Resumen
Esta ley establece la Junta Asesora sobre Transportación de Puerto Rico, adscrita al Departamento de Transportación y Obras Públicas. Su objetivo es formular y coordinar la política pública de transportación en la isla, promoviendo un sistema integrado y seguro que abarca la construcción de carreteras, el transporte colectivo, los servicios aéreos y marítimos, y la prevención de accidentes de tránsito. La Junta asesora al Secretario del DTOP y coordina esfuerzos entre agencias gubernamentales.

Para crear la Junta Asesora sobre Transportación de Puerto Rico, adscrita al Departamento de Transportación y Obras Públicas, definir sus propósitos, facultades, deberes, organización y su relación con los demás organismos gubernamentales; establecer los principios sobre los cuales se formulará la política pública de Puerto Rico en torno al área de transportación; derogar la Ley Núm. 74 de 22 de junio de 1975, según enmendada y para otros fines.
EXPOSICION DE MOTIVOS
Es de conocimiento general que Puerto Rico depende de sus medios de transportación para la circulación en general de personas, bienes y artículos. La transportación es elemento esencial en el quehacer social y económico de Puerto Rico y gran parte de los recursos, tanto del sector público como del sector privado, son dedicados a los distintos medios de transportación.
Una sociedad en estado de progreso y en alto grado de desarrollo depende en gran medida de un sistema de transportación adecuado. El aumento poblacional genera una demanda adicional por más y mejores medios de transportación. El ampliar nuestro sistema de transportación de forma efectiva sirve de estímulo a toda actividad económica y social.
El sistema de transportación como expresáramos anteriormente está relacionado con diversos aspectos de nuestra vida común, ya sean éstos sociales, económicos, políticos y tecnológicos. En los últimos años el sistema de transportación en todos los países del mundo se ha visto afectado por el aumento en el precio de los derivados del petróleo, y no sólo por el precio, sino también por la disponibilidad de dicha materia prima. Esta situación se agrava grandemente por el hecho de que no contamos con el desarrollo de sistemas de transportación que respondan adecuadamente a nuestras necesidades. De establecerse y desarrollarse eficientes sistemas de transportación se reduciría el consumo de derivados del petróleo, con resultados beneficiosos en el orden económico y social.
Nuestro gobierno debe establecer y desarrollar sistemas eficientes de transportación, formulando y manteniendo una política pública sobre transportación que permita una visión integral y
eficaz, coordinando por consiguiente cada uno de los esfuerzos gubernamentales.
Por ello se requiere la creación de una Junta Asesora sobre Transportación de Puerto Rico, la cual integrará y coordinará aquellas funciones relacionadas con la transportación, algunas de las cuales se encuentran fragmentadas o dispersas en diferentes agencias o entidades públicas. Dicha Junta habrá de entender con lo relativo a transportación desde una perspectiva integral con relación a toda acción programativa gubernamental. Así pues, la Junta Asesora Sobre Transportación de Puerto Rico, integrará y coordinará las funciones relacionadas con la transportación, permitiendo un eficaz cumplimiento de la política pública que a estos efectos se desarrolle.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Artículo 1.- TITULO Esta Ley se conocerá como "Ley de la Junta Asesora sobre Transportación de Puerto Rico".
Artículo 2.- Declaración de Política Pública y Propósitos Legislativos.
Se reconoce y se declara pór esta Asamblea Legislativa, como política pública del Estado Libre Asociado de Puerto Rico el establecer un sistema integrado, coordinado y seguro de transportación, basado en los conceptos tecnológicos más modernos y tomando en consideración nuestras necesidades, capacidades y medios. Dicha política pública habrá de fundamentarse, entre otros, en los siguientes principios básicos: a. continuar el Programa de Construcción y Mejoras de Carreteras que interconecten los núcleos urbanos, así como las que dan servicio a las zonas rurales y aquéllas de carácter intraurbano; b. promover los medios de transportación colectiva en los principales centros urbanos y de servicio interurbano, incluyendo zonas rurales, propiciando la operación más eficiente, rápida y segura de éstos; c. promover servicios de transportación aérea y marítima adecuados para el desarrollo socio-económico de Puerto Rico con costos y tarifas razonables;
d. continuar con el Programa de Prevención de Accidentes de Tránsito en las Carreteras; e. la coordinación y revisión conjunta de programas relacionados con el área de transportación adscritos a otras agencias de gobierno.
Artículo 3.- Junta de Transportación; Creación y Composición Se crea adscrita al Departamento de Transportación y Obras Públicas de Puerto Rico, la Junta Asesora sobre Transportación de Puerto Rico.
Este organismo estará integrado por el Secretario de Transportación y Obras Públicas, quién será su presidente, el Director de la Oficina de Energía de Puerto Rico, el Superintendente de la Policía, el Presidente de la Comisión de Servicio Público de Puerto Rico, el Presidente de la Junta de Planificación de Puerto Rico y dos (2) ciudadanos particulares, que serán nombrados por el Gobernador de Puerto Rico, y quienes habrán de estar relacionados con el sistema de transportación en Puerto Rico. Los miembros así nombrados deberán poseer conocimientos satisfactorios en el área de la transportación, así como gozar de excelente reputación dentro de la comunidad puertorriqueña.
Uno (1) de los miembros nombrados por el Gobernador servirá por un término de dos (2) años y el otro servirá por un término de cuatro (4) años. Los nombramientos sucesivos se harán por términos de cuatro (4) años cada uno y hasta que sus sucesores sean nombrados por el Gobernador y tomen posesión del cargo. Los miembros de la Junta que no sean funcionarios públicos tendrán derecho a recibir dieta de cincuenta dólares ( $50.00 ) por cada día que asistan a reuniones de la Junta.
Cuatro (4) miembros constituirán quórum y los acuerdos se tomarán por mayoría de los presentes.
La Junta se reunirá, por lo menos, una (1) vez al mes, en reunión ordinaria y podrá reunirse todas las veces que lo estimen pertinente, previa convocatoria del Presidente, en reuniones extraordinarias.
La Junta adoptará y aprobará un reglamento para regular sus asuntos a tono con esta ley.
El Gobernador podrá destituir a cualquier miembro de su cargo por negligencia en el desempeño de sus funciones, conducta
inmoral, o cualquier otra causa razonable, previa notificación y audiencia.
Artículo 4.- Poderes y Funciones La Junta Asesora sobre Transportación de Puerto Rico tendrá la encomienda de asesorar al Secretario del Departamento de Transportación y Obras Públicas en la determinación de la política relacionada con el servicio de la transportación. Habrá de servir de instrumento eficaz para mejorar la coordinación entre las diversas agencias estatales con responsabilidad en el área de la transportación.
Artículo 5.- Informes La Junta rendirá, a través del Secretario del Departamento de Transportación y Obras Públicas, informes trimestrales al Gobernador de Puerto Rico sobre el desarrollo de sus trabajos. Rendirá además un informe anual al Gobernador y a la Asamblea Legislativa de Puerto Rico sobre la labor realizada por dicha Junta, con las recomendaciones que estime pertinentes y necesarias en cuanto a mejorar los sistemas integrales de transportación de Puerto Rico.
Artículo 6.- Cláusula de Separabilidad Si cualquier disposición de esta ley fuere declarada inconstitucional o nula por un tribunal competente, la misma no afectará ninguna otra disposición de esta ley.
Artículo 7.- Derogación Cualquier ley o parte de la misma, resolución conjunta o actuación gubernamental que contradiga en alguna parte esta ley quedará derogada al entrar en vigor la misma.
Se deroga la Ley Núm. 74 de 22 de junio de 1975, según enmendada.
Artículo 8.- Vigencia Esta ley empezará a regir treinta (30) días después de su aprobación.

To create the Puerto Rico Advisory Board on Transportation, attached to the Department of Transportation and Public Works; to define its purposes, powers, duties, organization and relationship with other government bodies; to establish the principles on which the public policy for transportation will be formulated in Puerto Rico; to repeal Act No. 74 of June 22, 1975, as amended, and for other purposes.
STATEMENT OF MOTIVES
It is of general knowledge that Puerto Rico depends on its means of transportation for the movement of persons, goods and things. Transportation is an essential element in the daily, social and economic life of Puerto Rico and a great part of the resources from the public, as well as the private sectors, are dedicated to the various means of transportation.
A progressive and highly-developed society depends to a great measure on an adequate system of transportation. The population growth generates an additional demand for more and better means of transportation. The effective expansion of our transportation system serves as a stimulus
to the whole economic and social activity. As mentioned above, the transportation system is related to several phases of our lives in common, be they social, economic, political and technological. During the last few years, the system of transportation in all the countries of the world has been affected by the price increases in fossil fuel derivates and the availability of said raw material. This situation is greatly affected due to the fact that we lack the development of our transportation system which will respond adequately to our needs. If efficient transportation systems were established and developed, the consumption of oil by-products would be greatly reduced, thus producing beneficial economic and social results.
Our government should establish and develop efficient transportation systems, formulating and maintaining a public transportation policy which will allow an integral and efficient view, thus coordinating each of the government efforts in this area.
Thus, it is necessary to create the Puerto Rico Advisory Board on Transportation, which will integrate and coordinate those functions related to transportation, some of which are fragmented or dispersed in different agencies or public entities. Said Board shall deal with the problem of transportation from an overall perspective with regard to all the programatic government actions. Therefore, the Puerto Rico
Advisory Board on Transportation shall integrate and coordinate all functions related to transportation, thus allowing the effective compliance of the public policy developed to such effects.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- Title. This Act shall be known as the "Puerto Rico Advisory Board on Transportation Act".
Section 2.- Statement of Motives and Public Policy. The Legislature declares and recognizes as the public policy of the Commonwealth of Puerto Rico to establish an integrated, coordinated and safe system of transportation, based on the most advanced technological concepts and taking into consideration our needs, capabilities and means. Said public policy shall be based on the following basic principles among others. a. continue the Program for Construction and Improvement of Highways which connect the urban nuclei, as well as those serving the rural zones and those classified as interurban; b. promote mass transportation on the main urban centers and interurban services including rural areas, propitiating their more efficient, rapid and safe operation; c. promote adequate air and marine transportation services with reasonable costs and rates for the
socioeconomic development of Puerto Rico; d. continue the Traffic Accident Prevention Program; e. the joint coordination and revision of programs related to transportation, attached to other government agencies.
Section 3.- Board on Transportation; Creation and Composition.
The Puerto Rico Advisory Board on Transportation is hereby created, attached to the Department of Transportation and Public Works.
This body shall be composed of the Secretary of Transportation and Public Works, who shall be its Chairman; the Director of the Puerto Rico Office of Energy, the Police Superintendent, the Chairman of the Puerto Rico Public Service Commission; the Chairman of the Puerto Rico Planning Board and two (2) private citizens, to be appointed by the Governor of Puerto Rico, and who shall be related to the transportation system in Puerto Rico. The members thus appointed shall have satisfactory knowledge in the area of transportation, as well as an excellent reputation within the Puerto Rican community.
One (1) of the members appointed by the Governor shall serve for a term of two (2) years and the other shall serve for a period of four (4) years. Successive appointments shall be made for a period of four (4) years each, and until their successors are appointed by the Governor and
take office. The members of the Board who are not public officials shall be entitled to per diems at a rate of fifty dollars ( $50.00 ) for each day they attend the meetings of the Board.
Four (4) members shall constitute a quorum and the agreements shall be adopted by a majority of those presents. The Board shall hold ordinary meetings at least, once (1) a month, and shall hold special meetings whenever it is deemed pertinent, after being duly called by the Chairman. The Board shall adopt and approve bylaws to regulate its matters pursuant to this Act.
The Governor shall remove any member for negligence in the performance of his duties, immoral conduct, or any other reasonable cause, after due notice and hearing.
Section 4.- Powers and Duties The Puerto Rico Advisory Board on Transportation shall be charged with advising the Secretary of the Department of Transportation and Public Works in the determination of the policy related to the transportation services. It shall serve as an effective instrument to improve the coordination among the various Commonwealth agencies involved in the area of transportation.
Section 5.- Reports The Board shall render quarterly reports through the Secretary of the Department of Transportation and Public Works, to the Governor of Puerto Rico on the development
of its work. It shall also render an annual report to the Governor and the Legislature of Puerto Rico on the work performed by said Board, with the recommendations deemed pertinent and necessary with regard to improving the integral transportation systems in Puerto Rico.
Section 6.- Separability Clause If any part of this Act is declared unconstitutional or null by a Court of competent jurisdiction, the judgment rendered shall not affect any other provision of this Act.
Section 7.- Repeal Any Act or part thereof, Joint Resolution or government action contrary to any part of this Act shall be repealed upon the effective date of this Act.
Act No. 77 of June 22, 1975 as amended, is hereby repealed.
Section 8.- Effectiveness This Act shall take effect thirty (30) days after its approval.
