Ley 74 del 1980
Resumen
Esta ley enmienda la Ley Núm. 81 de 1971, que creó la Corporación del Nuevo Centro de San Juan. Su objetivo es facilitar la adquisición y venta de terrenos por parte de dicha Corporación a empresas privadas, especialmente para el desarrollo de proyectos de vivienda de interés social y otros usos. La enmienda permite a la Junta de Gobierno de la Administración de Terrenos de Puerto Rico eximir proyectos de la obligación de retener la nuda propiedad, eliminando un obstáculo para su financiamiento y desarrollo.

LEY Para enmendar el inciso
(d) del Artículo 13, de la Ley Núm. 81 de 23 de junio de 1971, conocida como "Ley de la Corporación del Nuevo Centro de San Juan"; para facilitar la adquisición y la venta de terrenos a empresas privadas por parte de la Corporación del Nuevo Centro de San Juan, para desarrollar proyectos de vivienda de interés social y para usos diversos.
EXPOSICION DE MOTIVOS
El inciso
(d) del Artículo 13 de la Ley Núm. 81 de 23 de junio de 1971, que crea la Corporación del Nuevo Centro de San Juan, dispone lo siguiente: "En todo caso en que se trate de bienes adquiridos por la Corporación, mediante traspaso héchole por el Estado Libre Asociado, o por cualquiera de sus agencias, en virtud de la facultad concedida en este Artículo y conforme a las demás condiciones y requisitos establecidos en esta ley, la Corporación deberá, retener, cuando menos, la nuda propiedad de los mismos, en cualquier enajenación que realice de tales bienes en favor de cualquier persona que no sea una agencia del Estado Libre Asociado de Puerto Rico, para propósitos de estructurar los fines públicos que informa esta ley."
Este inciso ha resultado no solamente motivo de preocupación sino también un obstáculo al desarrollo del proyecto del Nuevo Centro de San Juan, ya que una vez la Corporación adquiere los terrenos este inciso limita la disposición de los mismos al retener la nuda propiedad. Esto dificulta el financiamiento de las obras a realizarse. Entre las obras a realizarse se hallan los proyectos de vivienda para la venta, proyectos de interés social tanto cultural como institucional. A fin de eliminar cualquier obstáculo que impida un cabal desarrollo del proyecto del Nuevo Centro de San Juan, se recomienda la aprobación de la enmienda propuesta.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el inciso
(d) del Artículo 13, de la Ley Núm. 81 de 23 de junio de 1971, para que se lea como sigue:
(a) (d) En todo caso en que se trate de bienes adquiridos por la Corporación, mediante traspaso héchole por el Estado Libre Asociado, o por cualquiera de sus agencias, en virtud de la facultad concedida en este Artículo y conforme a las demás condiciones y requisitos establecidos en esta ley, la Corporación, deberá, retener, cuando menos, la nuda propiedad de los mismos, en cualquier enajenación que realice de tales bienes en favor de cualquier persona que no sea una agencia del Estado Libre Asociado de Puerto Rico, para propósitos de estructurar los fines públicos que informa esta ley.
La Junta de Gobierno de la Administración de Terrenos de Puerto Rico podrá eximir de esta disposición a cualquier proyecto que estime conveniente, en interés del desarrollo del Nuevo Centro de San Juan. Su determinación estará basada en las recomendaciones, debidamente fundamentadas, de la Junta de Directores de la Corporación del Nuevo Centro de San Juan.
La Junta de Gobierno de la Administración de Terrenos de Puerto Rico promulgará la reglamentación necesaria para cumplir con los propósitos de este inciso." Sección 2.- Esta Ley comenzará a regir inmediatamente después de su aprobación.

To amend subsection
(d) of Section 13 of Act No. 81 of June 23, 1971, known as the "New Center Corporation of San Juan"; to expedite the acquisition and the sale of land to private enterprises by the New Center Corporation of San Juan to develop projects for public dwellings and diverse uses of social interest.
STATEMENT OF MOTIVES
Subsection
(d) of Section 13 of Act No. 81 of June 23, 1971 which creates the New Center Corporation of San Juan, provides the following: "In such case concerning properties acquired by the Corporation, by conveyance made by the Commonwealth, or by any of its agencies, by virtue of the powers granted in this Section and in accordance with the other conditions and requirements established in this Act, the Corporation shall retain, at least, the nude property thereof, in any alienation carried out of such property in behalf of any person other than an agency of the Commonwealth of Puerto Rico, for purposes of carrying out the public aims embodied in
this Act." This subsection has not only been the cause of concern, but has also been an obstacle to the development of the New Center of San Juan project, because once the Corporation acquires the land this subsection limits the disposition thereof by retaining the nude property. This hinders the financing of the work to be developed. Among the projects to be developed are housing projects to be sold, and cultural or institutional projects of social interest. In order to eliminate any obstacle that would hinder the proper development of the New Center of San Juan project, the approval of the following proposed amendment is recommended. BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Subsection
(d) of Section 13 of Act No. 81 of June 23, 1971, is hereby amended to read as follows: "Section 13.- Transfer of Property and Land.
(a) (d) In every case concerning properties acquired by the Corporation, by conveyance made by the Commonwealth, or by any of its agencies, by virtue of the powers granted in this Section and in accordance with the other conditions and requirements established in this Act, the Corporation shall retain, at least, the nude property thereof, in any alienation carried out of such property, in behalf of any person other than
an Agency of the Commonwealth of Puerto Rico, for the purposes of carrying out the public aims embodied in this Act.
The Board of Directors of the Puerto Rico Land Administration may exempt any project it deems advisable from this provision, as concerns the development of the New Center of San Juan. Its determination will be based on the properly grounded recommendations of the Board of Directors of the New Center Corporation of San Juan.
The Board of Directors of the Puerto Rico Land Administration will promulgate the necessary Regulations to comply with the objectives of this subsection."
Section 2.- This Act shall take effect immediately after its approval.
