Ley 76 del 1983

Para enmendar las Secciones 2 y 3 de la Ley Núm. 133 de 14 de mayo de 1937, según enmendada, a los fines de exigir como requisito para expedir licencias para contraer matrimonio, que se presente certificado médico al Registro Demográfico, acompañado de la hoja del informe del laboratorio clínico demostrativa del resultado del examen para la detección de enfermedades venéreas y establecer penalidades.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Artículo 1.- Se enmienda la Sección 2 de la Ley Núm. 133 de 14 de mayo de 1937, según enmendada, para que lea como sigue: "Sección 2.-Por la presente se prohibe a los encargados de los registros demográficos expedir certificados o licencias para contraer matrimonio, a aquellos hombres o mujeres que padezcan de las enfermedades indicadas en la sección primera de esta Ley. Tampoco podrá expedirse ningún certificado o licencia para contraer matrimonio cuando ambos contrayentes no presentaren al registrador demográfico, un certificado médico demostrativo de que ninguno de ellos sufre las enfermedades indicadas en la sección primera de esta Ley. La hoja del informe del laboratorio clínico, demostrativa del resultado del examen para la detección de enfermedades venéreas formará parte del certificado médico. Los médicos de beneficencia municipal o aquellos que fueran empleados del Gobierno Estadual vendrán obligados a expedir las certificaciones referidas anteriormente a aquellas personas insolventes sin cobro de honorarios. La certificación médica será válida por un término de diez (10) días desde su expedición, y transcurridos éstos, no podrán contraer matrimonio sin una nueva certificación médica." Artículo 2.- Se enmienda la Sección 3 de la Ley Núm. 133 de 14 de mayo de 1937, según enmendada, para que lea como sigue: "Sección 3.-Toda persona que contrajere matrimonio, o indujere o facilitare en su celebración, en contravención de lo dispuesto por esta Ley, incurrirá en delito menos grave, y

convicta que fuere será sancionada con pena de reclusión por un período que no excederá de seis (6) meses. Las disposiciones de esta sección no serán aplicables a las personas que padezcan de locura o demencia, en relación con las cuales se dispondrá de conformidad con las leyes vigentes sobre la materia."

Artículo 3.- Esta Ley comenzará a regir inmediatamente después de su aprobación.

B. 762) of the 3rd Session of the 9th Legislature of the Commonwealth of Puerto Rico, entitled:

AN ACT to amend Sections 2 and 3 of Act No. 133 of May 14, 1937 as amended, to require that in order to issue a marriage license, a medical certificate must be presented to the Vital Statistics Registry together with the report from the clinical laboratory which shows the results of the examination for the detection of venereal diseases, and to establish penalties, and finds the same are complete, true and correct versions of each other.

To amend Sections 2 and 3 of Act No. 133 of May 14, 1937 as amended, to require that in order to issue a marriage license, a medical certificate must be presented to the Vital Statistics Registry together with the report from the clinical laboratory which shows the results of the examination for the detection of venereal diseases, and to establish penalties.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- Section 2 of Act No. 133 of May 14, 1937 as amended, is hereby amended to read as follows: "Section 2.- Keepers of vital statistics registries are hereby prohibited from issuing marriage certificates or licenses to men or women who suffer from the diseases indicated in Section 1 hereof. Neither will a marriage certificate or license be issued unless both parties present to the Registrar of Vital Statistics, a medical certificate showing that neither of them suffers from the diseases indicated in Section 1 hereof. The report from the clinical laboratory showing the results of the

examination for the detection of venereal diseases shall be part of the medical certificate. The municipal public welfare physicians or those physicians employed by the Commonwealth Government shall be obliged to issue the certificates mentioned hereinabove to insolvent persons, without charging any fee therefor. The medical certificate shall be valid for a term of ten (10) days from its date of issue, and when said term has elapsed, they may not contract marriage until a new medical certificate is issued."

Section 2.- Section 3 of Act No. 133 of May 14, 1937 as amended, is hereby amended to read as follows: "Section 3.- Every person who contracts marriage, or who induces or facilitates its being contracted in violation of the provisions of this Act, shall be guilty of a misdemeanor and, upon conviction, shall be punished by imprisonment for a period which shall not exceed six (6) months. The provisions of this Section shall not be applicable to persons suffering from insanity or dementia, in connection with whom provisions shall be made in accordance with the laws in force on this matter."

Section 3.- This Act shall take effect immediately after its approval.
