Ley 55 del 1983
Resumen
Esta ley adiciona el Artículo 107-A al Código Penal de Puerto Rico (Ley Núm. 115 de 1974) para definir y prohibir la prostitución. Establece que toda persona que sostenga, acepte, ofrezca o solicite relaciones sexuales por dinero o cualquier forma de pago será sancionada con penas de reclusión y/o multa. La ley especifica que el sexo de las partes no será considerado una defensa y busca desalentar esta actividad en Puerto Rico, considerando su impacto en la salud pública y las estructuras familiares.

LEY
Para adicionar el Artículo 107-A a la Ley Núm. 115 del 22 de julíode 1974, según enmendada, conocida como Código Penal de Puerto Rico, a los fines de definir y prohibir la prostitución en Puerto Rico.
EXPOSICION DE MOTIVOS
La legislación vigente en Puerto Rico no prohibe ni define la prostitución.
Hay estados de los Estados Unidos y otros países que han aprobado legislación legalizando o reglamentando la prostitución. En otros hay legislación que la prohibe y condena y se persigue al violador de sus preceptos. En algunas otras jurisuiicciones la legislación que prohibe la prostitución, aunque vigente, no es implantada adecuadamente y con todo vigor.
En Puerto Rico hay legislación de carácter penal que prohibe las casas de prostitución o sodomía (Artículo 108); las casas escandalosas (Artículo 109); el proxenetismo, rufianismo, casas escandalosas y el comercio de personas (Artículo 110). Es sin embargo, mediante la aplicación de ordenanzas municipales que se persigue la prostitución.
Además, hay legislación de carácter no penal relacionada con la prostitución. El Artículo 7 de la Ley Núm. 94 del 11 de mayo de 1944 (24 L.P.R.A. 557), dispone que toda persona prostituta se considerará que padece de enfermedades venéreas y de ser convicta, deberá ser examinada antes de expirar su sentencia, por oficiales del Departamento de Salud.
El Código Civil de Puerto Rico dispone en su Artículo 96 que es causal de divorcio el "conato del marido o de la mujer para corromper a sus hijos o prostituir a sus hijas, y la convivencia en su corrupción o prostitución".
El Artículo 685 del Código Civil dispone que serán incapaces de suceder por causa de indignidad "los padres que abandonaren a sus hijos y prostituyeren a sus hijas o atentaren a su pudor".
Procede entonces, que esta Asamblea Legislativa adicione un artículo al Código Penal vigente, tipificando el delito de prostitución, a los fines de definir el mismo, atemperarlo con otras dispo-
siciones legales vigentes en Pú́erto Rico, relativas a la prostitución, e imponer penas que desalienten el ejercicio de dicha actividad dentro de la jurisdicción del Estado Libre Asociado de Puerto Rico, sin que haya relevancia en cuanto al sexo de las partes envueltas.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se adiciona el Artículo 107-A a la Ley Núm. 115 de 22 de julio de 1974, según enmendada, para que lea como sigue: "Artículo 107-A-Prostitución
(a) Toda persona que sostuviere, aceptare, ofreciere o solicitare sostener relaciones sexuales con otra persona por dinero o estipendio, remuneración o cualquier forma de pago, será sancionada con pena de reclusión por un término no menor de treinta (30) días ni mayor de seis (6) meses o multa no menor de trescientos (300) dólares ni mayor de quinientos (500) dólares o ambas penas a discreción del Tribunal en primera convicción, y en subsiguientes convicciones con penas de multa de quinientos (500) dólares y reclusión por un término no menor de sesenta (60) días ni mayor de seis (6) meses.
(b) A los efectos de este artículo no se considerará como defensa, el sexo de las partes que sostuvieren, aceptaren, ofrecieren o solicitaren sostener relaciones sexuales." Sección 2.- Esta Ley comenzará a regir inmediatamente después de su aprobación.

To add Article 107-A to Act No. 115 of July 22, 1974 as amended, known as the Penal Code of Puerto Rico, in order to define and prohibit prostitution in Puerto Rico.
STATEMENT OF MOTIVES
The legislation in force in Puerto Rico does not prohibit nor does it define prostitution.
Other countries, and some states in the United States have passed legislation legalizing or regulating prostitution. In others, there is legislation that prohibits and condemns it, and the violator of its precepts is prosecuted. In some other jurisdictions, the legislation that prohibits prostitution, although it is in effect, is not implemented adequately and with full force.
In Puerto Rico there is legislation of a penal nature that prohibits houses of prostitution or sodomy (Article 108); disorderly houses (Article 109); pimping, rufianism, disorderly houses, and commerce of persons (Article 110). However,
prostitution is prosecuted through the enforcement of municipal ordinances.
Also, there is legislation of a non-penal nature related to prostitution. Section 7 of Act No. 94 of May 11, 1944 (24 L.P.R.A. 557), provides that all prostitutes will be deemed to suffer from venereal diseases, and upon conviction, must submit to an examination by officials of the Department of Health before completing their sentence.
The Civil Code of Puerto Rico provides in Article 96, that "the intent of the husband or the wife to corrupt their sons or to prostitute their daughters, and their connivance in their corruption or prostitution", will be grounds for divorce.
Article 685 of the Civil Code provides that "parents who have abandoned their children or prostituted their daughters, or make attempts against their chastity", shall be disqualified to succeed on grounds of indignity.
It is proper, then, for this Legislature to add an article to the Penal Code presently in force, qualifying the crime of prostitution so as to define it, adjust it to other legal provisions presently in force in Puerto Rico with relation to prostitution, and impose penalties that will serve as a deterrent to the exercise of said activity within the jurisdiction of the Commonwealth of Puerto Rico, without any relevance as to the sex of the parties involved.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Article 107-A is added to Act No. 115 of July 22, 1974 as amended, to read as follows: "Article 107-A- Prostitution
(a) Any person that engages in, accepts, offers, or solicits to engage in sexual relations with another person for money or a fee, remuneration or any form of payment, shall be sanctioned by imprisonment for a term of not less than thirty (30) days, nor greater than six (6) months, or a fine of not less than three hundred (300) dollars, nor greater than five hundred (500) dollars, or both penalties at the discretion of the Court for the first conviction, and for subsequent convictions, by fines of five hundred (500) dollars and imprisonment for a term of not less than (60) days, nor greater than six (6) months.
(b) For the purposes of this Section, the sex of the parties that engaged, accepted, offered or solicited to engage in sexual relations will not be considered as a defense.
Section 2.- This Act shall take effect immediately after its approval.
