Ley 63 del 1980
Resumen
Esta ley enmienda la Ley Núm. 23 de 1952 para aumentar el número de cargos de Procuradores Especiales de Relaciones de Familia en el Tribunal Superior de Puerto Rico. El objetivo es asegurar que cada Fiscalía cuente con al menos un procurador especializado en asuntos de familia, mejorando así la administración de justicia en esta área.

LEY
Para enmendar el Artículo 1 de la Ley Núm. 23 de 24 de julio de 1952, según enmendada, a los fines de aumentar el número de cargos de Procuradores Especiales de Relaciones de Familia.
EXPOSICION DE MOTIVOS
Actualmente existen en Puerto Rico doce distritos judiciales del Tribunal Superior. No obstante, al crearse las nuevas salas del Tribunal Superior no se contempló en la ley de aumentar los cargos de Procuradores Especiales de Relaciones de Familia a fin de poder cubrir dichas plazas para cada distrito y poder así realizar cabalmente las funciones inherentes a este cargo. Debe aclararse que en la Fiscalía de San Juan, por el volumen de trabajo, se utilizan dos Procuradores Especiales de Relaciones de Familia. La legislación actual sólo provee para siete (7) cargos y cuatro (4) cargos adicionales mediante certificación del Secretario de Justicia.
Es necesario que se enmiende la ley que crea cargos de Procuradores Especiales de Relaciones de Familia para el Tribunal Superior a los fines de hacer posible que cada Fiscalía cuente con un Procurador Especial de Relaciones de Familia, excepto San Juan que contará con dos. El aumento en el número de estos funcionarios públicos redundará en una mejor administración de la justicia en Puerto Rico.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el Artículo 1 de la Ley Núm. 23 de 24 de julio de 1952, según enmendada, para que lea como sigue: : :n"Artículo 1: Por la presente se crean doce (12) cargos de Fiscales Especiales Generales, doce (12) cargos de Fiscales, ochenta y seis (86) cargos de Fiscales Auxiliares, once (11) cargos de Procuradores Especiales de Relaciones de Familia para el Tribunal Superior de Puerto Rico y cincuenta y un (51) cargos de Fiscales Auxiliares del Tribunal de Distrito.
El Gobernador podrá autorizar la creación de hasta diez (10) cargos adicionales de Fiscales Auxiliares y diez (10) de
Fiscales Auxiliares del Tribunal de Distrito, mediante certificación del Secretario de Justicia, acreditativa de que hay la necesidad de crear más cargos de Fiscales Auxiliares o de Fiscales Auxiliares del Tribunal de Distrito.
También el Gobernador podrá autorizar la creación de cuatro (4) cargos adicionales de Procuradores Especiales de Relaciones de Familia para el Tribunal Superior de Puerto Rico, mediante certificación del Secretario de Justicia acreditativa de que hay la necesidad de crear más cargos de Procuradores Especiales de Relaciones de Familia para el Tribunal Superior de Puerto Rico.
El Secretario de Justicia, de acuerdo a las necesidades del servicio, podrá autorizar a cualquier Fiscal Auxiliar a desempeñarse en funciones de Fiscal Auxiliar del Tribunal de Distrito y viceversa sin que por ello se entienda cambio en la clasificación del funcionario".
Artículo 2.- Esta ley comenzará a regir inmediatamente después de su aprobación.

To amend Section 1 of Act No. 23 of July 24, 1952 as amended, to increase the number of Special Family Relations Solicitors.
STATEMENT OF MOTIVES
At present there are twelve Superior Court judicial districts. Nevertheless, when the new courtrooms for the Superior Court were created, no provision was made to increase the number of Special Family Relations Solicitors offices in order to fill the positions in each district and thus properly perform the duties inherent to such office. It should be explained that due to the large volume of work at the San Juan District Attorney's Office, two Special Family Relations Solicitors are used. The present legislation only provides for seven (7) offices and four (4) additional offices by means of a certification by the Secretary of Justice.
It is necessary to amend the act creating the offices of the Special Family Relations Solicitor for the Superior Court,
for the purpose of providing each District Attorney's office with a Special Family Relations Solicitor, except for San Juan, which shall have two. The increase in the number of these public officials shall provide a better administration of justice in Puerto Rico.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 1 of Act No. 32 of July 24, 1952 as amended, is hereby amended, to read as follows:
"Section 1.- There are hereby created twelve (12) offices of Special Prosecuting Attorneys-at-Large, twelve (12) Offices of Prosecuting Attorneys, eighty-six (86) offices of Assistant Prosecuting Attorneys, eleven (11) offices of Special Family Relations Solicitors for the Superior Court of Puerto Rico, and fifty-one (51) offices of Assistant Prosecuting Attorneys of the District Court.
The Governor may authorize the creation of a maximum of ten (10) additional offices of Assistant Prosecuting Attorneys, and ten (10) Assistant Prosecuting Attorneys for the District Court, upon certification by the Secretary of Justice attesting to the need to create more offices
of Assistant Prosecuting Attorneys or of Assistant Prosecuting Attorneys of the District Court.
The Governor may also authorize the creation of four (4) additional offices of Special Family Relations Solicitors for the Superior Court of Puerto Rico, upon certification by the Secretary of Justice attesting to the need to create other Special Family Relations Solicitors' offices for the Superior Court of Puerto Rico. The Secretary of Justice may authorize any Assistant Prosecuting Attorney to perform the functions of an Assistant Prosecuting Attorney for the District Court, and vice versa, according to the needs of the service, without it being understood as a change in the officer's classification.
Section 2.- This Act shall take effect immediately after its approval.
