LEY Para enmendar los Artículos 1 y 2 de la Ley 34 de 13 de junio de 1966 . enmendada, mediante la implantación de nuevas escalas retributivas sobre una base porcentual para los maestros y demás personal docente del Departamento de Instrucción Pública. y hacer extensiva las mismas al personal docente de las escuelas institucionales de los departamentos y dependencias del Estado Libre Asociado de Puerto Rico y para conferir al Secretario

(a) de Instrucción Pública todos los poderes y facultades que resulten necesarios para poner en rigor las disposiciones relativas a las nuevas escalas retributivas que se establecen para el Programa de las Escuelas Libre de Música y el Programa de Instrucción Vocacional. Técnica y de Alta Destreza.

EXPOSICION DE MOTIVOS

La retribución para los maestros y demás personal docente del Departamento de Instrucción Pública y el cubierto por la Ley 18de 19 de abril de 1955, se rige por las escalas de sueldos establecidas en la Ley 34 de 13 de junio de 1966, enmendada. Las escalas vigentes entraron en vigor el primero de julio de 1980.

El estudio que dio lugar al Plan Integral para Mejorar la Situación Retributiva de los Empleados Públicos, incluyó un análisis crítico de la estructura de salarios vigente para el personal docente. Dicho estudio reflejó una situación similar a laencontrada para otros grupos de empleados del Servicio Público que forman parte del vigente Sistema de Personal: El sueldo base de la estructura salarial actual para el personal docente, y por ende, la totalidad de la mencionada estructura no es adecuada al presente.

El objetivo primordial de esta ley es mejorar la condición económica de un cuerpo de abnegados servidores públicos, hacerles justicia y atraer y retener en el servicio a estos servidores de alta prioridad, para el desarrollo eficaz de nuestro sistema de instrucción.

Para lograr dichos propósitos, es necesario adoptar nuevas estructuras retributivas para el personal docente del Programa Regular de Instrucción, del Programa de Instrucción Vocacional, Técnica y de Alta Destreza, del Programa de las Escuelas Libre de Música y el personal docente cubierto por la citada Ley'18.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Sección 1.- Se enmienda el Artículo 1 de la Ley 34 de junio de 1966, enmendada, para que lea como sigue: "Artículo 1.- a) Se adoptan las siguientes escalas retributivas sobre una base porcentual para los maestros y demás personal docente de Instrucción Pública, que regirán durante el año fiscal 1983-84 según se especifica a continuación:

b) Las reglas de interpretación y de administración de las estructuras salariales son las siguientes:

Los sueldos individuales de los maestros y demás personal docente deberán coincidir con alguno de los tipos establecidos en la escala correspondiente que forme parte de la nueva estructura.
Siempre que una acción de personal tenga el efecto de alterar el sueldo de algún maestro y demás personal docente, el mismo se ajustará conforme a la naturaleza de la misma.
Si como efecto de la implantación de la nueva estructura salarial adoptada, el sueldo de algún maestro y demás personal docente no coincidiese con alguno de los tipos retributivos de la escala correspondiente, el mismo habrá de ajustarse al próximo tipo superior de la escala, independientemente del tipo que sea.
Si el sueldo del maestro y demás personal docente estuviese en el máximo de la escala o sobrepasare el mismo, el ajuste se hará en factor del correspondiente incremento porcentual que conlleva la escala.
Al adoptarse la nueva estructura salarial, los sueldos de los maestros y demás personal docente se ajustarán de la siguiente forma: El que esté bajo el mínimo irá al nuevo tipo mínimo. El salario de aquellos maestros y demás personal docente que devenguen sueldos superiores al tipo mínimo de la escala por motivo de haber recibido aumentos de sueldo durante la vigencia de la anterior estructura, se ajustará de modo que se reconozcan todos los aumentos de sueldo recibidos durante la vigencia de la estructura salarial suplantada."

Sección 2.- Se enmienda el Artículo 2 de la Ley 34 del 13 de junio de 1966, enmendada, para que lea como sigue: "(Artículo 2.-Los maestros con preparación de bachillerato, maestría o doctorado y que posean un certificado provisional recibirán el mismo sueldo de ingreso que se estipula para los maestros de igual preparación con certificados permanentes. Sin embargo, por años de servicio, dichos maestros provisionales solo podrán recibir aumentos correspondientes a los primeros dos tipos intermedios de sueldo dentro de la categoría por preparación a la cual pertenezcan.)"

Sección 3.- Facultades y Poderes Necesarios Se confiere al Secretario del Departamento de Instrucción Pública, todos los poderes y facultades que resulten necesarios e indispensables para poner en vigor las disposiciones relativas a las nuevas escalas retributivas que por la presente se establecen.

Sección 4.- Asignación de Fondos Los fondos necesarios para implantar las estructuras retributivas que entrarán en rigor el primero de abril de 1984, se consignarán en el Presupuesto Ejecutivo del Departamento de Instrucción Pública y de aquellas agencias y dependencias del gobierno que tengan personal docente en escuelas institucionales.

Sección 5.- Derogación Por la presente se deroga toda ley o parte de ley que resulte incompatible con la presente.

Sección 6.- Vigencia Esta Ley entrará en vigor el primero de abril de 1984.

To amend Sections 1 and 2 of Act No. 34 of June 13, 1966, amended, through the implementation of new salary schedules for teachers and other teaching staff of the Department of Education, on a percentage basis, and extend them to the teaching staff of the institutional schools of the departments and agencies of the Commonwealth of Puerto Rico, and to confer unpon the Secretary of Education all the powers and faculties that might be necessary to enforce the provisions related to the new salary schedules established for the Free Schools of Music Program and the Vocational, Technical and Advanced Skills Educational Program.

STATEMENT OF MOTIVES

The compensation for teachers and other teaching staff of the Department of Education, and those covered by Act No. 18 of April 19, 1955, is governed by the salary schedules established in Act No. 34 of June 13, 1966, amended. The present schedules became effective on July 1, 1980.

The research that preceded the Integral Plan to Improve the Compensation Situation of Public Employees, included a critical analysis of the present salary structure for the teaching staff. This study reflected a situation that was similar to what was found for other groups of Public Service employees that are part of the Personnel System in force. The basic salary of the present salary structure for the teaching staff, and therefore, for the whole structure mentioned above, is not adequate at present.

The primary objective of this Act is to improve the economic condition of a corps of dedicated public servants, to do them justice, and attract and retain these high-priority public employees, for the effective development of our educational system.

To achieve these purposes it is necessary to adopt new compensation structures for the teaching staff of the Regular Education Program, the Vocational, Technical and Advanced Skills Educational Program, the Free Schools of Music Program, and the teaching staff covered by said Act No. 18. BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- Section 1 of Act No. 34 of June 1966, amended, is hereby amended to read as follows:

"Section 1.-

b) The rules for the interpretation and administration of the salary structures are the following:

The individual salaries of teachers and other teaching personnel must coincide with one of the rates established in the corresponding schedule that is part of the new structure.
Whenever a personnel action alters the salary of any teacher and other teaching staff, the same will be adjusted in accordance with the nature thereof.
If the salary of any teacher and other teaching staff does not coincide with one of the compensation rates of the corresponding schedule, as a result of the implementation of the new salary structure adopted, the same shall be adjusted to the next highest rate, regardless of what the rate is.
If the salary of the teacher and other teaching staff is at the maximum rate of the schedule or over it, the adjustment will be made as a factor of the corresponding percentile increment that is part of the schedule.
Upon adoption of the new salary structure, the salary of the teachers and other teaching staff shall be adjusted in the following manner: That which is below the minimum shall be brought to the minimum.

The salary of those teachers and other teaching staff who earn salaries above the minimum rate of the schedule because they received salary increases during the effectiveness of the previous structure, shall be adjusted in such a manner that all the salary increases received during the effectiveness of the salary structure replaced hereby, are recognized."

Section 2.- Section 2 of Act 34 of June 13, 1966, amended, is hereby amended to read as follows: "(Section 2.- Teachers with a bachelors, masters or doctors degree and holding a provisional certificate, shall receive the same initial salary that is stipulated for teachers with the same degree, holding permanent certificates. However, said provisional teachers may only receive raises for years of service, corresponding to the first two intermediate salary rates within the educational category to which they belong.)"

Section 3.- Faculties and Necessary Powers The Secretary of the Department of Education is hereby conferred all the powers and faculties that may be necessary and indispensable to implement the provisions with regard to the new compensation schedules hereby established.

Section 4.- Appropriation of Funds The necessary funds to implement the compensation structures that shall be in effect on April 1, 1984, shall be consigned

in the Executive Budget of the Department of Education and of those government departments and agencies that have teaching personnel in their institutional schools.

Section 5.- Repealing Clause Any Act or part thereof that is incompatible with this Act is hereby repealed.

Section 6.- Effectiveness This Act shall take effect on April 1, 1984.
