Ley 122 del 1980
Resumen
Esta ley enmienda la Ley Núm. 131 de 1969, que establece el Colegio de Peritos Electricistas de Puerto Rico. Las modificaciones incluyen la definición de la entidad como corporación cuasi pública, sus poderes y deberes (como investigar quejas y suspender licencias), los requisitos de membresía y su gobernanza. Además, establece la obligación de adherir un sello de $3.00 en las Certificaciones de Instalación Eléctrica, cuya venta y administración de fondos involucra al Secretario de Hacienda.

LEY
Para enmendar el Artículo 1, los incisos
(g) y
(h) del Artículo 2 y los Artículos 3, 4, 7, 8 y 9 de la Ley Núm. 131 de 28 de junio de 1969, que establece el Colegio de Peritos Electricistas de Puerto Rico.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmienda el Artículo 1 de la Ley Núm. 131 de 28 de junio de 1969 para que lea como sigue: "Artículo 1.- Se establece el Colegio de Peritos Electricistas de Puerto Rico, el cual estará compuesto por todos los peritos electricistas autorizados por la Junta Examinadora de Peritos Electricistas de Puerto Rico, a ejercer la profesión en Puerto Rico, siempre que la mayoría de dichos peritos así lo acuerde en referéndum que al efecto se celebrará según se dispone más adelante. Este Colegio será una entidad jurídica o corporación cuasi pública que operará bajo el nombre de Colegio de Peritos Electricistas de Puerto Rico y establecerá su domicilio en la capital de Puerto Rico."
Sección 2.- Se enmiendan los incisos
(g) y
(h) del Artículo 2 de la Ley Núm. 131 de 28 de junio de 1969 para que se lean como sigue: "Artículo 2.- El Colegio de Peritos Electricistas de Puerto Rico tendrá los siguientes poderes y deberes:
(a) (g) Deberá recibir e investigar las quejas que se formulen respecto a la conducta de sus miembros en ejercicio de la profesión, pudiendo remitirlas a la Junta de Gobierno para que actúen, y después de una vista preliminar, en la que se dará oportunidad de defensa al interesado, si se encontrara causa fundada, instituir el correspondiente procedimiento de suspensión de licencia ante la Junta Examinadora de Peritos Electricistas de Puerto Rico.
(h) Defenderá los derechos de sus miembros y procurará que éstos gocen del prestigio y respeto necesario para el buen desempeño de su profesión."
Sección 3.- Se enmiendan los Artículos 3, 4, 7 y 8 de la Ley Núm. 131 de 28 de junio de 1969 para que se lean como sigue: "Artículo 3.- Serán miembros del Colegio, todos los peritos electricistas admitidos a practicar la profesión de perito electricista por la Junta Examinadora de Peritos Electricistas de Puerto Rico.
Celebrada la primera junta general del Colegio, ninguna persona que no sea miembro del mismo podrá ejercer la profesión de perito electricista en el Estado Libre Asociado, exceptuando estos casos:
Los peritos electricistas del Ejército de Estados Unidos y de la Marina de Estados Unidos cuando el ejercicio de la profesión se realiza en el cumplimiento de obligaciones oficiales.
Regirán los destinos del Colegio en primer término, su Asamblea General, y en segundo término su Junta de Gobierno.
Sección 4.- Se enmienda el Artículo 4 de la Ley Núm. 131 de 28 de junio de 1969 para que se lea como sigue:
"Artículo 4.-Oficiales"
Los oficiales del Colegio, quienes a su vez lo serán de la Junta de Gobierno, consistirán del presidente, vicepresidente, secretario, tesorero y los vocales que disponga el Reglamento.
Sección 5.- Se enmienda el Artículo 7 de la Ley Núm. 131 de 28 de junio de 1969 para que se lea como sigue:
"Artículo 7.-Suspensión"
Cualquier miembro que no pague su cuota y que en los demás respectos esté cualificado como miembro del Colegio, quedará suspendido como tal miembro, pero podrá rehabilitarse mediante el pago retroactivo de lo que adeude por tal concepto, desde que se le expidió la licencia, o desde su último pago de cuota anual.
Sección 6.- Se enmienda el Artículo 8 de la Ley Núm. 131 de 28 de junio de 1969 para que se lea como sigue:
"Artículo 8.-Sello-Fijación"
Será deber de todo perito electricista adherir un sello de tres dólares ( $3.00 ) que habrá de adoptar oficialmente el Colegio, a todo documento de Certificación de Instalación Eléctrica radicado en cualquiera de las oficinas de la Autoridad de Energía Eléctrica de Puerto Rico tales como:
a) instalaciones soterrados b) sub-estación o switch unit c) instalaciones de postes, alumbrado o líneas aéreas d) por cada metro eléctrico o medidor e) re-inspecciones de instalaciones o monturas para contadores vacantes.
Hasta tanto dicho sello no se hubiere adherido, no podrá radicarse dicho documento o escrito; disponiéndose que el Colegio de Peritos Electricistas de Puerto Rico suplirá los blancos correspondientes, para las certificaciones.
Sección 7.- Se enmienda el Artículo 9 de la Ley Núm. 131 de 28 de junio de 1969 para que se lea como sigue:
"Artículo 9.-Venta
Por la presente se ordena al Secretario de Hacienda, para que a través de las Colecturias de Rentas Internas del Estado Libre Asociado de Puerto Rico, venda los sellos especiales adoptados y expedidos por el Colegio de Peritos Electricistas de Puerto Rico, de acuerdo a los Artículos 1 al 9 de esta Ley.
El Colegio de Peritos Electricistas de Puerto Rico hará entrega al Secretario de Hacienda, de tiempo en tiempo, de un número de sellos suficientes para su venta. El Secretario de Hacienda deberá realizar mensualmente la liquidación del valor total de los sellos rendidos; retendrá el diez por ciento ( 10% ) del total recaudado por concepto de la venta de estos sellos para cubrir parte de los costos administrativos incurridos en la venta de los mismos; y el importe restante lo reembolsará al Colegio de Peritos Electricistas de Puerto Rico. En tanto se verifique la liquidación y reembolso del valor total de los sellos que hubieren sido entregados al Secretario de Ha-
cienda, tanto el producto de los sellos vendidos como los sellos que aún no hubieren sido vendidos, serán considerados para todos los efectos del mismo carácter y condición que valores del Estado Libre Asociado de Puerto Rico, en poder del Secretario de Hacienda."
Sección 8.- Esta ley comenzará a regir noventa (90) días después de su aprobación.

AN ACT
To amend Section 1, subsections
(g) and
(h) of Section 2 and Sections 3, 4, 7, 8 and 9 of Act No. 131 of June 28, 1969, which establishes the College of Expert Electricians of Puerto Rico.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO: Section 1.- Section 1 of Act No. 131 of June 28, 1969, is hereby amended to read as follows: "Section 1.- The College of Expert Electricians of Puerto Rico is hereby established, which shall be composed of every expert electrician authorized by the Board of Examiners of Expert Electricians of Puerto Rico to practice the profession in Puerto Rico, provided a majority of said expert electricians do so resolve in a referendum which shall be held for said purpose as hereinafter provided. This College shall be a juridical entity or quasi-public corporation which shall operate under the name of the College of Expert Electricians of Puerto Rico, and shall establish its domicile in the Capital of Puerto Rico."
Section 2.- Subsections
(g) and
(h) of Section 2 of Act No. 131 of June 28, 1969, are hereby amended to read as follows: "Section 2.- The College of Expert Electricians of Puerto Rico shall have the following powers and duties:
(a) (g) It shall receive and investigate the complaints that may be made in regard to the conduct of its members in the practice of their profession, which complaints shall be sent to the Board of Directors for action, and after a preliminary hearing, in which the interested party shall be given an opportunity for his defense, if well-founded grounds are found, to institute the proper proceedings for the suspension of his license before the Board of Examiners of Expert Electricians of Puerto Rico.
(h) It shall defend the rights of its members and shall see to it that the latter enjoy the necessary prestige and respect for the proper performance of their profession."
Section 3.- Sections 3, 4, 7 and 8 of Act No. 131 of June 28, 1969, are hereby amended to read as follows: "Section 3.- All the expert electricians admitted to the
practice of the profession as expert electricians by the Board of Examiners of Expert Electricians of Puerto Rico, shall be members of the College.
After the first general meeting of the College is held, no person who is not a member thereof may practice the profession of expert electrician in the Commonwealth, except in the following cases:
The expert electricians of the United States Army and the United States Navy when the practice of said profession is performed in compliance with their official duties.
The College shall be governed, first, by its General Assembly and second, by its Board of Directors.
Section 4.- Section 4 of Act No. 131 of June 28, 1969, is hereby amended to read as follows:
"Section 4.- Officials"
The officials of the College who, at the same time, shall be officials of the Board of Directors, shall consist of a President, Vice President, Secretary, Treasurer and the members provided by the Regulations."
Section 5.- Section 7 of Act No. 131 of June 28, 1969, is hereby amended to read as follows:
"Section 7.- Suspension"
Any member who does not pay his dues but who is, in all other respects, qualified to be a member of the
College, shall be suspended as such member, but can be reinstated upon the retroactive payment of his dues owed since he was issued his license, or since his last payment of yearly dues".
Section 6.- Section 8 of Act No. 131 of June 28, 1969, is hereby amended to read as follows: "Section 8.- Affixing of Stamp. It shall be the duty of every expert electrician to affix a three dollar ( $3.00 ) stamp, which is to be officially adopted by the College, on every Certificate of Electrical Installation document filed in any office of the Electric Power Authority of Puerto Rico such as:
a) underground installations b) substantial or switch unit c) installation of posts, lights or overhead lines d) for each electric meter or gauge e) reinspections of installations or mounts for vacant meters.
Said document or writ cannot be filed until such stamp has been affixed; provided that the College of Expert Electricians shall furnish the corresponding forms for the certificates".
Section 7.- Section 9 of Act No. 131 of June 28, 1969, is hereby amended to read as follows: "Section 9.- Sale The Secretary of the Treasury is hereby directed to sell, through the Internal-Revenue Collectors' Offices of the Commonwealth of Puerto Rico, the special stamps adopted and issued by the College of Expert Electricians of Puerto Rico, in accordance with Sections 1 to 9 of this Act.
The College of Expert Electricians of Puerto Rico shall deliver to the Secretary of the Treasury, from time to time, a sufficient number of stamps for their sale. The Secretary of the Treasury shall carry out the liquidation of the total value of the stamps issued, each month; he shall retain ten percent ( 10% ) of the total collected from the sale of the stamps to cover part of the administrative costs incurred in the sale thereof; and the remaining sum shall be reimbursed to the College of Expert Electricians of Puerto Rico. Until the liquidation and reimbursement of the total value of the stamps that have been delivered to the Secretary of the Treasury has been verified, both the proceeds from the sale of stamps and the stamps still unsold, shall be considered for all effects and purposes of the same nature and condition as securities of the Commonwealth of Puerto
Rico in the custody of the Secretary of the Treasury." Section 8.- This Act shall take effect ninety (90) days after its approval.
