Ley 13 del 1983
Resumen
Esta ley enmienda la Ley de la Judicatura del Estado Libre Asociado de Puerto Rico y la Ley 7 de 1974 para establecer un aumento en los sueldos anuales de todas las categorías de jueces, incluyendo los del Tribunal Supremo, Tribunal Superior, Tribunal de Distrito, Jueces de Paz y Jueces Municipales. El aumento entró en vigor el 1 de octubre de 1983, con el objetivo de fortalecer el sistema de justicia criminal y mejorar la retención de personal judicial.

LEY
Para enmendar los incisos
(a) ,
(b) y
(c) de la Sección 23 de la Ley 11 de 24 de julio de 1952, enmendada, titulada "Ley de la Judicatura del Estado Libre Asociado de Puerto Rico"; para enmendar el Artículo 4 de la Ley 7 de 8 de agosto de 1974, enmendada, que establece el sueldo anual de los Jueces; a fin de disponer un aumento en los mismos durante el año fiscal 1983-84; y para disponer sobre los fondos para llevar a cabo los propósitos de esta Ley.
EXPOSICION DE MOTIVOS
Entre las prioridades programáticas de nuestro gobierno está la de ofrecer una mayor seguridad y protección a la ciudadanía. Para lograr este objetivo se hace necesario fortalecer nuestro sistema de justicia criminal, compuesto por los honorables miembros de la judicatura, fiscales y otros oficiales de gobierno.
En estos honrosos servidores públicos recae la responsabilidad de poner en ejecución nuestro sistema judicial, base fundamental para lograr la seguridad y estabilidad de nuestro país.
La responsabilidad que conlleva el descargo de estas funciones no está a la par con la compensación que reciben dichos profesionales. Por otro lado, otros sectores y jurisdicciones ofrecen sueldos y beneficios marginales superiores a los que ofrece nuestro servicio público. Esta condición representa un atractivo campo de empleo para nuestros profesionales y en consecuencia crea un problema de reclutamiento y retención de este personal en el sector gubernamental.
Por tanto, el esfuerzo, dedicación y sacrificio económico y personal de estos servidores públicos, requieren seria consideración para mejorar sus sueldos.
Esta ley tiene como propósito establecer aumentos de sueldos para todas las categorías de jueces. El primero de éstos habrá de concederse a partir del primero de octubre de 1983.
Decrétase por la Asamblee-Legislativa de Puerto Rico:
Artículo 1.- Se enmiendan los Incisos
(a) ,
(b) y
(c) de la Sección 23 de la Ley Núm. 11 de 24 de julio de 1952, enmendada, para que lea como sigue:
"Sección 23.-Sueldos
(a) El sueldo anual de Juez Presiderie del Tribunal Supremo será de $44,600 a partir del primero de octubre de 1983.
El sueldo anual de cada uno de los Jueces Asociados del Tribunal Supremo será de $44,000 a partir del primero de octubre de 1983.
(b) El sueldo anual de cada uno de los Jueces del Tribunal Superior será de $38,000 a partir del primero de octubre de 1983.
El sueldo anual de cada uno de los Jueces del Tribunal de Distrito será de $32,000 a partir del primero de octubre de 1983.
(c) El sueldo anual de cada uno de los Jueces de Paz será de $8,400 a partir del primero de octubre de 1983." Artículo 2.- Se enmienda el Artículo 4 de la Ley 7 de 8 de agosto de 1974, enmendada, para que lea como sigue: "Artículo 4.- A partir del primero de octubre de 1983 los Jueces Municipales devengarán un sueldo anual de $23,000 cada uno." Artículo 3.- Asignación de Fondos Los fondos necesarios para llevar a cabo los propósitos de esta Ley se asignarán anualmente en la Resolución Conjunta del Presupuesto.
Artículo 4.- Derogación Se deroga toda ley o parte de ley que resulte incompatible con la presente.
Artículo 5.- Vigencia Esta Ley entrará en vigor el primero de octubre de 1983.

AN ACT
To amend subsections
(a) ,
(b) and
(c) of Section 23 of Act No. 11 of July 24, 1952, amended, entitled the "Judiciary Act of the Commonwealth of Puerto Rico"; to amend Section 4 of Act 7 of August 8, 1974, amended, which establishes the annual salary of the Judges; for the purpose of providing a raise in the same during the 1983-84 fiscal year; and to provide for the funds to carry out the purposes of this Act.
STATEMENT OF MOTIVES
Among the programmatic priorities of our government is that of offering the maximum security and protection to the citizenry. To achieve this objective it is necessary to strengthen our criminal justice system which is composed of the honorable members of the judiciary, the district attorneys and other government officials.
These honorable public servants have the responsibility of enforcing our judicial system, which is the fundamental basis to achieve the security and stability of our country.
The responsibility involved in the discharge of these functions is not at a par with the remuneration received by these professionals. On the other hand, other sectors and jurisdictions offer salaries and fringe benefits which are superior to those offered by our public service. This condition represents an attraction in the field of employment for our professionals and as a result it creates a problem in the recruiting and retention of this personnel in the government sector.
Therefore, the efforts, dedication, and the economic and personal sacrifice of these public servants merit serious consideration, in raising their salaries.
This Act has as its purpose, to establish raises in salaries for all the categories of judges. The first of these shall be granted from the first day of October of 1983.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Subsections
(a) ,
(b) and
(c) of Section 23 of Act No. 11 of July 24, 1952, amended, is hereby amended to read as follows:
"Section 23.- Salaries
(a) The annual salary of the Chief Justice of the Supreme Court shall be of $44,600 counting from the first day of October of 1983.
The annual salary of each one of the Associate Justices of the Supreme Court shall be of $44,000, counting from the first day of October of 1983.
(b) The annual salary of each one of the Judges of the Superior Court shall be of $38,000, counting from the first day of October of 1983.
The annual salary of each one of the Judges of the District Court shall be of $32,000, counting from the first day of October of 1983.
(c) The annual salary of each one of the Justices of the Peace shall be of $8,400, counting from the first day of October of 1983."
Section 2.- Section 4 of Act No. 7 of August 8, 1974, amended, is hereby amended to read as follows:
"Section 4.-
Counting from the first day of October of 1983, the Municipal Judges shall receive an annual salary of $23,000 each."
Section 3.- Appropriation of Funds
The funds needed to carry out the purposes of this Act shall be appropriated annually in the Budget Joint Resolution.
Section 4.- Repealing Clause
Any Act or part of an Act that is in conflict with this Act is hereby repealed.
Section 5.- Effectiveness This Act shall take effect on the first day of October of 1983.
