Ley 107 del 1980
Resumen
Esta ley enmienda los Artículos 5 y 17 de la Ley Núm. 33 de 1978, conocida como "Ley Contra el Crimen Organizado". Su propósito principal es reemplazar el sistema de sentencia indeterminada por un sistema de sentencia determinada. La ley establece penalidades fijas de reclusión y multas para delitos graves relacionados con el crimen organizado y la destrucción de documentos u objetos, permitiendo ajustes por circunstancias agravantes o atenuantes.

Para enmendar los Artículos 5 y 17 de la Ley Núm. 33 de 13 de julio de 1978, conocida como "Ley Contra el Crimen Organizado", a los fines de sustituir el Sistema de Sentencia Indeterminada por el Sistema de Sentencia Determinada.
Decrétase por la Asamblea Legislativa de Puerto Rico:
Sección 1.- Se enmiendan los Artículos 5 y 17 de la Ley Núm. 33 de 13 de julio de 1978, conocida como Ley Contra el Crimen Organizado, para que se lean como sigue:
"Artículo 5.-Penalidades
Toda persona que viole cualquiera de las disposiciones del Artículo 3 de esta ley incurrirá en delito grave y convicta que fuere será sancionada con pena de reclusión por un término fijo de quince (15) años. De mediar circunstancias agravantes, la pena fija establecida podrá ser aumentada hasta un máximo de veinticinco (25) años; de mediar circunstancias atenuantes, podrá ser reducida hasta un mínimo de diez (10) años.
El Tribunal, a su discreción, podrá imponer la pena fija de reclusión establecida o pena de multa no menor de cinco mil (5,000) dólares ni mayor de veinticinco mil (25,000) dólares, o ambas penas." "Artículo 17.-Destrucción de Documentos u Objetos. Cualquier destrucción, mutilación, alteración, ocultación, remoción, o cualquier otro daño a los documentos u objetos solicitados por el Secretario de Justicia constituirá delito grave y será sancionado con pena de reclusión por un término fijo de tres (3) años. De mediar circunstancias agravantes, la pena fija establecida podrá ser aumentada hasta un máximo de cinco (5) años; de mediar circunstancias atenuantes, podrá ser reducida hasta un mínimo de dos (2) años."
Sección 2.- Esta ley comenzará a regir cuando entre en vigor la ley que establece el Sistema de Sentencia Determinada en Puerto Rico.

AN ACT
To amend Section 5 and 17 of Act No. 33 of July 13, 1978, known as the "Act Against Organized Crime", for the purpose of replacing the Indeterminate Sentence System by the Fixed Sentence System.
BE IT ENACTED BY THE LEGISLATURE OF PUERTO RICO:
Section 1.- Sections 5 and 17 of Act No. 33 of July 13, 1978, known as the Act Against Organized Crime, are hereby amended to read as follow: "Section 5.- Penalties Any person who violates any of the provisions of Section 3 of this Act shall be guilty of a felony, and, upon conviction, shall be punished by imprisonment for a fixed term of fifteen (15) years. Should there be aggravating circumstances, the fixed penalty herein established may be increased to a maximum of twentyfive (25) years; should there be extenuating circumstances, it may be reduced to a minimum of ten (10 years).
The Court, in its discretion, may impose the established fixed penalty of confinement or the penalty of a fine of no less than five thousand (5,000) dollars nor more than twenty-five thousand (25,000) dollars, or both penalties". "Section 17.- Destruction of Documents or Objects Any destruction, mutilation, alteration, concealment, removal or any other damage done to the documents or objects requested by the Secretary of Justice shall constitute a felony and shall be sactioned with imprisonment for a fixed term of three (3) years. Should there be aggravating circumstances, the fixed term established may be increased to a maximum of five (5) years; should there be extenuating circumstances, it may be reduced to a minimum of two (2) years".
Section 2.- This Act shall become effective when the Act to establish the Fixes Sentence System in Puerto Rico takes effect.
