Ley 24 del 1980
Resumen
Esta ley enmienda el Artículo 7 de la "Ley Para la Reglamentación e Inspección de los Mercados Agrícolas" para establecer y modificar las sanciones por incumplimiento de sus disposiciones o de los reglamentos y estándares establecidos por el Secretario de Agricultura. Las sanciones incluyen multas por delito menos grave, multas administrativas y la confiscación de productos agrícolas no conformes, con disposiciones para su destino final.

LEY
Para enmendar el Artículo 7 de la Ley Número 241 de 8 de mayo de 1950, según enmendada, conocida como "Ley Para la Reglamentación e Inspección de los Mercados Agrícolas."
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el Artículo 7 de la Ley Núm. 241 de 8 de mayo de 1950, según enmendada, conocida como "Ley Para la Reglamentación e Inspección de los Mercados Agrícolas", para que se lea como sigue: "Artículo 7.-Toda persona natural o jurídica que dejare de cumplir con las disposiciones de esta ley o con todo o parte de cualquier standard o reglamento establecido por el Secretario de Agricultura de acuerdo con las disposiciones de esta ley, incurrirá en delito menos grave y convicta que fuere, será castigada con multa que no será menor de cien (100) dólares ni mayor de doscientos (200) dólares por la primera convicción; y por cada violación subsiguiente será castigada con multa no menor de doscientos (200) dólares ni mayor de quinientos (500) dólares; disponiéndose que cualquier producto agrícola, envase o material de empaque o rotulación del mismo que no estuviere de acuerdo con los reglamentos o standards promulgados por el Secretario de Agricultura y que haya sido objeto de una orden de detención podrá ser confiscado si su dueño o manipulador omitiere proceder en alguna de las formas señaladas en el Artículo 6-A de esta ley, y en tal caso los productos agrícolas, envases o materiales de empaque o rotulación de éstos que fueren apropiados para el uso de hospitales municipales o estatales se enviarán a éstos cuando fuere posible y conveniente hacerlo y los que no fueren enviados a hospitales se venderán en pública subasta, destruirán o usarán para otros propósitos que no sea el uso o consumo humano; disponiéndose que en caso de violaciones al Artículo 6-A, la multa administrativa que impondrá el Secretario de Agricultura será hasta doscientos (200) dólares por la primera vez; y hasta quinientos (500) dólares en grados subsiguientes.
El Secretario de Agricultura queda facultado para imponer multas administrativas hasta una cantidad de doscientos (200) dólares la primera vez, y hasta quinientos (500) dólares por
cualquier violación subsiguiente, cuando se encuentre que no se han cumplido las disposiciones de esta ley o de los reglamentos o standards promulgados de acuerdo con la misma."
Sección 2.- Esta ley empezará a regir inmediatamente después de su aprobación.

AN ACT to amend Section 7 of Act No. 241 of May 8, 1950 as amended, known as the "Act for the Regulation and Inspection of Farm Markets", and finds the same are complete, true and correct versions of each other.

To amend Section 7 of Act No. 241 of May 8, 1950 as amended, known as the "Act for the Regulation and Inspection of Farm Markets".
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 7 of Act No. 241 of May 8, 1950 as amended, known as the "Act for the Regulation and Inspection of Farm Markets," is hereby amended to read as follows: "Section 7.- Any natural or artificial person who fails to comply with the provisions of this Act, or with all or part of any standard or Regulations established hereunder by the Secretary of Agriculture, shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of no less than one hundred (100) dollars nor more than two hundred (200) dollars for the first offense, and in case of recidivism, by a fine of no less than two hundred (200) dollars nor more than five hundred (500) dollars; Provided, that any farm product, container or material for the packing or labeling of the
same, not in compliance with the Regulations and standards promulgated by the Secretary of Agriculture, and which has been subject to a detention order, may be seized, if its owner or dealer neglects to act as set forth in Section 6-A of this Act, and in that case, such farm products, containers or materials for the packing or labeling thereof, as are fit for use in municipal and commonwealth hospitals shall be sent to them whenever possible and convenient, and those not sent to hospitals shall be sold at public auction, or shall be destroyed, or used for purposes other than for human use or consumption; Provided, that in cases of violations to Section 6-A, the administrative fine that the Secretary of Agriculture may impose shall be of not more than two hundred (200) dollars for the first offense, and up to five hundred (500) dollars for subsequent violations.
The Secretary of Agriculture is hereby empowered to impose administrative fines up to an amount of two hundred (200) dollars for the first offense and up to five hundred (500) dollars for any subsequent offense when it is found that the provisions of this Act or the Regulations or standards promulgated under this Act have not been complied with."
Section 2.- This Act shall take effect immediately after its approval.
