation and Public Works shall issue special license plates for all motor vehicles owned and operated by non-profit institutions devoted to the transportation of physicallydisabled persons and for vehicles owned and personally operated by a crippled or physicallydisabled person, according to the Secretary of the Department of Social Services' definition of the term 'crippled or physically-disabled person', and has established the degree of physical disability that would make the crippled or physically-disabled person eligible for the privileges granted by this Act.
Said license plates shall have the international symbol of the physically-disabled, the words 'Puerto Rico' and a special series of numbers authorized by the Secretary of Transportation and Public Works.
Said license plates may only be used while the private motor vehicle is owned and operated by the crippled or physically-disabled person who is dulyidentified by a card issued by the Secretary of the Department of Social Services, with the exception of those cases in which the physically-disabled or crippled person cannot drive, or chooses an authorized driver to drive; or when the vehicles are owned by nonprofit institutions devoted to the transportation of physically-disabled or crippled persons. The driving of the vehicle by any person other than the physically-disabled or crippled person, shall be authorized solely and exclusively for the transportation of the natural or juridical person who owns the private motor vehicle to whom the special license plate has been issued. This person must return the license plates when the motor vehicle is transferred to another person, pursuant to the law.
The Secretary shall provide by regulations, everything concerning the issuing, use, renewal and cancellation of the license plates, and shall establish certain parking privileges for the vehicles that are used by the persons mentioned in this Act.
(b) The special license plates issued to the private
motor vehicle of a natural or juridical person as provided in subsection
(a) , shall not require any additional fees than those required by law for the license plates of privately-used vehicles.
(c) (d) Any person who parks a motor vehicle in the areas specifically set aside and reserved for the private motor vehicles of the persons indicated in this Act, illegaly, shall be guilty of an administrative offense." Section 3.-Subsection (100) is hereby added to Section 16-101 of Act No. 141 of July 20, 1960 as amended, to read as follows: "Section 16-101- Illegal acts which shall constitute administrative traffic offenses.
