L E Y Para establecer el número de Registradores para el Registro de la Propiedad; fijar la remuneración del Director Administrativo y de los Registradores de la Propiedad, disponer sobre los fondos para llevar a cabo los propósitos de esta ley; y para derogar la sección 19 de la Ley Núm. 3 de 1955, según enmendada.

EXPOSICION DE MOTIVOS

Al aprobarse la Ley Núm. 198 de 8 de agosto de 1979, conocida como Ley Hipotecaria y del Registro de la Propiedad, se derogó la Ley Núm. 3, de 2 de septiembre de 1955, con excepción de la sección 19 referente a los sueldos de los Registradores. La Ley Núm. 3 establecía el número de Registradores, y por lo tanto se hace necesario legislar al respecto. Es necesario además, derogar la sección 19 de dicha ley, e incluirla en la presente ley para que conste en un sólo cuerpo legal todo lo referente a los Registradores de la Propiedad y la remuneración que recibirán por el desempeño de sus funciones.

Durante el año fiscal 1978-79 se radicaron 206,169 documentos en las diferentes Secciones del Registro, lo que representa un aumento de 7,869 sobre el año anterior. El total de documentos despachados durante el mismo año ascendió a 222,415 , o sea, un aumento de 40,088 sobre el despacho del año anterior. Para obtener estos logros es evidente el gran esfuerzo y la actitud de cooperación de nuestros Registradores y empleados. Para mantener este ritmo de despacho de documentos es importante ofrecer un incentivo, más aún ahora que se ha de comenzar con los primeros pasos en la mecanización del Registro, que conlleva una labor más intensa. La propuesta de la presente ley es necesaria para el logro de los anteriores propósitos.

Decrátase por la Asamblea Legislativa de Puerto Rico:

Artículo 1.- El Registro de la Propiedad contará con veintiocho Registradores y el Secretario de Justicia, a solicitud del Director Administrativo, acompañada de una certificación acreditativa de que las necesidades del Registro de la Propiedad exigen el nombramiento de Registradores adicionales, podrá aumentar el número de éstos, pero sin exceder de treinta y dos, salvo el caso

contemplado en que un Registrador fuere nombrado Director Administrativo, cuando podrá aumentarse el número a treinta y tres.

Artículo 2.- Se establecen las siguientes retribuciones anuales para el Director Administrativo del Registro de la Propiedad, y los Registradores de la Propiedad.

Cargo Sueldo Director Administrativo del Registro de la Propiedad $25,000.00 Registrador de la Propiedad 24,000.00

Artículo 3.- Los fondos necesarios para llevar a cabo los propósitos de esta ley se consignarán anualmente en la Resolución Conjunta del Presupuesto General.

Artículo 4.- Se deroga la sección 19 de la Ley Núm. 3 de 2 de septiembre de 1955, según enmendada, y que fuera dejada en vigencia por la Ley 198 de 8 de agosto de 1979.

Artículo 5.- Esta ley entrará en vigor inmediatamente después de su aprobación.

To establish the number of Registrars for the Property Registry; to fix the remuneration for the Administrative Director and the Property Registrars, to provide the funds to carry out the purposes of this Act, and to repeal Section 19 of Act No. 3 of 1955 as amended.

STATEMENT OF MOTIVES

When Act No. 198 of August 8, 1979, known as the Mortgage and Property Registry Act was approved, Act No. 3 of September 2, 1955, was repealed, with the exception of Section 19 which provides for the Registrars' salaries. Act No. 3 established the number of Registrars, therefore, legislation is needed to that effect. It is also necessary to repeal Section 19 of said Act and to include it in the present Act so that everything related to Property Registrars and the salaries they shall receive for their work shall be embodied in a single legal document.

During fiscal year 1978-79, 206,169 documents were filed in the different Registry Sections, which is an increase of 7,869 over the preceding year. During that same year, the total number of documents issued amounted to 222,415 , which is

an increase of 40,088 over those issued in the preceding year. To accomplish this, the great effort and cooperation of our Registrars and employees was evident. In order to continue issuing documents at this rate it is important to offer an incentive, especially now that the first steps are to be taken to mechanize the Registry, all of which entails more intensive work. Therefore, this Act is needed to achieve the aforementioned purposes.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- The Property Registry shall have twenty-eight (28) Registrars, and the Secretary of Justice, at the request of the Administrative Director, together with a certificate attesting that the needs of the Property Registry require the appointment of additional Registrars, may increase their number up to a maximum of thirty-two (32), except in case a Registrar is appointed Administrative Director, when their number may be increased to thirty-three (33).

Section 2.- The following annual salaries are hereby established for the Administrative Director of the Property Registry, and the Property Registrars:

Section 3.- The funds needed to carry out the purposes of this Act shall be appropriated, annually, in the Regular Budget Joint Resolution.

Section 4.- Section 19 of Act No. 3 of September 2, 1955 as amended, which was left in force by Act No. 198 of August 8,1979 , is hereby repealed.

Section 5.- This Act shall take effect immediately after its approval.
