Ley 137 del 1980
Resumen
Esta ley enmienda la Ley de Bebidas de Puerto Rico para regular el traspaso de espíritus destilados entre almacenes de adeudo. Otorga al Secretario de Hacienda la facultad de promulgar reglamentos, exigiendo vistas públicas para su aprobación. Además, tipifica como delito grave la provisión de información falsa o fraudulenta al erario público sobre el movimiento de espíritus destilados, imponiendo penas de reclusión y/o multas para prevenir el fraude fiscal.

Para enmendar los Artículos 43, 62 y 68 y adicionar el Artículo 119A, a la Ley Núm. 143, aprobada en 30 de junio de 1969, según enmendada, Ley de Bebidas de Puerto Rico, para reglamentar los traspasos de espíritus destilados entre almacenes de adeudo, celebrar vistas públicas e imponer penalidades.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el Artículo 43, de la Ley Núm. 143, aprobada en 30 de junio de 1969, según enmendada, para que se lea como sigue: "Artículo 43.-Control de plantas industriales La custodia de toda planta industrial, los almacenes de adeudo y otras dependencias afianzadas de dichas plantas se regirá por la reglamentación que al efecto promulgue el Secretario".
Sección 2.- Se enmienda el Artículo 62 de la Ley Núm. 143, aprobada en 30 de junio de 1969, según enmendada, para que se lea como sigue: "Artículo 62.-Control de los almacenes de adeudo. La custodia de todo almacén de adeudo público o privado se regirá por la reglamentación que al efecto promulgue el Secretario."
Sección 3.- Se enmienda el Artículo 68 de la Ley Núm. 143, aprobada en 30 de junio de 1969, según enmendada, para que se lea como sigue: "Artículo 68.-Traspaso de espíritus o bebidas alcohólicas entre almacenes de adeudo.
Los espíritus o bebidas alcohólicas podrán ser trasladados de un almacén de adeudo legalmente establecido a otro almacén de adeudo legalmente establecido de acuerdo con la reglamentación que al efecto promulgue el Secretario."
Sección 4.- Se adiciona el Artículo 119A a la Ley Núm. 143, aprobada en 30 junio de 1968, según enmendada, para que se lea como sigue:
"Artículo 119A.-Toda persona natural o jurídica que con el fin de defraudar el erario del Estado Libre Asociado de Puerto Rico ofreciere al Secretario de Hacienda información falsa o fraudulenta en informes o documentos relacionados con el movimiento de espíritus destilados en su poder, incurrirá en delito grave y convicta que fuere será castigada con pena de reclusión por un término no menor de un año ni mayor de cinco años, o con multa no menor de mil ni mayor de cien mil dólares o ambas penas a discreción del Tribunal."
Sección 5.- El Secretario de Hacienda promulgará el reglamento requerido por esta Ley antes de la fecha de vigencia de la misma. Para la aprobación y toda modificación de este reglamento deberá celebrar vistas públicas para dar oportunidad de ser oídas a todas las partes interesadas. Estas vistas públicas se anunciarán por lo menos quince (15) días antes de la fecha señalada para su celebración en dos (2) periódicos de circulación general en Puerto Rico.
Sección 6.- Esta Ley empezará a regir ciento veinte (120) días después de su aprobación.

To amend Sections 43, 62, and 68 and to add Section 119A, to Act No. 143, approved June 30, 1969 as amended,"The Alcoholic Beverages Act of Puerto Rico", to regulate the transfer of distilled spirits between bonded warehouses; to hold public hearings, and to impose penalties.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Section 43 of Act No. 143 approved on June 30, 1969 as amended, is hereby amended to read as follows: "Section 43.- Control of Industrial Plants The custody of all industrial plants, bonded warehouses and other bonded branches of the said plants shall be ruled by the regulations promulgated by the Secretary for such purposes."
Section 2.- Section 62 of Act No. 143 approved on June 30, 1969 as amended, is hereby amended to read as follows: "Section 62.- Control of bonded warehouses. The custody of all public or private bonded warehouses shall be ruled by the regulations promulgated by
the Secretary for such purposes." Section 3.- Section 68 of Act No. 143, approved on June 30, 1969 as amended, is hereby amended to read as follows: "Section 68.- Transfer of Spirits or Alcoholic Beverages between bonded warehouses.
Spirits or alcoholic beverages may be transferred from a legally-established bonded warehouse to another legally-established bonded warehouse according to the regulations promulgated by the Secretary for such purposes." Section 4.- Section 119A is hereby added to Act No. 143, approved on June 30, 1968 as amended, to read as follows: "Section 119A.- Any natural or juridical person who, with the purpose of defrauding the Treasury of the Commonwealth of Puerto Rico offers the Secretary of the Treasury false or fraudulent information in reports or documents regarding the movement of distilled spirits in his custody, shall be guilty of a felony and, upon conviction, shall be punished by imprisonment for a term of not less than one year nor more than five years, or by a fine of not less than one thousand dollars nor more than one hundred thousand dollars, or both penalties, at the discretion of the Court."
Section 5.- The Secretary of the Treasury shall promulgate the regulations required by this Act before the effective date thereof. Public hearings shall be held in order to give the interested parties the opportunity to be heard, for the approval and any modification of these regulations. These public hearings shall be announced at least fifteen (15) days before the date they are to be held, in two (2) newspapers of general circulation in Puerto Rico.
Section 6.- This Act shall take effect one hundred and twenty (120) days after its approval.
