Ley 33 del 1982
Resumen
Esta ley enmienda la Ley Núm. 58 de 1979 para autorizar al Departamento de la Vivienda y al Banco y Agencia de Financiamiento de la Vivienda a extender subsidios de interés hipotecario a familias que adquieran viviendas previamente recuperadas por estas agencias. También permite al Departamento de la Vivienda conceder subsidios y garantizar hipotecas para proyectos de vivienda cuando la financiación federal no esté disponible. Adicionalmente, tipifica como delito menos grave la discriminación por parte de funcionarios gubernamentales en la administración de estos beneficios.

LEY
Para enmendar el Título y el Artículo 1, adicionar el Artículo 3A y un nuevo Artículo 4 y redesignar los Artículos 4 y 5 como Artículos 5 y 6 de la Ley 58 de 1ro. de junio de 1979, para autorizar al Secretario de la Vivienda a hacer extensivo el subsidio de interés de hipotecas a las familias que adquieran por compra-venta una vivienda que haya sido adquirida de sus anteriores propietarios por el Departamento de la Vivienda o por el Banco y Agencia de Financiamiento de la Vivienda, y para otros fines.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el título a la Ley 58 de 1ro. de junio de 1979 para que lea como sigue: "Para autorizar al Departamento de la Vivienda a conceder subsidios sobre intereses y garantizar hipotecas, sobre viviendas en proyectos que a la vigencia de esta ley hayan sido aprobadas por la Administración de Hogares de Agricultores de los Estados Unidos (Farmers Home Administration) y el Departamento de la Vivienda, cuando la referida agencia federal no pueda financiar las hipotecas y subsidiar parcialmente los intereses bajo las disposiciones de la Sección 502 de la Ley Federal de la Vivienda; y para autorizarlo, a través del Banco y Agencia de Financiamiento de la Vivienda a incurrir en obligaciones hasta la cantidad adicional de dos millones trescientos mil (2,300,000) dólares para esos mismos fines; y para asignar fondos para llevar a cabo los propósitos de esta ley."
Sección 2.- Se enmienda el Artículo 1 a la Ley 58 de 1ro. de junio de 1979 para que lea como sigue: "Artículo 1.-Se autoriza al Departamento de la Vivienda a conceder subsidios sobre intereses y garantizar hipotecas a treinta (30) años, sobre viviendas en proyectos que a la vigencia de esta ley hayan sido aprobadas por la Administración de Hogares de Agricultores de Estados Unidos (Farmers Home Administration, FMHA) y por el Departamento de la Vivienda, hasta un máximo de 3,000 unidades, cuando la referida Agencia Federal no pueda financiar las hipotecas y subsidiar parcialmente los intereses de los préstamos hipotecarios bajo las disposiciones de la Sección 502 de la Ley Federal de la Vivienda.
El Secretario de la Vivienda ádoptará las guías correspondientes para impartir su aprobación a las unidades o proyectos de vivienda a los cuales se les concederá compromisos condicionales (conditional commitments) para que los promotores y constructores, utilizando como respaldo el subsidio estatal que autoriza esta ley y la garantía hipotecaria autorizada por la Ley Núm. 87 de 25 de junio de 1965, según enmendada, puedan gestionar financiamiento permanente en la banca o en instituciones financieras." Sección 3.- Se adiciona el Artículo 3A a la Ley 58 de 1ro. de junio de 1979 para que lea como sigue:
Artículo 3 A-El Secretario de la Vivienda tendrá facultad para hacer extensivo el subsidio de interés de hipoteca a las familias que adquieran por compraventa una vivienda que haya sido adquirida de sus anteriores propietarios por el Departamento de la Vivienda o por el Banco y Agencia de Financiamiento de la Vivienda a consecuencia del incumplimiento al contrato de hipoteca o cuando estos mediante dación en pago hagan entrega de sus casas ante la imposibilidad de cumplir con las obligaciones contraídas u otras razones. Las familias a quienes se les vendan estas viviendas deberán ser elegibles a los beneficios de esta ley." Sección 4.- Se adiciona un nuevo Artículo 4 a la Ley 58 de 1ro. de junio de 1979 para que lea como sigue: "Artículo 4.-Cualquier empleado, agente o funcionario del Gobierno del Estado Libre Asociado, sus agencias, municipios o instrumentalidades que, en la estructuración de las disposiciones de esta ley, o en la administración y concesión de sus beneficios, discrimine contra cualquier individuo, grupo o colectividad por motivo de raza, color, sexo, nacimiento, origen, o por sus ideas políticas o religiosas, incurrirá en delito menos grave.
La comisión de cualquiera de las actuaciones indicadas en el párrafo anterior será causa suficiente para la destitución del empleado, agente o funcionario infractor. El procedimiento de destitución se seguirá de acuerdo a las leyes y reglamentos aplicables a tal empleado, agente o funcionario y será independiente del proceso criminal." Sección 5.- Se redesignan los artículos 4 y 5 de la Ley 58 de 1ro. de junio de 1979 como sus artículos 5 y 6 , respectivamente.
Sección 6.- Esta ley entrará en vigor inmediatamente después de su aprobación.

AN ACT
To amend the Title and Section 1, add Section 3A and a new Section 4 and redesignate Sections 4 and 5 as Sections 5 and 6 of Act No. 58 of June 1, 1979, to authorize the Secretary of Housing to extend the mortgage interest subsidy to the families who acquire a dwelling by a contract of sale, which had been acquired from the previous owners by the Department of Housing or by the Housing Bank and Finance Agency, and for other purposes.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- The title of Act No. 58 of June 1, 1979, is hereby amended to read as follows: "To authorize the Department of Housing to grant subsidies on interest and guarantee mortgages on dwellings in projects which on the effective date of this Act have been approved by the Farmers Home Administration and the Department of Housing, when said federal agency cannot finance the mortgages, and partiallysubsidize the interest under the provisions of Section 502 of the Federal Housing Act; and to authorize it,
through the Housing Bank and Finance Agency, to incur obligations up to the additional sum of two million, three hundred thousand (2,300,000) dollars for these same purposes; and to appropriate funds to carry out the purposes of this Act."
Section 2.- Section 1 of Act No. 58 of June 1, 1979, is hereby amended to read as follows: "Section 1.- The Department of Housing is hereby authorized to grant subsidies on interest and guarantee thirty-(30) year mortgages on those dwellings in projects which on the effective date of this Act have been approved by the United States Farmers Home Administration (FMHA), and by the Department of Housing, up to a maximum of 3,000 units, when said Federal Agency cannot finance the mortgages and partiallysubsidize the interest on the mortgage loans under the provisions of Section 502 of the Federal Housing Act.
The Secretary of Housing shall adopt the corresponding guidelines to give his approval to the housing units or projects to which conditional commitments shall be granted, so that the promoters and builders using the state subsidy authorized by this Act and the mortgage guarantee authorized by Act No. 87 of June 25, 1965 as amended, as backing, may negotiate permanent financing in the banking or financial institutions."
Section 3.- Section 3A is hereby added to Act No. 58 of June 1, 1979, to read as follows: "Section 3A.- The Secretary of Housing shall have the faculty to extend the mortgage-interest subsidy to the families who acquire a dwelling by a contract of sale which has been acquired from the previous owner by the Department of Housing or the Housing Bank and Finance Agency due to default of the mortgage contract, or when by payment in kind, surrender their homes because it is impossible to fulfill their contracted obligations, or for other reasons. The families to whom these dwellings are sold must be eligible for the benefits of this Act." Section 4.- A new Section 4 is hereby added to Act No. 58 of June 1, 1979, to read as follows: "Section 4.- Any employee, agent or official of the Government of the Commonwealth, its agencies, municipalities or instrumentalities who, in the implementation of the provisions of this Act, or in the administration and granting of its benefits, discriminates against any person, group or community because of race, color, sex, birth, origin or for their political or religious beliefs shall incur a misdemeanor.
The commission of any of the actions indicated in the previous paragraph shall be sufficient cause for the dismissal of the guilty employee, agent or official from office. The dismissal procedure shall be followed according to the laws and regulations applicable to such employee, agent or official, and it shall be done regardless of the criminal procedure." Section 5.- Sections 4 and 5 of Act No. 58 of June 1, 1979 are hereby redesignated as Sections 5 and 6, respectively.
Section 6.- This Act shall take effect immediately after its approval.
