LEY

Para adicionar un nuevo Artículo 11 y redesignar el vigente Artículo 11 como Artículo 12 de la Ley Número 10 de 5 de julio de 1973, según enmendada, a los fines de hacer extensivo los beneficios de dicha ley a las familias de ingresos moderados que adquieran por compraventa las viviendas, que bajo el plan de subsidio a intereses sobre hipotecas, sean adquiridas de sus propietarios por la Corporación de Renovación Urbana y Vivienda o por el Banco y Agencia de Financiamiento de la Vivienda de Puerto Rico.

EXPOSICION DE MOTIVOS

Es política pública del Gobierno de Puerto Rico el ampliar las oportunidades para que el mayor número de familias de ingresos moderados cuenten con los medios y alternativas de hacerse de una vivienda propia a través de los distintos programas creados en ley.

A tenor con ese propósito, se enmienda la Ley Número 10 de 5 de julio de 1973, según enmendada, para hacer extensivo los beneficios de esta ley a las familias de ingresos moderados que adquieran por compraventa las viviendas que bajo el plan de subsidio a los intereses de hipotecas hayan sido adquiridas de sus propietarios por la Corporación de Renovación Urbana y Vivienda o por el Banco y Agencia de Financiamiento de la Vivienda a consecuencia del incumplimiento al contrato de hipoteca, o cuando éstos mediante dación en pago hagan entrega de sus casas ante la imposibilidad de cumplir con las obligaciones contraidas u otras razones.

Decrétase por la Asamblea Legislativa de Puerto Rico:

Sección 1.- Se adiciona un nuevo Artículo 11 a la Ley Núm. 10 de 5 de julio de 1973, según enmendada, para que lea como sigue: "Artículo 11.-El Secretario tendrá facultad para hacer extensivo el subsidio a intereses sobre hipotecas a las familias de ingresos moderados que adquieran por compraventa una vivienda, que bajo el plan de subsidio provisto por esta ley, sea adquirida de sus propietarios por la Corporación de Renovación Urbana y Vivienda

• por el Banco y Agencia de Financiamiento de la Vivienda a consecuencia del incumplimiento al contrato de hipoteca, o cuando éstos mediante dación en pago hagan entrega de sus casas ante la imposibilidad de cumplir con las obligaciones contraidas u otras razones. Las familias a quienes se les vendan estas viviendas deberán ser elegibles a los beneficios de esta ley y el subsidio se les concederá por el término y conforme a la escala establecida en el Artículo 6 de esta ley."

Sección 2.- Se redesigna el Artículo 11 como Artículo 12 de la Ley Número 10 de 5 de junio de 1973, según enmendada.

Sección 3.- Esta ley entrará en vigor inmediatamente después de su aprobación.

STATEMENT OF MOTIVES

It is the public policy of the government of Puerto Rico to broaden the opportunities for the largest number of moderateincome families to have the means and choices to acquire their own homes through the different programs created by law.

Pursuant to this objectives, Act No. 10 of July 5, 1973 as amended, is hereby amended to extend the benefits of this Act to moderate-income families under the mortgage interest subsidy plan, who purchase homes acquired from their owners by the Urban Renewal and Housing Corporation because of noncompliance with the mortgage contract, or when resorting to payment in kind, the proprietors turn in their homes because it is impossible for

them to comply with the obligations incurred, or for other reasons.

BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:

Section 1.- A new Section 11 is hereby added to Act No.10 of July 5, 1973 as amended, to read as follows:

Section 11.- The Secretary shall have the power to extend the mortgage interest subsidy to moderate-income families who purchase homes which, under the subsidy plan provided herein, are acquired from their owners by the Urban Renewal and Housing Corporation or by the Housing Bank and Financing Agency because of noncompliance with the mortgage contract, or when they resort to payment in kind, turning in their homes because they find it impossible to comply with the obligations contracted, or for other reasons. Families to whom these homes are sold must be eligible for the benefits of this Act, and the subsidy shall be granted for the term and pursuant to the schedule established in Section 6 of this Act."

Section 2.- Section 11 is hereby redesignated as Section 12 in Act No. 10, of July 5, 1973 as amended.

Section 3.- This Act shall take effect immediately after its approval.
