Ley 50 del 1980
Resumen
Esta ley enmienda el Artículo 1.070 del Código de Seguros de Puerto Rico para especificar las organizaciones y entidades excluidas de sus disposiciones generales. Detalla las exclusiones para organismos cuyas actividades de seguros estén reguladas por otras leyes, organizaciones de servicios de salud, y sociedades o asociaciones de socorros mutuos sin fines pecuniarios que ofrezcan planes de servicios médico-quirúrgicos y de hospitalización. Sin embargo, estas últimas deben cumplir con secciones específicas de la Ley Núm. 152 de 1942 y mantener las reservas requeridas.

Para enmendar el Artículo 1.070 de la Ley Núm. 77 de 19 de junio de 1957, según enmendada, conocida como "Código de Seguros de Puerto Rico".
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el Artículo 1.070 de la Ley Núm. 77 de 19 de junio de 1957, según enmendada, para que se lea como sigue: "Artículo 1.070.-Organismos y Entidades Excluidos Sin menoscabo del sentido general de las anteriores disposiciones, este Código no cubrirá ni determinará la existencia de operaciones, contratos, ni funcionarios, directores ni representantes de todo organismo hasta donde sus actividades relacionadas con seguros estuvieron prescritas o permitidas por otra ley expressamente votada al efecto, excepto según se dispone en los Artículos 2.280 y 2.290 de este Código, y excepto aquellos organismos que cualifiquen como organizaciones de servicios de salud conforme a las disposiciones del Capítulo 19 de este Código, ni de toda sociedad o asociación de socorros o auxilios mutuos de fines no pecuniarios fundada en Puerto Rico con anterioridad al 11 de abril, 1899, y que tenga actualmente establecido, mantenga y opere en Puerto Rico cualquier plan de servicios médico-quirúrgicos y servicios de hospitalización a sus socios de cuota sin fines pecuniarios. Sin embargo, estas sociedades y asociaciones excluidas que tengan actualmente establecido, mantengan y operen en Puerto Rico cualquier plan de servicios de hospitalización vendrán obligadas a cumplir con las secciones 7,8 y 10 de la Ley Núm. 152 de 1942 tal como ha sido enmendada o se enmiende y vendrán obligadas a mantener las reservas requeridas a las entidades organizadas bajo esta Ley Núm. 152 de 1942".
Sección 2.- Esta ley empezará a regir inmediatamente después de su aprobación.

AN ACT
To amend Section 1.070 of Act No. 77 of June 19, 1957 as amended, known as the "Insurance Code of Puerto Rico".
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 1.070 of Act No. 77 of June 19, 1957 as amended, is hereby amended to read as follows: "Section 1.070.- Excluded Organizations and Entities. Without affecting the generality of the foregoing provisions, this Code shall not cover or determine the existence of operations, contracts, officers, directors or representatives of any organization to the extent that its insurance operations are prescribed or permitted by any other law expressly enacted for the purpose, except as provided in Section 2.280 and 2.290 of this Code, and excepting those bodies that qualify as health service organizations pursuant to the provisions of Chapter 19 of this Code, or of any relief or mutual assistance nonprofit society or association founded in Puerto Rico prior to April 11, 1899, and
which has at present established, and maintains and operates any medicosurgical and hospital services plan in Puerto Rico for its quota-paying members on a nonprofit basis. However, these excluded societies or associations which have at present established, and maintain and operate any hospital services plan in Puerto Rico shall be bound to comply with Section 7, 8 and 10 of Act No. 152, as heretofore or hereafter amended, and to maintain the reserves required of the entities organized under Act No. 152 of 1942".
Section 2.- This Act shall take effect immediately after is approval.
