Resumen
Esta ley enmienda la Ley Núm. 12 de 1982 para aclarar y ampliar la elegibilidad de una bonificación especial no recurrente y futuros aumentos salariales para empleados públicos. Asegura que todos los maestros en el servicio público, el Cuerpo de la Policía y otros empleados de la administración central y judicial reciban estos beneficios, y establece la primera etapa de un plan retributivo integral a largo plazo.

Para enmendar el tercer y el cuarto párrafo de la exposición de motivos, el Artículo 2, el primer párrafo del Artículo 3 y el primer párrafo del Artículo 4 de la Ley Núm. 12 de 27 de agosto de 1982 .
EXPOSICION DE MOTIVOS
Con el propósito de ofrecer un alivio salarial a los empleados públicos con antelación a la adopción de un plan retributivo integral a largo plazo, se aprobó la Ley Núm. 12 de 27 de agosto de 1982. Esta medida concede una bonificación especial no recurrente a los maestros en el servicio público y a los miembros del Cuerpo de la Policía, a partir del primero de enero de 1983 y terminando el 30 de septiembre de 1983, inclusive. Fue la intención legislativa que los beneficios de la ley fueran extensivos a todos los maestros, independientemente del departamento o agencia gubernamental en que trabajen. No obstante, por la forma en que está redactada, la ley ha sido interpretada como aplicando únicamente a los maestros del Departamento de Instrucción Pública.
La presente medida tiene el objetivo de aclarar el lenguaje de la Ley Núm. 12 de 27 de agosto de 1982, para que se cumpla el propósito legislativo y todos los maestros que se desempeñan como tales en el servicio público reciban los beneficios de esta ley independientemente del departamento o agencia gubernamental. donde se desempeñen.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el tercer y el cuarto párrafo de la exposición de motivos de la Ley Núm. 12 de 27 de agosto de 1982 para que lean como sigue: "EXPOSICION DE MOTIVOS
Uno de los propósitos de la presente Ley es otorgar una bonificación o compensación especial no recurrente a los maestros y demás personal docente del Departamento de Instrucción Pública, al personal docente cubierto por la Ley Núm. 18, del 19
de abril de 1955, al Cuerpo de la Policia y empleados públicos de las agencias de la Administración Central y de los Administradores Individuales excluyendo los empleados municipales. Esta bonificación o compensación especial tiene el propósito de ofrecer un alivio salarial a los empleados públicos, con antelación a la adopción de un plan retributivo integral a largo alcance. El otro objetivo fundamental de esta ley es el de mejorar la situación salarial de los empleados públicos mediante la adopción de un plan retributivo integral a largo alcance cuya etapa inicial comenzará el 1 ro. de octubre de 1983 con la concesión de determinados aumentos de sueldos.
Los parámetros que regirán cualquier incremento en sueldo que se otorgue a los empleados del Gobierno de Puerto Rico como parte del aludido plan integral, serán los siguientes:
a) Los aumentos a otorgarse constituirán la etapa inicial de un plan integral a largo alcance encaminado a mejorar la situación retributiva actual de los empleados públicos. Los aumentos de sueldo a concederse estarán científicamente correlacionados con las tendencias y prácticas retributivas que prevalecen en otros sectores de nuestra economía. Es decir, habrá una lógica retributiva. b) Se revisarán las estructuras retributivas del Cuerpo de la Policia, del Personal Docente del Departamento de Instrucción Pública, de los maestros que se desempeñan como tales en otras agencias gubernamentales y la de los empleados bajo la Oficina Central de Administración de Personal. c) Por tratarse de un plan científico e integral, las revisiones salariales estarán dirigidas a todos los empleados públicos de la Rama Ejecutiva, sin distinción de status ni categoría, excluyendo a aquellos empleados bajo sistemas autónomos que negocian convenios salariales." Sección 2.- Se enmienda el Artículo 2 de la Ley Núm. 12 de 27 de agosto de 1982, para que lea como sigue:
"ARTICULO 2.-BONO O COMPENSACION ESPECIAL NO RECURRENTE
Los maestros y demás personal docente del Departamento de Instrucción Pública, los maestros que se desempeñen como tales en otras agencias gubernamentales, los miembros del
Cuerpo de la Policía y todo funcionario o empleado de las agencias de la Administración Central y de los Administradores Individuales, que forman parte del Sistema de Administración de Personal creado por virtud de la Ley de Personal del Servicio Público, así como los que forman parte del sistema autónomo de la Rama Judicial, tendrán derecho a recibir el Bono o Compensación Especial no Recurrente, que por la presente se establece."
Sección 3.- Se enmienda el primer párrafo del Artículo 3 de la Ley Núm. 12 de 27 de agosto de 1982, para que lea como sigue: "ARTICULO 3.-CUANTIA DEL BONO O COMPENSACION ESPECIAL NO RECURRENTE
Los maestros y demás personal docente del Departamento de Instrucción Pública, los maestros que se desempeñan como tales en otras agencias gubernamentales, y los miembros del Cuerpo de la Policía, recibirán un Bono o Compensación Especial no Recurrente de $45, $45 y $35 mensuales respectivamente, a partir del primero de enero de 1983 y terminando el 30 de septiembre de 1983, inclusive."
Sección 4.- Se enmienda el primer párrafo del Artículo 4 de la Ley Núm. 12 de 27 de agosto de 1982, para que lea como sigue: "ARTICULO 4.-REVISIONES DE LAS ESTRUCTURAS RETRIBUTIVAS
El primero de octubre de 1983 se adoptará la primera etapa del plan integral a largo alcance encaminado a mejorar la situación económica de los empleados públicos. Esta fase del plan integral incluirá la adopción de nuevas escalas de retribución sobre una base porcentual y conllevará, además, incrementos en sueldos de alrededor de $45 mensuales a los maestros y demás personal docente del Departamento de Instrucción Pública y a los maestros que se desempeñan como tales en otras agencias gubernamentales, de alrededor de $35 mensuales a los 'miembros del Cuerpo de la Policía y de $30 mensuales a los demás empleados públicos dentro del Sistema de Personal creados en virtud de la Ley de Personal del Servicio Público, así como a los, que forman parte del sistema autónomo de la Rama Judicial." "Sección 5.-Esta Ley empezará a regir inmediatamente. La bonificación o compensación especial no recurrente a la que son acreedores los maestros y personal docente cubiertos por la Ley
Núm. 18, de 19 de abril de 1955 de conformidad con la Ley Núm. 12, de 27 de agriso de 1982 que no se haya efectuado al presente, se pagará no más tarde de 60 días después de la fecha de aprobación de esta ley.

STATEMENT OF MOTIVES
Act No. 12 of August 27, 1982 was approved with the purpose of offering a salary relief to the public employees, prior to the adoption of a far-reaching integral compensation plan. This measure grants a special nonrecurrent bonus to the teachers in the public service and to the members of the Police Corps, beginning January 1, 1983, and ending September 30, 1983, inclusively. It was the legislative intention that the benefits of the Act should apply to all the teachers, regardless of the department or government agency where they work. Nevertheless, in the way it is written, the Act has been interpreted as to apply only to the teachers of the Department of Education.
The aim of this measure is to clarify the language of Act No. 12 of August 27, 1982, to fulfill the legislative
intention so that all the teachers that act as such in the public service can receive the benefits of this Act,regardless of the department or government agency they work for. BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Paragraphs three and four of the Statement of Motives of Act No. 12 of August 27, 1982, are hereby amended to read as follows:
"STATEMENT OF MOTIVES
One of the aims of this Act is to grant a special nonrecurrent bonus or compensation to the teachers and other teaching staff of the Department of Education, to the teaching staff covered by Act No. 18 of April 19, 1955, to the Police Corps, and to the public employees of the Central Administration agencies and of the Individual Administrators, excluding municipal employees. This bonus or special compensation is intended to provide a salary relief to public employees, prior to the adoption of a far-reaching integral compensation plan. The other basic aim of this Act is to improve the salaries of public employees through the adoption of a far-reaching integral compensation plan, the first stage of which shall begin in October 1, 1983, with the granting of specific salary increases.
The parameters which shall govern any salary raises granted to the employees of the Government of Puerto Rico as part of said integral plan, shall be the following:
a) The raises to be granted shall constitute the first stage of a far-reaching integral plan aimed at improving the public employees' present salaries. The salary raises to be granted shall be scientifically correlated with the compensation trends and practices which prevail in other sectors of our economy. In other words, the compensation shall be logical. b) The salary structures of the Police Corps, the teaching staff of the Department of Education, the teachers that act as such in other government agencies, and the employees under the Central Personnel Administration Office, shall be revised. c) Since this is a scientific and integral plan, the salary revisions shall be aimed at all the public employees of the Executive Branch, regardless of status or category, excluding those employees under autonomous systems who negotiate their own salary agreements."
Section 2.- Section 2 of Act No. 12 of August 27, 1982, is hereby amended to read as follows: "SECTION 2.- SPECIAL NONRECURRENT BONUS OR COMPENSATION
The teachers and the rest of the teaching staff of the Department of Education, the teachers that act as such in other government agencies, the members of the Police Corps, and all the officials or employees of the Central Administration agencies and of the Individual Administrators, who are part of the Personnel Administration System, created by virtue of the Public Service Personnel Act, as well as those who are part of the autonomous system of the Judicial Branch, shall be entitled to receive the Special Nonrecurrent Bonus or Compensation established hereby."
Section 3.- The first paragraph of Section 3 of Act No. 12 of August 27, 1982, is hereby amended to read as follows: "SECTION 3.- AMOUNT OF THE SPECIAL NONRECURRENT BONUS OR COMPENSATION
The teachers and the rest of the teaching staff of the Department of Education, the teachers that act as such in other government agencies, and the members of the Police Corps, shall receive a special nonrecurrent bonus or compensation of $45, $ 45$ and $35 a
month, respectively, beginning January 1, 1983, and ending September 30, 1983, inclusive."
Section 4.- The first paragraph of Section 4 of Act No. 12 of August 27, 1982, is hereby amended to read as follows: "SECTION 4.- REVIEW OF THE COMPENSATION SCHEDULES The first stage of the far-reaching integral plan addressed to improving the financial condition of the public employees, shall be adopted on October 1, 1983. This phase of the integral plan shall include the adoption of new salary schedules on a percentage basis, and shall also entail salary raises of about $45 a month to teachers and the rest of the teaching staff of the Department of Education, and to the teachers who act as such in other government agencies; of about $35 a month to the members of the Police Corps, and of $30 a month to the rest of the public employees within the Personnel System created by virtue of the Public Service Personnel Act, as well as to those who are part of the autonomous system of the Judicial Branch."
Section 5.- This Act shall take effect immediately. The special nonrecurrent bonus or compensation to which teachers and teaching staff covered by Act No. 18 of April 19, 1955, pursuant to Act No. 12 of August 27, 1982, are entitled to, that has not been paid as of this moment, will be paid no later than 60 days after the date of approval of this Act.
